The foreman of the jury in Phil Spector's murder trial told the judge Tuesday that the panel is at an impasse of 7 to 5, but he did not indicate which way it was leaning.

"At this time I don't believe that anything else will change the positions of the jurors," the foreman said when Superior Court Judge Larry Paul Fidler asked if there was anything he could do to help.

Polled individually, some jurors agreed with the foreman and others disagreed. One suggested further instruction about reasonable doubt.

By the looks of Spector,he is not going to make it to another trial. He looks like death warmed over. Oh and the jury - Morons. Pull your heads out of your asses. He is guilty. If she wanted to commit suicide do you think she would do it in his house? I am pretty sure she sobered up in time to get the hell out of there before she did something she would regret and did not make it. He is one creepy looking dude.

The Instructions to The Jury are half the problem. They state early on that it must be by a preponderance of evidence, BEYOND a reasonable doubt.
After the Defense poured on the expert$ and Ms Baden poo pooed and obfuscated with vigor, there was that little bit of DOUBT. That was all they needed, a doubter or two.

"I think I killed somebody"...(I forgot her name), and I have the gun with blood on my hands, I'm in a daze, I'm dead drunk.

That was enough for most of us...but apparently not them.

The diapered-astronaut starts tomorrow....
She looks like she wants to take the stand.
Then we'll get another OJ trial, Court TV will cover the earth.

All facts must be proved beyond a reasonable doubt. Preponderance is the civil standard of proof.

The jury instruction for reasonable doubt rules out slight doubt or imaginary doubt, as all facts are subject to these.

The admission "I think I killed somebody," was enough for me. The experts were smoke and mirrors.

Also, courtv is no longer covering trials but will be led by that legal wizard Starr Jones.

Isn't the foreman an engineer? I used to work for engineers and I'm married to one. They over-analyze everything. Great with bridges and buildings. Not so great with gun-crazy nuts. And, yes, I know it's a defendant's right to testify or not and the jury isn't supposed to infer anything if the defendant doesn't testify in his own defense. But come on - if that was me and I was innocent, my lawyer could talk until s/he was blue in the face. I'd testify!!!

Absolutely. They always do in high profile cases.

Usually, the defendant takes a deal when faced with retrial. Spector reportedly refused a deal before, though. It could be a rare retrial and the prosecution will know everything the defense is likely to do and will be prepared for it.

I've been a trial lawyer in Southern California for over 25 years and I will tell you a great secret that everyone ignores:

IF THE DEFENDANT DOESN'T TESTIFY, HE IS GUILTY.

Every time I had an innocent defendant, I had him or her testify.

I watched about 90 percent of the Spector trial over the web feed on KTLA. He's guilty.

According to interviews done with Spectors now-adult son, 'gunplay' style violence was a common occurance in the Spector household the entire time the boy was growing up, and the son corroborates the other womens testimony of prior acts of violence involving Spector and handguns. And I'm sorry, but seeing how batsh*t crazy he looked sitting right there at the defendants table, one can only imagine how 'pleasant' he must have been, drunk, angry, and armed with a handgun - not enough money in the world to keep me with a loon like Spector, thank you very much..! ;) ...

Honestly, never underestimate the ignorance of a jury and their 'star-struck' behavior. Were they following the same trial the rest of us were?!

When I was selected for a jury trial, I was amazed how all common sense eludes jurors.

When I read this article I just shook my head. This guy is a gun-crazy lunatic, and needs to go away for a long time.

I swear it is impossible to find 12 people in LA that are not blinded by fame. What a joke. You wonder why people see you as the shallowest and most easily duped citizenry in the country? It's because you are and every time a high profile case comes your way you turn on the klieg lights and switch off your brain. I am sure after they let this lowlife piece of garbage off there will be half the jury hiring agents to push a new book on how they thought he was guilty but couldn't prove it. They have no problem putting every poorly represented and equally impoverished minority away for life but if you produced a few albums, hold some rushing records or made TV shows with a bird you are always not guilty beyond a reasonable doubt. Ironic that it comes from the most unreasonable jury pool in the country.

Also anyone that pulls a gun on John Lennon should be put away for that alone.

Sorry, Phil wasn't married to his current wife when the murder happened. This wife (before she was even a wifely gleam in Phil's eye) was actually hired to be the assistant to the assistant Phil had when the murder happened. Got that? I know it's hard to follow if you're not a CourtTV junkie. The assistant who holed up with Phil for about 10 days after the murder and then had a falling out with Phil and quit. The assistant who wasn't called by either side. Now, her story I'd love to hear.
