Jack L. Goldsmith, a Harvard law professor who led the Justice Department office that objected to a Bush administration domestic eavesdropping plan, told a Senate committee on Tuesday that the situation became a "legal mess" because the White House did not believe either the courts or Congress had any role to play.

Professor Goldsmith told the Judiciary Committee that chances to create a legally justified program were undercut by senior White House officials who were averse to any restraint on presidential power and devoted to extreme secrecy.

"It was the biggest legal mess I had ever encountered," said Professor Goldsmith, who raised his objections to the program run by the National Security Agency while head of the Office of Legal Counsel.

He also said David Addington, Vice President Dick Cheney's counsel, told him that his position might mean failure to halt a new terrorist attack that would leave him with the blood of thousands on his hands. Professor Goldsmith was greeted largely as a hero by Democrats on the Judiciary Committee who praised him for standing up to enormous pressure with his objections.

This proves that Gonzales lied to the Congress, and there should be something they could do to get the little varmint.

Goldsmith could not, really, go public at the time, as Bush/Cheney would have had his shot, probably, to prevent it.

We do need to act now, to stop Cheney and Bush from destroying the country. Impeach Cheney and then Bush ten days later.

why is it that these EXPERTS only find a way to speak honestly well after the crucial time when they could have possibly done something to put a halt to the criminal actions of the Admin.?

Had both Greenspan and Goldsmith spoken up sooner, perhaps it would have thrown a wrench into the unchallenged diabolical works of Bush and Dicktator

I also want to know how the administration can prohibit Goldsmith from discussing his legal analysis and providing it during the Senate Judiciary.

How do you classify an individuals thoughts?

I agree with many others who said it would have been far better if Goldsmith had been forth-coming about his objections at the time this was happening. It would have prevented the loss of Constitutional freedoms and rights (privacy) for American citizens. He, like Greenspan, did nothing daring (speak out, or call attention to serious issues) at the time these proporsals were being sought. Instead, they played and went along to advance their own careers, at the expense of their integrity and professional ethics. Now, they are cashing in big-time bringing out all of these "problems" with the failed policies of the Bush presidency.
As for the Bush administration, they have committed so many impeachable offenses, it would be difficult for our weak-kneed Congress, and lackey media/press to conduct an appropriate or adequate inquiry into all of the shady dealings that got us to this point. It seems the media and lawmakers on the hill are following suit. They're staying for the ride, to advance their careers, cash in on the gravy train until the music stops. Then, they'll all retire, write books and hit the lecture circuit about how awful things were, and they objected but couldn't do anything.

Oh stuffing. You talk as though administration officials had power. They were the front "persons". Bush and Darth Vader made all the decisions and the interns, political hacks carried out their orders. Career government employees stuck it out as long as they could. Even the generals waited til they retired to begin to denounce and expose Iraq for its folly.

Your logic doesn't seem to apply to Goldsmith since his perceived stance within the administration nearly cost him a position at the Harvard Law School and I can't imagine it endeared him to his superiors. People fail to respond to various situations for reasons having nothing to do with complicity, greed/self aggrandisement, or cowardice. It's not difficult to use hindsight to be critical but ultimately it accomplishes little. I'd say it's too bad that the Bush administration didn't have more people like Goldsmith and Comey.
