WASHINGTON — The House Judiciary Committee sued former White House Counsel Harriet Miers and White House chief of staff Joshua Bolten on Monday, setting up a constitutional clash over the Bush administration's refusal to provide testimony and documents about the firing of U.S. attorneys.

The lawsuit says Miers is not immune from the obligation to testify and that she and Bolten must identify all documents that are being withheld from Congress regarding what Democrats say were politically motivated dismissals of nine U.S. attorneys.

In a statement announcing the lawsuit, House Judiciary Committee Chairman John Conyers said, "We will not allow the administration to steamroll Congress."

Conyers, D-Mich., said he is confident the federal courts will agree that the Bush administration's position is at odds with constitutional principles.

The case was assigned to U.S. District Judge John Bates, an appointee of President Bush and a former prosecutor in the Whitewater criminal investigation of the Clintons in the 1990s.

The White House said House Democrats "continue to focus on partisan theater."

"The confidentiality that the president receives from his senior advisers and the constitutional principle of separation of powers must be protected from overreaching and we are confident that the courts will agree with us," said White House press secretary Dana Perino.

The House committee early last year subpoenaed Bolten for documents and Miers for testimony in trying to make a case that the White House directed the firing of nine U.S. attorneys because they were not supportive enough of Republicans' political agenda.

On Bush's behalf, White House Counsel Fred Fielding said such information is private and covered by executive privilege, the doctrine intended to protect the confidentiality of presidential communications.

The lawsuit pointed out that the White House is making a blanket claim of executive privilege, despite the administration saying the president was not personally involved in communications subpoenaed from Bolten and that the president was not involved in the decision to force U.S. attorneys to resign.

The House passed contempt citations by a 223-32 vote that most Republicans boycotted.

Mickey Edwards, a former Republican congressman from Oklahoma, said it was "embarrassing" that Republican members of Congress are not joining in the attempt to get the administration to respond to the subpoenas. By engaging in partisan warfare, "the Congress itself loses its power, its prestige," said Edwards.

Former House general counsel Stan Brand said it is the first time in history that Congress had become a plaintiff in a civil case against the executive branch over a White House claim of executive privilege.

A week and a half ago, Attorney General Michael Mukasey said he would not refer the House's contempt citation to a grand jury and that neither Bolten nor Myers had committed a crime.

House Speaker Nancy Pelosi, D-Calif., then announced she had given the Judiciary Committee authority to sue Bolten and Myers in federal court.

The lawsuit says:

_The record reveals numerous questionable or outright false statements to Congress and the public by other members of the administration, including purported reasons for seeking the forced resignations and the scope of White House involvement.

_Executive privilege does not cover documents whose contents are widely known, previously released or that were the subject of extensive, previously authorized testimony.

The lawsuit also says Miers' conduct is inconsistent with representations that the Justice Department's Office of Legal Counsel made to Congress in 1971 when OLC was being run by William H. Rehnquist, who later was named to the Supreme Court and later chief justice.

Rehnquist told Congress that a witness intending to invoke executive privilege may not simply ignore a congressional subpoena and fail to appear.

Conyers said the administration "simply will not negotiate towards a compromise resolution, so we must proceed."

Michael Steel, spokesman for House Republican leader John Boehner of Ohio, called the lawsuit "pandering to the left-wing fever swamps of loony liberal activists."

During the Watergate scandal, the Supreme Court confirmed the legitimacy of the executive privilege doctrine. At the same time, the court found the privilege to be qualified and rejected President Nixon's assertion of privilege over the White House tape recordings.

The court ruling prompted Nixon to surrender the tapes to prosecutors and ultimately to resign from office.

Bolton & Meiers are simple robots of a corrupt administration. The current Attorney General, Mukasey, is no different (just like Ashcroft and Gonzales) and will not enforce any law, including a lawsuit from the House of Representatives.

As for the courts being packed by these dictators and their robots. Even Supreme Court Justices can be impeached. -Don't hold your breath on that ever happening.

