NEW ORLEANS — Republican Sen. John McCain, campaigning through poverty-stricken cities and towns, said Wednesday he opposes a Senate bill that seeks equal pay for women because it would lead to more lawsuits.

Senate Republicans killed the bill Wednesday night on a 56-42 vote that denied the measure the 60 votes needed to advance it to full debate and a vote. Majority Leader Harry Reid, D-Nev., had delayed the vote to give McCain's Democratic rivals, Sens. Hillary Rodham Clinton and Barack Obama, time to return to Washington to support the measure, which would make it easier for women to sue their employers for pay discrimination.

McCain skipped the vote to campaign in New Orleans.

"I am all in favor of pay equity for women, but this kind of legislation, as is typical of what's being proposed by my friends on the other side of the aisle, opens us up to lawsuits for all kinds of problems," the expected GOP presidential nominee told reporters. "This is government playing a much, much greater role in the business of a private enterprise system."

The bill sought to counteract a Supreme Court decision limiting how long workers can wait before suing for pay discrimination.

It is named for Lilly Ledbetter, a supervisor at the Goodyear Tire & Rubber Co.'s plant in Gadsden, Ala., who sued for pay discrimination just before retiring after a 19-year career there. By the time she retired, Ledbetter made $6,500 less than the lowest-paid male supervisor and claimed earlier decisions by supervisors kept her from making more.

The Supreme Court voted 5-4 last year to throw out her complaint, saying she had waited too long to sue.

Democrats criticized McCain for opposing the bill.

"Senator McCain has yet again fallen in line with President Bush while middle-class families are falling by the wayside," Clinton said in a statement following the vote. "Women are earning less, but Senator McCain is offering more of the same."

Democratic National Committee spokeswoman Karen Finney said: "At a time when American families are struggling to keep their homes and jobs while paying more for everything from gasoline to groceries, how on Earth would anyone who thinks they can lead our country also think it's acceptable to oppose equal pay for America's mothers, wives and daughters?"

McCain stated his opposition to the bill as he campaigned in rural eastern Kentucky, where poverty is worse among women than men. The Arizona senator said he was familiar with the disparity but that there are better ways to help women find better paying jobs.

"They need the education and training, particularly since more and more women are heads of their households, as much or more than anybody else," McCain said. "And it's hard for them to leave their families when they don't have somebody to take care of them.

"It's a vicious cycle that's affecting women, particularly in a part of the country like this, where mining is the mainstay; traditionally, women have not gone into that line of work, to say the least," he said.

McCain chose to visit the tiny hamlet of Inez, Ky., because it is where President Lyndon B. Johnson declared war on poverty. But McCain said Johnson's poverty programs had failed.

"I wouldn't be back here today if government had fulfilled the promise that Lyndon Johnson made 44 years ago," he said.

In recent weeks, McCain has proposed a series of tax breaks for corporations, doubling the dependent child tax exemption, government-backed refinancing for struggling homeowners and a summer holiday from gas taxes. He proposed another new program Wednesday: a tax write-off for companies that provide high-speed Internet access for underserved, low-income communities.

He stumbles, badly, when he's asked where he gets the money to cover the tax breaks.

He started running on "fiscal responsibility" so now has to switch gears to "supply sider" and he's sort of falling apart trying to reconcile the two.

He needs the economic equivalent of Joe Leiberman standing next to him to slip him the "right" answer.

If a woman is not receiving pay equity, file a claim. Don't wait, do it now.

This position assumes that:

1. The woman in question has immediate access to payroll records to make her case.
2. That a pattern of behavior is established in a matter of two or three years.

In other words, even if she has access to payroll info, suing because she was paid less for the same work over a short period of time might not be strong enough evidence for the courts or a jury. So what evolves is a Catch-22. Wait for the pattern to emerge and the courts say she waited too long. Act immediately and the courts say there is insufficient evidence of a pattern of discrimination. At best, women will be left with a "sweet spot" rule, sue after more than 5 but less than 7 years, which I am fairly sure isn't in keeping with the spirit of the anti-discrimination laws.

What this bill says is that instead of starting the statute of imitations for legal action at the first discriminatory paycheck, it sets it as the last paycheck recieved, thus closing the loophole that corporations can pay women less, as long as the womwne don't find out about it right away-
It is really agood law that closes loopholes created by a radical and misguided supreme court interpretion.
Cons voting against it should beashamed

Both Clinton and Obama admitted to not knowing the facts of a gun-related law, and subsequent court case, in the last debate, and that was smart.

They would have looked like idiots, because they hadn't read it.

John McCain could learn from that.

How likely is it that John McCain actually knows what the hell's going on with this legislation? It's intended to address a recent court decision. Like he follows employment law.

Why not just say it?

The case is complicated, and it DID piss women off.

The claimant tried to show that some of her harm was due to a lower pension amount, in the final tally, which makes a lot of sense to most people. If pension is calculated at "high three", or whatever, HER high three were lower.

Unless they're senators married to a beer dynasty, and can wave off all that nit-picky accounting.

The question is when the clock starts ticking. Most corporations have prohibitions against employees discussing their rate of pay. How can you include a time period when a person might not be aware that they are being underpaid?

McCain's argument is not remotely relevant to the bill being debated. Basically he refuses to actually defend his vote and instead deflects claiming women are not well educated lol. The true debate over this bill is should there be a limit on how long after realizing pay discrimination exists can a woman wait before suing. The Republican position is that it should be highly limited so that you reduce litigation against companies. The Democratic position is you do not limit the time to sue so the victim can remain at her job and avoid retaliation for a considerable period of time. Personally I'm not sure how the damages in these cases work, but to me the most moderate and logical position would be to allow full current damages for the first 15 years (with interest), but any time exceeding those years only award the amount equivalent to the lost wages.

Once again, Huffpo slants a story about McCain by headlining it with a picture of Hillary with him. Picture language? "Hillary agrees that women shouldn't be paid the same." The event was some kind of bipartisan photo op about the environment. You remember bipartisanship? Y'all praise it when Barack does it, but when Hillary, who's actually done it more often and more effectively, you call her a sellout and a neocon.

I was trying, idly, to find the image on the net, to see the context. I couldn't find that, but I did find it posted on the National Review Online in September, 2004, by Kathryn Jean Lopez, under the headline, "McCain-Hillary 2008? Hillary-McCain 2008?" So you see what happens to bipartisans: tunnel-vision ideologues attack them. Is that the only picture of McCain they could dig up? Looks a photo op for some kind of environmental cause, no? Alaska drilling?

But the Huffpo crowd will stop at nothing, apparently. Now, McCain did flirt with running as a Democrat. That's already well known. Want to know how to hurt his chances? Do some oppo research into the number of times he's gone across the aisle, which is why The Base hates him. Force him to condemn his past stances, and bring up the painful memories for the Base. (The Republican base: Al Qaeda means "the base." Funny, huh?)
