A New York City man is suing JetBlue Airways Corp. for more than $2 million because he says a pilot made him give up his seat to a flight attendant and sit on the toilet for more than three hours on a flight from California.

Gokhan Mutlu, of Manhattan's Inwood section, says in court papers the pilot told him to "go 'hang out' in the bathroom" about 90 minutes into the San Diego to New York flight because the flight attendant complained that the "jump seat" she was assigned was uncomfortable, the lawsuit said.

Mutlu was traveling on a a "buddy pass," a standby travel voucher that JetBlue employees give to friends, from New York to San Diego on Feb. 16, and returned to New York on Feb. 23, the lawsuit said.

Initially, Mutlu was told a flight attendant had taken the last seat on the plane, but then he was advised she would sit in the employee "jump seat," meaning he could have the last seat, the lawsuit said.

The pilot told him 1 1/2 hours into the five-hour flight that he would have to relinquish the seat to the flight attendant, court papers say. But the pilot said that Mutlu could not sit in the jump seat because only JetBlue employees were permitted to sit there, the lawsuit said.

When Mutlu expressed reluctance to go sit in the bathroom, the pilot, who was not named in the lawsuit, told him that "he was the pilot, that this was his plane, under his command that (Mutlu) should be grateful for being on board," the lawsuit said.

The aircraft hit turbulence and passengers were directed to return to their seats, but "the plaintiff had no seat to return to, sitting on a toilet stool with no seat belts," court papers say.

Some time later, a male flight attendant knocked on the restroom door and told Mutlu he could return to his original seat, court papers say.

Mutlu's lawsuit, filed Friday in Manhattan's state Supreme Court, says JetBlue negligently endangered him by not providing him with a seat with a safety belt or harness, in violation of federal law.

A JetBlue spokesman declined comment on the lawsuit Monday.

What I find really funny is that all of you assume the story is true. The pilot demanding a person sit on a toilet. LOL.....We'll see when the story really comes out.

That's one of the most insulting things I've ever heard on an airplane. They made a big mistake if they let too many people onto the plane, but just because he's on a buddy pass doesn't mean he has no rights. As far as I know passengers have to be in seats with seat belts. If they were going to put him on a freakin toilet they should have warned him BEFORE he got on the plane. And he was on that toilet for 3 hours! Just because this flight attendant was uncomfortable - shocking! Bad policy and bad public relations - I've got some bad news for Jet Blue: Mutlu is getting paid.

Ah, this is an easy one. They'd have him out of there in a minute and into a comfy seat; if he lit up a cigarette in there. The comfy seat would allow the crew to restrain him safely until he was arrested following landing. Could he still sue? lol

Agree this is easy. The plaintiff's attorney has this one nailed from a safety standpoint - just paint a picture of the poor dude sitting on the can in turbulence. JetBlue will be lucky to settle this one out of court for less than a million...

Poor flight attendant! She was uncomfortable in the jump seat? Awwww! Poor spoiled princess. Sorry she had to undergo such discomfort. No one wants to be uncomfortable. It's understandable that the pilot told the passenger to sit on the toilet seat so that princess could be comfortable. Poor baby! I hope he gets more than the $2 million he's suing for.

Oh, for Pete's sake! The "passenger" hitched a free ride which he had to spend in the loo! Did he get where he was going (for nothing)? And, when you think about it, didn't he probably have a great deal more personal space in the can than he might have had in Seat 41E? Jet Blue should be suinin him! Ungrateful slob!

The airline made a commitment when they accepted his "buddy pass" to board the flight. They were supposed to treat him as a regular passenger. Being bumped by a deadheading employee is not good public relations, Being bumped from your seat while in flight and then not being able to use the jump seat is even worse, and because the deadheader thought her seat too uncomfortable is even worse. To make a passenger sit in the loo is the height of stupidity. Jet Blue has really hit the skids lately. It is only a matter of time before they join Pan Am, Eastern an other ex-airliners not flying the friendly skies of America.

The guy (his lawyer) is asking for so much so the settlement is decent - thats standard. They'll probably settle in the low 6 figures. By the way, punitive damages have often been used to make companies make real policy changes. Big corporations make decisions based on financial gains or losses, so sometimes juries need to give companies a big hit to get them to take notice. Look at all the police depts across the country that didn't get real with their overly aggressive officers until the cities started paying out huge sums of money. It sucks, but thats how it is. When's the last time you were forced to sit on a toilet on a flight?

Do you think a $50 fine would be a sufficient deterrent to prevent it from happening again? A small fine, absorbed by the airline and not the pilot, would turn it into a pilot’s game. The penalty has to be enough to ensure it does not reoccur. The pilot should have his license revoked.

Although jumpseats aren't very comfortable for a long flight, the flight attendant had a safe seat, with a proper restraint. It is not unlikely that a person could be severely injured during turbulence, which can slam a person to the ceiling in a fraction of a second. The pilot in command endangered this man's life, and that issue is more important than the humility of sitting on the toilet. My bet is that JetBlue is going to pay big, and probably quickly and quietly to make this go away. The pilot showed very poor judgement and needs to be punished.

I am astounded. In my opinion they would be getting off cheap. Awards like that are meant to punish a corporation and JetBlue apparently needs to be punished for such egregious behavior.
