WASHINGTON — The Senate on Tuesday approved new rules for government eavesdropping on phone calls and e-mails, giving the White House much of the latitude it wanted and granting legal immunity to telecommunications companies that helped in the snooping after the Sept. 11 terrorist attacks.

Protection for the telecom companies is the most prominent feature of the legislation, something President Bush had insisted on as essential to getting private sector cooperation in spying on foreign terrorists and other targets. The bill would give retroactive protection to companies that acted without court permission.

The House did not include the immunity provision in a similar bill it passed last year. House Republicans now want to adopt the Senate bill, which would avoid contentious negotiations to work out differences between the competing legislation.

About 40 lawsuits have been filed against telecom companies by people alleging violations of wiretapping and privacy laws.

Bush promised to veto any new surveillance bill that did not protect the companies, arguing that it is essential if the private sector is to give the government the help it needs.

The president called the Senate bill a good piece of legislation that allows the intelligence community to monitor communications of foreign terrorists while protecting Americans' liberties. He urged the House to pass the bill and send it to his desk without delay.

The Senate bill provides "fair and just liability protection to those private companies who have been sued for billions of dollars only because they are believed to have done the right thing and assisted the nation after the September 11th terrorist attacks," Bush said.

House Judiciary Committee Chairman John Conyers said Tuesday he still opposes retroactive immunity.

"There is no basis for the broad telecommunications company amnesty provisions advocated by the administration," Conyers wrote in a letter to White House Counsel Fred Fielding asking for documents about the wiretapping program. The documents have been withheld from Congress.

The 68-29 Senate vote Tuesday to update the 1978 Foreign Intelligence Surveillance Act belied the nearly two months of stops and starts and bitter political wrangling that preceded it. The two sides had battled to balance civil liberties with the need to conduct surveillance on potential adversaries.

At issue is the government's post-9/11 Terrorist Surveillance Program, which circumvented a secret court created 30 years ago to oversee such activities. The court was part of the 1978 Foreign Intelligence Surveillance Act, a law written in response to government abuse of its surveillance authority against Americans.

The surveillance law has been updated repeatedly since then. Congress hastily adopted a FISA modification in August in the face of dire warnings from the White House that changes in telecommunications technology and FISA court rulings were dangerously constraining the government's ability to intercept terrorist communications.

Shortly after its passage, privacy and civil liberties groups said the new law gave the government unprecedented authority to spy on Americans, particularly those who communicate with foreigners.

That law, already extended once, expires Feb. 16.

Doubtful they can work out the differences in the bills by then, Democrats in both the Senate and the House prepared short-term extensions that would keep the law in effect for several more weeks. Senate Republican leader Mitch McConnell of Kentucky blocked an extension attempt Tuesday. Rep. Lamar Smith of Texas, the senior Republican on the House Judiciary Committee, said Republicans in the House would fight another extension.

The White House said Bush would not sign another 15-day extension of the law.

"The intelligence community needs this good, long-term legislation, not a patchwork of extensions," presidential spokeswoman Dana Perino said. "The House is risking national security by delaying action, and the president will not sign another extension."

On the way to passage, the Senate rejected by a vote of 67-31 a move to strip away a grant of retroactive legal immunity for the companies. It also rejected two amendments that sought to water down the immunity provision.

One of the amendments, co-sponsored by Republican Arlen Specter of Pennsylvania and Democrat Sheldon Whitehouse of Rhode Island, would have substituted the government for the telecom companies in lawsuits, allowing the court cases to go forward but shifting the cost and burden of defending the program.

The other, pushed by California Democrat Dianne Feinstein, would have given a secret court that oversees government surveillance inside the United States the power to dismiss lawsuits if it found that the companies acted in good faith and on the request of the president or attorney general.

While giving the White House what it wanted on immunity, the Senate also expanded the power of the court to oversee government eavesdropping on Americans. The amendment would give the FISA court the authority to monitor whether the government is complying with procedures designed to protect the privacy of innocent Americans whose telephone or computer communications are captured during surveillance of a foreign target.

The bill would also require FISA court orders to eavesdrop on Americans who are overseas. Under current law, the government can wiretap or search the possessions of anyone outside the United States _ even a soldier serving overseas _ without court permission if it believes the person may be a foreign agent.

"You don't lose your rights when you leave American soil," Sen. Ron Wyden, D-Ore., said in an interview. Wyden wrote the provision into the bill when it was still being considered by the Senate Intelligence Committee. "In the digital age, an American's rights shouldn't depend on their physical geography."

I was beginning to feel sorry for Hillary and was thinking about voting for her in the Texas primary, but after this..................... no way. And what was Webb thinking?

