ALBANY, N.Y. — Same-sex marriages legally performed elsewhere will be recognized in New York in response to a state court ruling this year, Gov. David Paterson's spokeswoman said Wednesday.

State agencies, including those governing insurance and health care, must immediately change policies and regulations to make sure "spouse," "husband" and "wife" are clearly understood to include gay couples, according to a memo sent earlier this month from the governor's counsel.

Gay marriage is not legal in New York, and the state's highest court, the Court of Appeals, has said it can only be legalized by the Legislature. But the memo, based on a Feb. 1 New York Appellate Division court ruling, would recognize the marriages of New Yorkers who are legally wed elsewhere.

The appellate judges determined that there is no legal impediment in New York to the recognition of a same-sex marriage. The state Legislature "may decide to prohibit the recognition of same-sex marriages solemnized abroad," the ruling said. "Until it does so, however, such marriages are entitled to recognition in New York."

Paterson spokeswoman Erin Duggan said the May 14 memo is intended to guide the actions of state agencies.

The memo states that failure to include gay marriages in the dispensing of state services such as health care benefits could violate state human rights law. The agencies could face sanctions for any violations, the memo warns.

The agency changes can be instituted through internal memos or changes in regulations and would not require legislative action, Paterson counsel David Nocenti said in the memo, which was first reported by The New York Times.

The February appellate decision involved the case of a woman whose female partner was denied health benefits by her employer even though she had been legally married in Canada.

Sure it can. A majority in Massachusetts now support same-sex marriage. But that wasn't true until the courts made it a reality and proved to the citizenry that their foolish fears were unfounded.

Wish i was still in LA for the celebrations. 3 of my freinds are marrying their long term partners. Alas that i am in Indiana and that will never happen for myself and my partner of 8 years.
Kudos for NY. Mybe, just maybe, we are crawling slowly out of the stone age and rejoining the rest of the world.

Great news for a friend of my family who lives in New York. A Cuban-born, deeply Catholic man of African descent with a German Jewish WWII vet partner, nearly twenty years his senior. No greater example of ethnic diversity and racial, generational or religious understanding, in my opinion. When true love is involved, there are no barriers of any kind.

They have been together for over four decades now and are both now retired. This new development will prove highly beneficial for them as they enter their golden years.

Kudos to my home state for making this happen!

This is great news. One day "Separation Of Church And State" will really be recognized and an actual reality for this country. Marriage for all people is an amazing step. And to say someone can't get married because the bible says it's "one man and one woman" is a outrageous and does not belong in politics. You can be moral and have a good heart and center and still manage to keep your own personal religious beliefs out of politics and make decisions that benefit our freedoms and human rights.

So IF the bible says "one man and one woman" (no SAME-SEXED) ... what was the objection to INTERRACIAL marriages of "one man and one woman"??? Surely, the bible must have said "one SAME-COMPLEXIONED man and one SAME-COMPLEXIONED woman"???

My son & his HUSBAND were "domestic partnered" in California, AND "married" in Canada. NOW they can be MARRIED in California! I must say IT'S ABOUT TIME!!! Perhaps there IS HOPE & CHANGE for America, afterall!?

In the next year or so only if they're at the appellate level already, having gone past the trial stage. These types of cases take years to resolve...
