INDIANAPOLIS — Smoking can be hazardous to your health, and it's turning into a bad career move, too.

A Whirlpool Corp. factory in Evansville, Ind., has suspended 39 workers who signed insurance paperwork claiming they don't use tobacco and then were seen smoking or chewing tobacco on company property. Now, some could be fired for lying, company spokeswoman Debby Castrale said.

As annual health care premiums rise more than 10 percent a year, many companies are trying to rein in costs by encouraging healthy living.

"I can't think of a client of ours who has not shifted their focus to controlling the cost of their health care plan," said Indianapolis benefits lawyer Mike Paton.

Some employers have developed wellness programs to motivate employees, while others ask employees to state on benefits forms whether they use tobacco.

Whirlpool, based in Benton Harbor, Mich., uses financial incentives to encourage U.S. workers and their dependents to abstain from tobacco use, spokeswoman Jill Saletta said. The specifics vary according to location.

In Evansville, the 1,500-employee factory charges tobacco users an extra $500 in annual health insurance premiums. The refrigerator factory has levied the extra premium since 1996, and it depends on employees to honestly fill out forms. It doesn't mandate blood tests to detect nicotine or trail employees outside work, Castrale said.

Management suspended the 39 employees Friday after they were spotted using either chewing tobacco on company property or taking a drag in one of the factory's dozen shelters for outdoor smoking, Castrale said.

"It's definitely not something we wanted to do," she said. "It's unpleasant."

The employees were suspended without pay, and they'll present their case at "fact-finding" meetings before management determines their fate. Whirlpool had to recall some laid-off workers to keep production running due to the suspensions.

A 2007 national survey showed that 16 percent of all large employers _ those with 20,000 or more employees _ adjust health care premium contributions according to the worker's smoking status, according to the human resources consulting firm Mercer.

The federal Employee Retirement Income Security Act limits the changes an employer can make to a health premium because of a worker's unhealthy habits. But it doesn't set parameters on punishment if an employee lies about his or her habit, Paton said.

Lewis Maltby, president of the National Workrights Institute, which advocates for employee privacy, sees no problem with employers trying to curb smoking. But he worries that the trend of cracking down on employees' unhealthy behavior is extending beyond tobacco use.

"We shouldn't have to give employers complete control over our private life so they can save a few dollars on medical care," he said.

If was fraud, and that can hurt the health policies for the rest of the employees and even cost the company much more money in the end. I dont see anything wrong with punishing someone for committing fraud. I mean, its not like its George Bush lying to get his invasion into Iraq, but its still fraud.

Does anyone have statistics on how much childbearing adds to medical insurance costs? And how much do additional dependents on policies cost the plan?

When someone tells me that I can't smoke because of the supposed cost increases, I will need to be compensated for the costs of pregnancy and the coverage of children in the insurance pool.

Why should I give up something that gives me enjoyment, only to spend the savings on the costs incurred by those who chose to add children to an already overcrowded world? Not on my dime.

The whole pogram against smokers and tobacco is little less than another behavioral control experiment to see how sheep can be manipulated, which is EASY:
(1) create "specialness" for or against a behavior
(2) make it a 'class' thing that infers 'specialness', then
(3) tie it to some fear around the body or 'health.'

I'm not arguing that there are not better things for a body, but, get a grip: Stopping smoking while you still devour carcass, and ingest chemicals, and drive crap-spewing luxury SUVs, while thinking all your acquistive, greedy, fear-based thoughts...... AND botox and Blue Cross ain't gonna save your pop culture asses. Grandma smoked 'til 95; Grandad 'til 92. They were happy inside.
Yes, you're special, alright. 'Specially vulnerable and 'specially stupid, and chess pieces for the plutocrats and mad scientists looking for academic favor who enjoy screwing with you while you dream of lattes.

I agree with you, Silvanus, and believe that the demonization of smokers is a test to see just how much people can be manipulated. And it appears that this experiment is a success. However, it will be going bad before long. The more that people quit smoking, and start to notice that cancer rates are increasing, the polluters of this world will be busted. They're making us quit smoking only to die of all the other toxic substances that are entering our bodies against our will. Can't they even let us die of our own accord? Just a little time out of the day to enjoy doing what WE like to do on our time off from work? I guess that's not in the master plan for these capitalist pigs.

