It took until early this morning, but, as expected, the Senate intelligence committee has passed its surveillance bill. Also as expected, retroactive legal immunity for telecommunications companies complying with President Bush's warrantless surveillance program is part of the bill. Not exactly as expected: it won't be the FISA Court that determines who complied with the program. It will be the attorney general:


The Senate bill would direct civil courts to dismiss lawsuits against telecommunications companies if the attorney general certifies that the company rendered assistance between Sept. 11, 2001, and Jan. 17, 2007, in response to a written request authorized by the president, to help detect or prevent an attack on the United States.

Suits also would be dismissed if the attorney general certifies that a company named in the case provided no assistance to the government. The public record would not reflect which certification was given to the court.

Rachel Maddow had on a spokesperson from Dodds campaign and he said Dodd was going to filibuster this!
And thats a great political move for Dodd.
It shows he willing to do something and not just say 'wait til I'm president THEN I'l get things done'. Hillary and Obama are Senators and they aren't doing anything now! We have to wait until they are president before they can do anything! I am sick of the do-nothing dems!

Much ado about nothing! If you read the fine print AND see where the process is at, it is nowhere near as damaging as it is made out to be in a headline like this!!!

First, the main catch is "written request authorized by the President". What about the illegal datamining that has been going on without any check and balances? Secondly, this covers 9/11 and afterwards. What about the period before that when Quest, I think, started supplying information? Thirdly, the AG still has to be confirmed and Fourthly, the "bill" still needs to be vhetted by Patrick Leahy and Co. AND pass through the Senate and the House

The third and fourth points cover a long protracted prosess. On October 8th or 9th, the Dems introduced a Bill that builds more safeguards vis-a-vis FISA and Civil Liberties and the right to privacy

There is lot of frustration on the more left wing of the Democratic Party and justifiably so. Nevertheless, these "caving in" headlines are more a manifestation of that frustration than the realities on the ground ...

Republicans are focusing on an allegation in a recent book by two Pulitzer Prize-winning reporters, which suggests Clinton listened to a secretly recorded conversation between political opponents.

In their book about Clinton’s rise to power, Her Way, Don Van Natta Jr., an investigative reporter at The New York Times, and Jeff Gerth, who spent 30 years as an investigative reporter at the paper, wrote: “Hillary’s defense activities ranged from the inspirational to the microscopic to the down and dirty. She received memos about the status of various press inquiries; she vetted senior campaign aides; and she listened to a secretly recorded audiotape of a phone conversation of Clinton critics plotting their next attack.

“The tape contained discussions of another woman who might surface with allegations about an affair with Bill,” Gerth and Van Natta wrote in reference to Clinton’s husband, former President Bill Clinton. “Bill’s supporters monitored frequencies used by cell phones, and the tape was made during one of those monitoring sessions.”

A GOP official said, “Hillary Clinton’s campaign hypocrisy continues to know no bounds. It is rather unbelievable that Clinton would listen in to conversations being conducted by political opponents, but refuse to allow our intelligence agencies to listen in to conversations being conducted by terrorists as they plot and plan to kill us. Team Clinton can expect to see and hear this over and over again over the course of the next year.”

Gerth told The Hill that he learned of the incident in 2006 when he interviewed a former campaign aide present at the tape playing. He has not revealed the aide’s identity. Clinton’s campaign has not disputed any facts reported in the final version of his book, which became public this spring, he said.

“It hasn’t been challenged,” said Gerth. “There hasn’t been one fact in the book that’s been challenged.”

Incidentally, the photo of Bush that you've placed atop this piece really illustrates the physical deterioration that Bush has undergone these past years doing "god's" work.