I am mad as hell. The right rants and raves about illegal aliens, and then protects their corporate masters who might have crossed the line. And a bunch of Democrats vote with them. This is the end of the Democratic party. It is time for a change: a new party with ideas and convictions that understands that the saying is "We the people" not we the corporate masters.

I am an Obama supporter, but let's get the facts correct. I am VERY disappointed that Obama was so close by today and he did not show up to vote against this important bill. His vote would not have mattered (to kill it), but it would have been nice for him to show support for Dodd and Feingold.

Without researching this, but why isnt this unconstitutional in that it is an impairment of contractual rights. when we entered in to the agreement with the carriers wasnt it understood they would hold the information confidential. After the fact the government changes the obligations. Unconstitutional? Any one know the actual case law?

The Constitution angle has to do with protection against unlawful search, and the government's NOT unlimited power to write laws.

The violation of contract is not a Constitutional question, it is an issue between two non-governmental parties, but still one worth a civil lawsuit.

How the Hell did this happen?

Harry Reid had two bills to work with on FISA in December.

#1 Senate Judiciary bill. A very good bill with NO immunity and NO expanded spy powers for Bush.

#2 Senate Intelligence bill. A very bad bill which actually had input from Darth Cheney. This one gave immunity and expanded spy powers to Bush.

So which one did Harry Reid (with the approval of Democratic party leadership) choose to advance?

Harry advanced the bad Intel bill which today cleared the Senate.

He didn't vote as he was so nauseated by its intent, he had no intent to sell out the public or thier rights. I respect him for it. Let me remind the senate, until we have martial law, nobody has a legal right to spy on anyone without their written or verbal consent. Proof? When the feds wanted to tap my phones, computer, enter my home, car, they had to have my verbal and written consent first. I gave it as I wasn't the target. Had I said No, they would have been screwed. If they couldn't do this without my consent, nobody is going to tap my phone without it. I have every intent to take this one to court if they do. Bush isn't above the law, and can be civilly sued for this. My case, which has written documentation out the wazoo would prove, if they feds can't do it, nor can bush nor the telecoms. This isn't about fighting terrorism, its to out anyone who dare go against Bush or cheney. Paranoid assholes. Folks, they are trying to force martial law down our throats as we speak. Why was Billary missing? I remember when Hillary’s serial adulterer husband was running for president in 92. I also remember all the scandals about his infidelities and her/his association with the Bush family/Mena - Iran Contra, CIA drug money laundering. The Clintons then promised to be agents of change like she’s claiming she is now. So what did Hillary’s serial adulterer accomplish? He shoved NAFTA down our throats against the will of the majority of the people. The “man of the people” lied, begged, borrowed and bribed to get it passed by a Democratic majority Congress. Hillary was busy attacking the doctors in our health care system and saying no way to a single payer health insurance system that would leave out the parasitical health insurance companies. Those same companies are now giving her record numbers of campaign contributions. Déjà vu.

After passing NAFTA, her serial adulterer husband then bailed out the Mexican and New York banks to the tune of over $50 billion of taxpayers money. Yes, they started bailing out the rich early in their 1st term in the White House. Remember how he felt “our” (the working class) pain, even though his actions contributed to it?

In 96 Bill & Hillary gave us the Telecommunications Act, which allowed media consolidation. That’s why we now have to take our truth to the internet.

Bill & Hillary then cut the capital gains tax rate to 15% so the people that feed off of the working class pay a lower tax rate than the working class that creates the wealth. Bill’s so called balanced budget was achieved by smoke and mirrors -- he “borrowed” our social security funds to cover the actual deficits they were truly running. Bush followed suit and now they’re claiming social security is in a crisis. Thanks Bill! Now Hillary wants to finish it off by handing our social security accounts to Wall Street, just like Bush tried to do.

Now the Wynn family dynasty of Vegas is backing Hillary, along with the international bankers. In their last administration, the White House was frequently visited by drug lords such as Jorge Cabrera, red Chinese and other questionable people. Don’t forget that Bill pardoned Mark Rich just before leaving office. Don’t tell me Ken Starr investigated White Water/Mena and found nothing. I’ve read elsewhere that he stopped the investigation because he found dirty Republicans, ie Bush family connections, and had to stop the investigation because the media back then didn’t have the power to cover it all up.

Hillary can’t tie herself to Bill’s coattails without also wearing his jacket and taking credit for his failures and scandals. I am ashamed to admit I voted for Bill back then. If I’d had the internet then, I wouldn’t have made that mistake. We have the internet now and have no excuse for believing the Clintons fantasy campaign screenplay.

You should be afraid……of the Clinton’s getting back in the White House!

Not all of them did it for him --Quest didnt and they lost every govt contract and sunk the company. Good ol govt pressure .
