With the support of Schumer, Feinstein and the committee's nine Republicans, Mukasey has garnered enough support to clear the panel and move to the Senate floor.

Before Feinstein's announcement, sent to the media by e-mail at about 4:28 p.m., the nomination had seemed in doubt, especially after Judiciary Chairman Patrick Leahy (D-Vt.) announced his opposition to Mukasey at a 3 p.m. news conference in Burlington, Vt. Leahy became the fifth Judiciary Committee Democrat to announce his opposition over Mukasey's refusal to state explicitly that the interrogation technique known as waterboarding constitutes torture.

Hours before Leahy's press conference, however, Schumer in a telephone call already had laid out his thoughts to the chairman and also relayed a message that Feinstein had planned to support the nominee, according to aides.

But Schumer and Feinstein withheld announcing their decisions until late that afternoon. For Schumer, a decisive meeting came later in the day, around the same time as Leahy's press conference. Mukasey assured him he would enforce any law Congress passes to explicitly state that certain interrogation techniques -- such as waterboarding -- are illegal under U.S. torture laws.

Excuse me!! Liberal anger?? How about just plain old middle of the road law-abiding American anger? It's outrageous that these two Dems have once again buckled under threats from Bush. Why are people so insistent on protecting this lawbreaker? What are they afraid of? I'm seriously beginning to wonder, with all the illegal spying Bush has been doing, if he's got files on his political opponents, just like Nixon. What's to stop him?

Feinstein has long been one I have emailed to when I liked or did not like what she was doing. I emailed her upon hearing her decision to accept waterboarding as not being torture and let her know what I thought about it and of course she will send her form letter "so glad you shared your opinion". It's like my ex husband used to say "I am so glad you can have an opinion,now just keep it to yourself". I believe any positive vote for this man is a vote to accept waterboarding in the name of our country as to not be torture while I know in my heart, my soul, it is very much torture. Anyone who votes for this guy should get a ticket to waterboarding school so they can try it out. I have seen it being shown on tv and it was torture and cannot imagine it to really happen to me. I wasted an email on Feinstein for sure this time.

C-Span had an entire segment of 40 minutes on Saturday morning devoted solely to democrats answering the specific question "what do you think of Schumer and Feinstein endorsing this man's nomination for AG.Not one of the dems had anything that was positive regarding their ploy.In fact most were outraged.These are reguar people given a voice on the Washington Journal daily TV show not pundits,not editors parsing words,not paid staff.If they hoped to sneak in the dead of "political night" their endorsement they failed miserably.I am stunned that Schumer is such a cop out.I have seen Feinstein do this before during senate hearings so she did not surprise me at all.Time to send these 2 on a one way ticket to NY and Cal. respectively.

The Republican position seems to be that Congress has to pass laws in order to hold that specific methods like waterboarding are to be considered torture. Nonsense.

The Supreme Court has ruled on the judicial litmus test for the Eighth Amendment. Among the four principles laid out by Justice Brennan are that a punishment may not be degrading to human dignity and that a punishment is not allowed if it is clearly and totally rejected by society.

By these standards any federal judge would be obliged to rule that waterboarding is cruel and unusual. This is a matter of interpreting the existing law, and therefore it is for judges and lawyers to decide, not legislators.

Feinstein will use any stupid excuse to keep those who elected her from finding out that she really is a closet Republican. Like: I had to vote like this because of that and the other. If I hadn't voted like this, the other might have turned out like such and such or even [god forbid] like that.

Schumer. I'm disgusted by his actions on this matter. I thought he was a better man and now I find myself wondering just who among them really can be depended upon to fight for what's right. I agree with the earlier post by Hopalong that this is politics/money and it's heartbreaking to see that Schumer can sell out on such a vital issue. I never did think much of Feinstein. Is it too much to hope that their constituents will recall them?

Why did they even do it? Thay are in safe seats, and Feinstein will likely not run again in 2012.

There has to be some reason, and I would would like it publicized, because it will not be anything they want made public.

Schumer and Feinstein are acting like so many junkies on Capital Hill. There reaches a point where the stories and excuses just get so unbelievably absurd they don't merit trying to understand or tolerate. They got their fix and this isn't the last time. This all ends when everyone is in the gutter or these addicts are forcibly stopped.