The problem with this nation is that we voters are ennobling these 'Leaders' by voting for them.

We need a 3rd party desperately. Fire the whole lot come 2012.
One could dream and think this is only the beginning, after Miers and Bolton maybe we go after
Bush & Cheney - yeah right, that is why he spied on them and has one over of them. How else would
one explain their their dead beat lack of action?

I don't like the Clintons. But on the other hand, I am not enamoured of Obama either. I just can't see what all this Obama enthusiasm is about. The only thing positive I can see in Obama is that he's not Hillary. Sorry folks, I just can't get all ginned up about that. Especially when his credentials as a progressive are next to nothing.

There is no need to invent a third party it's already there and it has a true progressive on the ticket named Ralph Nader. Washington insiders hate his guts, the press hate his guts, the corporations fear him.......and hate his guts. The only people who like him are consumers, people with low wage jobs, environmentalist, conservationist, and people who love democracy. Don't wait for Clinton or Obama to inevitably do something dirty. You already know it will happen. Start supporting somebody of integrity right now.

that is the ONLY silver lining we can hope for. the last election gave me hope that i was not the only AMERICAN left on the planet. this election will speak volumes, it already has in numbers, numbers of voters, especially democratic voters, (the only OTHER party). we, as americans, have to continue paying attention to what is actually going on in washington or it will all be lost.
our country will cease to exist....ppfffftttt!

I don't get it. Congress suing for this? It is a Constitutional power. Congress has two methods to deal with this. They've used the statutory method, but not INHERENT CONTEMPT. Under those rules, the Speaker of the House orders the House Sergeant at Arms to go and arrest those in contempt and deliver them to the House. The arrest is under jurisdiction of the House itself, and does not involve the Executive Branch, the Judiciary, the DoJ or anyone. A lawsuit???

Pelosi: DO YER JOB. Order their arrest.

A big problem is with the sergeant of Arms having arrest power outsider of D.C. But this whole show is a stall. Going a route that involves the Supreme Court or the "Justice" Department guarantees it will all be over before a decision can be made. And IF a decision was made prior to Bush leaving office, he would simply pardon those convicted. Solution? Start now putting the machinery to guarantee that all will not be forgotten upon the advent of a new administration. I don't want a show trial and a sop conviction that is overturned by the ex-president as he scurries to a rock to hide under. I want the new crop of politicians in Washington to remember that to legitimize their right to power those who have committed such heinous crimes as they have must be shown to pay for them. Even though treason is a reasonable and possible charge against them, I ask that the death penalty not be invoked. Extradition laws being what they are, that might give them somewhere else on the planet to hide. Also, I would like this plan to prosecute to be made known. I am sure they are not willing to co-operate with Congress because they feel the laws of the United States are either without power or the will to enforce them. All should NOT be kiss and make up/business as usual after an attempt to impose "The Permanent Republican Majority".- an attempted Coup and "Revolution from Above".

How can you justify that unlimited power was merely given to them? Michael Mukasey refused to look into the Contempt of Congress charges despite the fact that Miers and Bolton simply didn't show up which incidentally, is the definition of Contempt of Congress.

Looks like George W. AWOL hired the perfect replacement for Gonzales.
Like Alberto, Mr. Mukasey puts his Yellow Bellied President's well-being ahead of America's!

Calling this "partisan theater" is outrageously ridiculous but very typical

of this maladministration as they stall and wait out the next ten months.

What they expect to follow is the usual call for political healing, all for the

What's been the pro forma response from the right wing about this kind'a stuff? Outrage, of course. Utter outrage. Lke WE don't recall what endless grief the RNC put the WH through in the 90s over the 'earth-shattering' topic of replacing a few leftover moles from the previous admin in the Clinton travel office. The Repub congress squealed like a stuck pig over that subject! And here we are a decade later, they're *indignant* the Dem congress would dare hold WH staff in contempt for the 'minor infraction' of refusing to respond to a government subpoena.
