SAN JUAN, Puerto Rico — The Pentagon urged interrogators at Guantanamo Bay to destroy handwritten notes in case they were called to testify about potentially harsh treatment of detainees, a military defense lawyer said Sunday.

The lawyer for Toronto-born Omar Khadr, Lt. Cmdr. William Kuebler, said the instructions were included in an operations manual shown to him by prosecutors and suggest the U.S. deliberately thwarted evidence that could help terror suspects defend themselves at trial.

Kuebler said the apparent destruction of evidence prevents him from challenging the reliability of any alleged confessions. He said he will use the document to seek a dismissal of charges against Khadr.

A Pentagon spokesman, Navy Cmdr. Jeffrey Gordon, said he was reviewing the matter Sunday evening.

The "standard operating procedures" manual that contained the purported instructions was made available to Kuebler last week as part of a pretrial review of potential evidence, the Navy lawyer said.

"The mission has legal and political issues that may lead to interrogators being called to testify, keeping the number of documents with interrogation information to a minimum can minimize certain legal issues," the document is quoted as saying in an affidavit signed by Kuebler.

The document could support challenges by other detainees to suppress confessions at Guantanamo, where the U.S. military says it plans to prosecute as many as 80 of roughly 270 detainees before the first U.S. war-crimes tribunals since World War II.

The case against Khadr, who was captured in Afghanistan when he was 15, is on track to be one of the first to trial. He faces war-crimes charges including murder for allegedly throwing a grenade that killed a U.S. Special Forces soldier during a 2002 firefight.

Kuebler said the nature of the interrogations is particularly relevant in Khadr's case because prosecutors are relying on evidence "extracted" from him at Bagram air base in Afghanistan and at Guantanamo.

"If handwritten notes were destroyed in accordance with the SOP, the government intentionally deprived Omar's lawyers of key evidence with which to challenge the reliability of his statements," Kuebler said in an e-mail to reporters.

The operations manual, which dates to January 2003, was attached to a 2005 report on an investigation into detainee abuse allegations at Guantanamo, Kuebler said. A summary of the findings was released at the time, but the defense lawyer said the section including the manual has not been made available publicly.

The so-called Schmidt-Furlow report documented degrading treatment, including one instance of a top terror suspect forced to dance with another man and behave like a dog. But investigators stopped short of saying torture occurred.

As with all prosecutions in a fair judicial system, the means of collecting evidence is important to the eventual conclusion.

If you torture a 15 year old boy, he is less likely to provide you with an honest confession.

It is evident that the US rounded up the guilty and the innocent (note the hundreds of detainees released without trial). Our Gitmo prison has created far more enemies than allies.

funny how nobody refers to the Bush Administration as "heroes" or "patriots"..... Nobody speaks of Cheney or Dubya as "leaders" nor are the words "competence" or "integrity" showing up next to their names..... So now the way that the prisoners were treated by the government can't be mentioned by the prisoners and the interrogators aren't supposed to leave a paper trail because it could raise "questions"..... nice.....

It should NOT be a surprise to everyone of us that Bush, Cheney and the entire Neo-con gang are capable of doing evil. What has been a surprise is why they are not being held accountable and prosecuted. This goes to show America does NOT have a working democracy and the political system is more corrupt than the American people want to admit. In fact, with the Bush administration (and the GOP) in power, there would never be justice - just corruption after corruption. The Conservatives always cry baby about 'government waste'. But they are perfectly OK with the incredible waste the Bush administration has been exercising: over 500 billion dollars of American taxpayers' money has been spent on a war that benefits only the oil cartel and the military industrial complex, who are laughing all the way to the bank like a bunch of bandits - aided by the very corrupt GOP.

Frankly, I'd be satisfied for a near-term coup in the house; Nancy can lose speakership in the blink of an eye. That's probably why she's trying to pigeon hole the current House Majority Leader to be the "Next Senator from IL." (In today's headlines.)

This should come as a surprise to those of us who can see through the Bush admin's corrupt system. With Cheney at the wheel, every thing that is evil and unethical and illegal is possible and will be exercised to their best interests, at the expense of the wellbeing and security of the American people.

Having that said, this and other crimes committed by the Bush administration should not and must not be ignored. Do remember that no one is above the law, especially those who systematically have been harming this great nation, e.g. traitors like Bush, Cheney, et al.

Sounds good, but when you can do anything otherwise "illegal" and you face absolutely no consequences (except a drop in your popularity), then you are absolutely "above the law."

We should recognize that there is an elite class that continues to operate above the law every single day. When police decline to arrest, when prosecutors decline to prosecute, when Congress declines to impeach, those people enjoy a life above all the laws the rest of us commoners have to follow.

So you can't be tried in the Hague unless your country signs the treaty? The World Court can prosecute anyone it sees fit for violations of international law whether or not that country is a signatory to the Treaty. Just because the United States does not recognize the World Court doesn't mean it does not exist and the United States has no official control over anything the World Court decides precisely because it is not a signatory to the Treaty.

I've seen you and some others say that, but I don't understand how that's relevant. Aren't we signators on the Geneva Conventions? How could we have backed away from the courts that sent so many Nazi's to their deaths? _I_ think all that still applies and I will - WE WILL - NOT let some unratified treaty get in the way of justice being served. FRANKLY, I don't care if we're not an official part of any such treaty. These guys need to see the end of the hangman's noose and by god we're going to get our trials or it'll be the end of this country as we know it! ONE WAY OR ANOTHER.

If we can't get the justice we seek, it might be time for another constitutional convention. The VERY FIRST PARAGRAPH of the preamble to the Constitution says that it's OUR RIGHT to stand up and create a new nation whenever our government fails us, and this time, we can fix whatever flawed language lets Bush and his administration escape justice...

Of course like everything else the Bushavicks do , this too will be forgotten about and never looked into.
There will be a few talking heads who will shrug their shoulders and say,"oops", but no one will really investigate. Remember, they may be democrats and republicans, but underneath it all, they are still greedy selfish politicians and they try very hard not to step on each others toes in cases like this. They know that they too either have done, or will probably do similar and they dont want to be punished for it what they do, or did.