Wow -- what a completely misleading headline. I hope it came from the Associated Press, not someone at Huffington Post.
NO ONE at Whirlpool was suspended for "using tobacco" -- they were suspended for LYING about their use of tobacco products on insurance forms. There's a huge difference.
Amazing how few other comments have touched on this little discrepancy...

Sorry chery, in this situation I must side with the "capitalists." I have years, experience, and have been on more than one side. The workers signed a contract. They must have integrity and maintain their side of the contract.

One of my late teen work experiences included steel mill labor. At the time, some idiots set off firecrackers in the mill. The idiots received a suspension. Some workers declared a wildcat strike in support of the suspended workers. I refused to join. The union did not support the suspended workers.

I have also worked in maritime and construction environments. Occasionally, workers would be terminated and banned from the industry for being strung out on drugs or alcohol. Their substance abuse was especially noticed when an "accident" occurred. Often, the "accident" involved operation of heavy equipment and crashing with around a hundred thousand pounds of stuff. In these cases, I cannot support the idiots. The idiots have agreed not to use recreational narcotics. They agreed to support their fellow employees and preserve property of their employer.

I see no difference between situations of my experience and a signed no smoking contract. If these employees receive the benefit and cannot support their side of the agreement, they can go straight to hell.

I was asked a similar question by my employers in about 1992. My response was to ask if they also wanted to know if I was a homosexual, since if I was, I obviously had a statistically much higher chance of catching AIDS and racking up huge medical expenses.

They were highly embarassed by my question, especially since there was a male homosexual smoker present at the time, but they still made me answer, and pay a higher premium for smoking.

Smoking is not illegal - yes it has been restricted but Big Tobacco is still making $$$$$$$ selling cigarettes. So until our government is willing to ban cancer sticks insurance companies should not be allowed to discriminate. As others have already pointed out, when insurance companies are allowed to discriminate and refuse coverage to smokers - how long before they pick the next vice or lifestlye choice to restrict. Nothing ever happens when the bad guys are this rich, they have important friends and lobbyists.

Really? They can't discriminate against Sky Divers, Sports Car Drivers, Motorcycle Owners?

What about people who choose to build homes in flood plains, and on cliffs in Earthquake prone regions? What about trailers in tornado alley?

Insurance Companies are in the business of evaluating risk. Discrimination is their trade.

so then by your logic, anyone, including executives, who are seen drinking alcohol can be fired as well? What about vitamins? What about poppy seeds? What about employees who get speeding tickets? What about those executives who smoke cigars? Where does it end?

So basically, you would grant a corporation the right to control every aspect of an employee's life?

I work for a major corporation. We have a few insurance choices. They all suck and are expensive but I digress. We have two separate plans from the same insurance company, one is a regular HMO the other is the exact same plan except you have to fill out a biannual questionnaire. For answering the questions the participants get their Dr. visit copays cut by half.

I personally pay the extra money because I don’t agree with the entire thing but I have heard from others that do participate. There are questions about Tobacco use, Alcohol use, Height and Weight, and I believe Seatbelt use. There may be other but this will do. If you state that you are a Tobacco user you will have to do a smoking cessation course. At the moment you don’t have to stop but you do have to attend. The same is true for Alcohol and being overweight.

I know one gal that answered as to Alcohol use that she drank one glass of wine a week. The online questionnaire asked he if she would agree to go to counseling for her drinking problem. She said NO since she didn’t think it was a problem, and it would not let her proceed. She finally changed her Alcohol use to none. Another question was about the seatbelt use, what if you have a wreck and your not wearing your seatbelt but you answered that you always did, would they not cover you?

After several states successfully sued Big Tobacco back in the 1990s, we were told the "winners" would be using the settlement money to set up "Anti-Smoking" programs designed to help smokers in those states "kick the habit".

As far as I know, that never happened. Or were a few TV commercials "The Program"?
