Kudos to Chris Dodd whose third-tier-nothing-to-lose presidential campaign has sprouted him a robust pair of cojones. Dodd became the most prominent Democrat, and the first among 2007-10-30-mukasey.jpg
the presidential candidates, to declare he will vote against Bush nominee Michael Mukasey's confirmation as Attorney General.

Angered by Mukasey's Senate testimony last week in which the former federal judge and prosecutor floated a legal "theory" that the President of the United States could, indeed, stand above constitutional statutes, Dodd declared on Monday:

"That is about as basic as it gets," Dodd said. "You must obey the law. Everyone must."

Dodd, along with a slew of other legal and political observers were also dismayed when Mukasey dodged Senators' questions last week about whether or not so-called waterboarding was, in fact, a form of torture. After eluding any straight answer, Mukasey wound up making the incredulous statement that he wasn't quite sure what was meant by the term.

Over the weekend, some leading Senate Democrats ranging from Dianne Feinstein of California to Carl Levin of Michigan engaged in their own form of equivocation, warning they might vote against Mukasey if he doesn't properly clarify his views when he responds to written questions from the Senate later this week.

But Dodd's bold stepping-out on this issue, rejecting any mulligan for a nominee who refuses to call torture by its proper name, seems like it might force the hand of fellow Democrats who might start looking rather silly if they don't turn thumbs down on the newly proposed AG. Within hours of Dodd's statement, fellow candidate and Delaware Senator Joe Biden also said he had made up his mind to vote nay. Campaign spokesmen for John Edwards and Bill Richardson also joined the chorus. And by late Monday night, the campaign of Barack Obama piled on, telling The New York Sun:

"Judge Mukasey has failed to send a clear signal that he understands the legal and moral issues that are at stake for our country, and so I cannot support him." Mr. Obama said even a clarification from Judge Mukasey would be insufficient. "No nominee for attorney general should need a second chance to oppose torture and the unnecessary violation of civil liberties," he said.

After this barrage, Mukasey's nomination might be dead in the water -- if you'll excuse the pun.

Hillary & Obama are frontrunners because of the millions they have raised Obama is not a leader. Chris Dodd has shown us time after time he is willing to speak out about protecting our rights and and the constitution. If he had raised the millions Hillary's & Obama's have he would be the frontrunner. Chris Dodd has the guts, experience and knowledge and intellect to lead this country. Chris Dodd, President Joe Biden VP sounds like a good ticket to me

Dems plus Bernie Sanders plus maybe one or 2 Republicans will get about 39 votes against Mukasey, meaning he gets confirmed, but the Dems can act as if they opposed him. It'll all be staged.

MUKASEY MUST NOT BE CONFIRMED! Any Democrat who votes to confirm will indicate his/her acceptance of the "unitary" presidency.

The following is from an editorial in today's New York Times: "...Michae­l Mukasey was asked an important question about Congress's power at his confirmation hearing. If witnesses claim executive privilege and refuse to respond to Congressional subpoenas in the U.S. attorney's scandal - as Karl Rove and Harriet Miers have done - and Congress holds them in contempt, would his Justic Dept. refer the matter to a grand jury for criminal prosecution, as federal law requires?

Mr. Mukasey suggested the answer would be no. That was hardly his only slap-down of Congress. He made the startling claim that a president can defy laws if he or she is acting within the authority 'to defend the country.'
That is a mighty large exception to the rule that Congress's laws are supreme."

And to add insult to injury, Mukasey said he didn't know whether waterboarding was torture.

This is a great reason why we're all best served with Dodd in the Senate rather than him trying to shoot for the presidency. It's apparently very hard to find senators who don't lie down whenever Bush wants something.

If Bush wants to appoint Mukasey, he must be BAD. Bush only names incompetent people to positions of authority. Most of the Justice Department is now being run by graduates from a 4th tier law school, run by Pat Robertson.

None of the Republithugs currently in trouble (there are so many it's hard to keep up) use 4th tier law school lawyers, they get those Harvard grads to represent them in their criminal trials. Fourth tier maybe good enough for Justice but NOT for criminal Republithugs.

The Dems could have (and still could) put the brakes on all this horseshit the day they took over in Congress. It's called impeachment. But the cowardly little grandma in charge, Blinky McWinkingstein (Pelosi), wouldn't (won't) do it.

Maybe one day you will stop swallowing the Dem kool-aid of "Waa Waa, we can't do anything because we don't have a super majority". A circumstance, by the way, which never hindered the Repubs when they ran things.

Agreed. But that's only because democrats actually investigate the nuance of arguments and occasionally have opinions that diverge. Meanwhile, the GOP is set on stonewalling ANY potential progress by a democrat led congress so they vote as a block regardless of the issue. We've never had such a do-nothing congress or as many filibusters as we do now, and that can be attributed ENTIRELY to the Republicans refusal to engage in any progress.

Has anybody noticed the number of issues lately where the lead story begins with the words "Dodd leads...?" I think leadership matters, and Dodd is the only Democrat showing any capacity to lead on the issues that matter. Guess that means he dosen't get to be president according to pundit logic and public disinterest in reality. Speaking of the public, saw a poll this morning that shows 52% support military action against Iran. Looks like a "long dark night before this thing is done."

If nothing else comes of Dodd's campaign for president other than defeating Mukasey for Attorney General, he's a success in my book.

I still don't understand why there hasn't been a WORD to Mukasey about appointing a special prosecutor or two or three to go after the numerous criminal cases against members of the administration from former AG Gonzales to Hatch Act violations involving Karl Rove to contempt of Congress for Miers and others. This should have LED the list of requirements for the new Attorney General!!

Dodd is gaining support because he has shown that he can act when he should. And if 52% of the country wants military action against Iran, then the country is stupider than I think. What poll was it?
Maybe Chris Dodd should have a chance to speak to the people on the issue. He has the courage and has opposed that idiocy while HRC was approving.

Sadly I think the only reason Dodd is speaking the truth is because he knows he has nothing to lose. He knows that he will never be nominated.­...so why not? He does not have to cater to special interests or grovel for their votes because he will not be getting them anyway. He is a free man and can speak freely and honestly Something this country needs.

I cannot believe after over 200 years OUR Republic is debating habeus corpus. A corner stone to democracy. How much history are the NEOCONs going to rewrite or undo. It is a burden of the state to prove why a person should be held in detention. Secondly, the entire purpose of our country is the president is not above the law. The Law of the Land must be upheld. I did not give Dodd much thought until now. At this point, he will get my vote here in Illinois in February. I like Obama, but Obama is becoming too much like Hillary, who is too controlled. I want candidates who say what they think.

I also like Kucinich, but I do remember when he was mayor of Cleveland and nearly destroyed the city. He also has no chance of winning the nomination, and Dodd just could do it.

Dennis lost his mayoralty over his fight to preserve an electric utility from privatization. But that utility is still public! So he won. And afterwards they elected him Congressman.
