WASHINGTON — Former CIA Director Porter Goss never criticized plans to destroy interrogation videotapes, a lawyer said Thursday as the investigation began shaping up as a matter of competing storylines.

Jose Rodriguez, the CIA official who gave the order to destroy the tapes, is at the center of Justice Department and congressional investigations into who approved the plan and whether it was illegal. His attorney, Robert Bennett, said Goss and Rodriquez met several times to discuss the tapes and Goss was never critical of Rodriquez' decision.

After a first round of hearings on Capitol Hill, the top Republican on the House Intelligence Committee said Rodriguez defied orders that the tapes be preserved.

Bennett disputed that in a telephone interview, saying Goss offered Rodriguez "not a word of criticism when they met, either before or right after the destruction."

The tapes, made in 2002, showed the harsh interrogation by CIA officers of two alleged al-Qaida terrorists, both of whom are known to have undergone waterboarding, which gives the subject the sensation of drowning.

Rodriguez was the head of the CIA's National Clandestine Service, which oversees spying operations and interrogations. Bennett said Goss was "well aware of the situation" when Rodriguez gave the order to destroy the tapes in November 2005.

Asked this week about whether he approved the decision, Goss refused to discuss it. He said he would likely be able to talk about it someday, but not now.

Other intelligence officials familiar with Goss' thinking say he recommended against the tapes' destruction. But they would not discuss the dispute publicly because of the ongoing investigation.

Investigators want to know how the plan worked its way through the Bush administration _ from the CIA to the Justice Department and White House _ and who signed off on it.

Attorney General Michael Mukasey recently went outside of Washington and picked John Durham, a career federal prosecutor from Connecticut, to oversee the tapes investigation. Lawmakers have pledged to continue with their inquiry despite the criminal case.

Rodriguez was scheduled to testify on Capitol Hill this week. Rep. Pete Hoekstra, R-Mich., the Intelligence Committee's top Republican, said he wants Rodriguez to help lawmakers determine who made the final call to destroy the tapes.

Because of the criminal case, however, Bennett told lawmakers his client would not testify without a promise of immunity. That could torpedo the criminal case, since anything said under an immunity deal can't be used in court.

Lawmakers pledged not to do anything to jeopardize the criminal case.

I now know why no one will go to jail on this. It's right there in the article. It was 'recommended' that the tapes not be destroyed. He wasn't told; "Don't destroy the tapes". This is how the CIA and the white house will get out of it. Congress will look at it and say; "Hey, he did a stupid thing. Since it was 'recommended' that he not destroy the tapes and not 'do not destroy the tapes', then there is nothing we can do. However, we will set up a commitee to see that it doesn't happen again". Case closed!

I believe there are large parts of CONGRESS that don't believe they are accountable to Congress. In an environment where Congress refuses to stand up for itself, why should any agency run in fear? If the intelligence community acted in self-interest or in response to orders (or an "understanding with") the executive branch, a little "Boo!" from the House isn't going to make anyone jump.

here's what we are expected to believe:

that the current president who has in his possession battlefield trophies such as saddam hussein's golden pistol and was promised to be able to view bin laden's head packed in dry ice and is known to get all school girly giddy when a combat veteran regales him with tales of the battlefield had NO IDEA OR INTEREST AT ALL in seeing those "EVILDOERS" get "smoked" (or watered) "out"... "dead or alive"... etc etc etc...

here's what's likely closer to reality - bush and cheney both have copies of the tapes and regularly masturbate while viewing them. but they're gonna string up the grunt they ordered to destroy the originals.

The tapes were destroyed because too much information was revealed during the torture session. That has to be why 'they' risked getting caught breaking the law and defying orders to preserve them. Every other excuse that is attempted is pure Bushit!!

After seeing how the politicians handled the identity of Valerie Plame, I would have destroyed the tapes too.
While I despise every aspect of this administraion, from the idiot in the White House on down, I understand why a career agent would want to protect the identities of other agents by destroying tapes.
This administration will throw away the lives of CIA agents and assets as quickly as it throws away the lives of soldiers in Iraq.

Yes in fact there never were any tapes as the left wing media states. It is all lies, we don't torture. Don't be fooled, the next attack might be in the form of a mushroom cloud. Iraq is months away from this capability, not to mention stock piles of chemical weapons (don't ask where they came from), but they are an eminent threat to the United States and democracy. There is a solid link between Sadaam and Al Queda (don't look at Egypt, Saudi Arabia, UAE, or Pakistan please). There is no doubt and war is the last means of dealing with this threat. Insurgency, there will be no insurgency. This will be a cake walk, a slam dunk, and we will be greeted with flowers as liberators. This will provide sweeping change through out the region, reshaping it in the form of democracy (I said don't look at Saudi Arabia, UAE, or Pakistan). We must contiue to fight them over there so we do not fight them here. It may take a few days or weeks, but I doubt a few months. Mission Accomplished.

Foreign aid increases to countries that support torture when these countries support torture, according to Noam Chompsky, in "What We Say Goes." Does this make you think about whether it is terror that we are fighting or just a global class war for control of resources and to provide cheap labor?

The majority of the population is in favor of diplomacy rather that the use of force. Public opinion doesn't count. Therefore, there are rogue elements within our government, especially the within the CIA.

The Iraq Study Group, for example, does not even mention what the Iraqi people want as far as the continued occupation. U>S> and Western studies have shown that at least 61% of the Iraqis think that it is legitimate to attack U>S> soldiers and about the same percentage want the U.S out.

The vast majority of this country want U.S. combat troops out of Iraq within six months to a year. The timetable approach has been vetoed by the President who leaves it up to General Petraeus to determine the policy in Iraq. Did Truman allow Douglas Mac Artur to determine the policy? No, the buck stopped with Truman.
