Martha Stewart Living Unit Sues Sears Canada

A unit of Martha Stewart Living Omnimedia Inc sued Sears Canada Inc on Wednesday for breach of contract, alleging it had not paid the required royalties under a licensing agreement.

MSO IP Holdings Inc licensed Sears Canada to use the "Martha Stewart Everyday" trademark and was owed about C$1.82 million under their agreement, according to the complaint filed in U.S. District Court in Manhattan.

MSO said Sears sent it a partial royalty payment in September, but the balance remained unpaid.
