According to Jeffrey Toobin's new book on the Supreme Court, Justice David Souter nearly resigned in the wake of Bush v. Gore, so distraught was he over the decision that effectively ended the Florida recount and installed George W. Bush as president.

In "The Nine," which goes on sale Sept. 18, Toobin writes that while the other justices tried to put the case behind them, "David Souter alone was shattered," at times weeping when he thought of the case. "For many months, it was not at all clear whether he would remain as a justice," Toobin continues. "That the Court met in a city he loathed made the decision even harder. At the urging of a handful of close friends, he decided to stay on, but his attitude toward the Court was never the same."

That's more than I could say for Justice Sandra Day O'Connor, the quitter when our Country needed her most.

I guess the old adage about giving a women a man's job applies.

Souter is one of the few Justices who actually takes his job seriously and follows the Constitution.
I am so pleased he stayed and hope we get more judges like him.

I never got "check and balances" when the court members serve as long as they want, do as they please, and often go unmonitored by the press despite making some decisions that are just as important as any congressman or senator...

Souter is the most intelligent member of the Court. He could see not only the travesty of justice, but the coming disaster this would spell for the nation's future.
He will be remembered as the best of this Supreme Court, and a true foe of the 'judicial activism' of Roberts, Alito, and Scalia.

Oh yea, sure. This mental giant of the court was also part of the majority on Kelo v. City of New London.

For a group that is so loud about the decline in civil rights under the current administration, I'd think you'd be up in arms over this decision, basically expanding the role and use of eminent domain.

just found this .. .seems as though Justice Souter is a decent man:

"In the disputed presidential election of 2000, Souter agreed with the majority of the Court that Florida's recount process was unconstitutional, but agreed with the dissent that the Court was without legal authority when it decided to terminate the recount process in Bush v. Gore (2000). Souter, the former state supreme court justice, would instead have given the Florida Supreme Court more opportunity to supervise a constitutional recount process. In searching for a middle ground between terminating the election outright and finding no constitutional problem at all in Florida's recount process, Souter displayed in a dramatic setting the independent‐mindedness, restrained view of the Court's role, and search for intermediate solutions typical of his work. Similarly, he coauthored, along with Justices Sandra Day O'Connor and Anthony Kennedy, the well‐known joint opinion in Planned Parenthood of Southeastern Pennsylvania v. Casey (1992), which reaffirmed Roe v. Wade's (1973) constitutional protection of a woman's right to terminate a pregnancy. Casey rested in significant part on a strong justification of the values associated with adherence to precedent that is consistent with Souter's views in other contexts. "

The ones who should have resigned (under force if necessary) is that group of right wing swindlers who stole the election for Doofus Dubya.
For a long time, the Republicans have ignored merit and appointed ideologs to the Court. That is criminal, unAmerican or rather anti-American. For it undermines the proper functioning of our government. When judges are crooked, the whole of society is spoiled. It is worse than the criminality of that torture loving AG Gonzales, for from them there is no appeal.
