With the support of Schumer, Feinstein and the committee's nine Republicans, Mukasey has garnered enough support to clear the panel and move to the Senate floor.

Before Feinstein's announcement, sent to the media by e-mail at about 4:28 p.m., the nomination had seemed in doubt, especially after Judiciary Chairman Patrick Leahy (D-Vt.) announced his opposition to Mukasey at a 3 p.m. news conference in Burlington, Vt. Leahy became the fifth Judiciary Committee Democrat to announce his opposition over Mukasey's refusal to state explicitly that the interrogation technique known as waterboarding constitutes torture.

Hours before Leahy's press conference, however, Schumer in a telephone call already had laid out his thoughts to the chairman and also relayed a message that Feinstein had planned to support the nominee, according to aides.

But Schumer and Feinstein withheld announcing their decisions until late that afternoon. For Schumer, a decisive meeting came later in the day, around the same time as Leahy's press conference. Mukasey assured him he would enforce any law Congress passes to explicitly state that certain interrogation techniques -- such as waterboarding -- are illegal under U.S. torture laws.

Trying to hide their votes by announcing their intentions over the weekend, as though liberal Democrats lose the ability to read a newspaper or surf the Web on a Saturday or a Sunday? Guess what, Chuck and DiFi? It didn't work! We're pissed, and if I ever have the chance to see either one or both of you in person I will spit the most disgusting hocker I can cough up directly into your beady little traitorous eyes, because that is the only kind of respect you deserve. And I don't even care if I'm waterboarded because of it, since I have the balls that you and the rest of the Democratic Party do not, and I am also willing to stand up for the original principles of my once-beloved nation, which you also do not.

Schumer and Feinstein have done the right thing on this vote. Holding up a nominee because he won't read the script on an issue is not a good practice. If the Democrats want to make waterboarding illegal it the way to do it is to pass legislation clearly explicitly making waterboarding illegal, not by holding some sort of meaningless political theater like they have done. Of course, there are many who are fooled by the dog and pony show, think it makes a difference and don't understand to actually do something the senate must legislate. So the shows go on and no laws are passed, all talk and only talk.

I pray they pay a huge political price for their betrayal of principles and of their fellow Democrats on the committee. We don't want any more political whores from any party continuing to block the will of the people. No matter what their reasons or excuses, they've sided with and enabled Mr. Bush, which is the last thing the American people want them to do.

Diane Feinstein is not a Democrat. After looking at her voting record she is a bush enabler among Dem Bush enablers.
feinstein, reid pelosi, Clinton, hoyer and Obey all must go. i am on the fence about shcumer. Oh almost forgot...Rockefeller must also go.
Feinstein, reid and pelosi are the top three weak kneed , bush enabler Democrats and must be replaced by people with backbone, integrity and true progressive values.
Enough of these sell outs!

If Schumer timed this to avoid liberal anger it did not work. I am liberal and I am ripshit.

Can Schumer time torture so it doesn't hurt.

Schumer lost the liberal vote, he better cozy up to the NRA before the next election. The right has shorter attention spans and memories than the left.
They might forget he is for gun control.
Maybe he should convert to Baptist too.
That may help him with the Christian right vote.
