SAN JUAN, Puerto Rico — The Pentagon urged interrogators at Guantanamo Bay to destroy handwritten notes in case they were called to testify about potentially harsh treatment of detainees, a military defense lawyer said Sunday.

The lawyer for Toronto-born Omar Khadr, Lt. Cmdr. William Kuebler, said the instructions were included in an operations manual shown to him by prosecutors and suggest the U.S. deliberately thwarted evidence that could help terror suspects defend themselves at trial.

Kuebler said the apparent destruction of evidence prevents him from challenging the reliability of any alleged confessions. He said he will use the document to seek a dismissal of charges against Khadr.

A Pentagon spokesman, Navy Cmdr. Jeffrey Gordon, said he was reviewing the matter Sunday evening.

The "standard operating procedures" manual that contained the purported instructions was made available to Kuebler last week as part of a pretrial review of potential evidence, the Navy lawyer said.

"The mission has legal and political issues that may lead to interrogators being called to testify, keeping the number of documents with interrogation information to a minimum can minimize certain legal issues," the document is quoted as saying in an affidavit signed by Kuebler.

The document could support challenges by other detainees to suppress confessions at Guantanamo, where the U.S. military says it plans to prosecute as many as 80 of roughly 270 detainees before the first U.S. war-crimes tribunals since World War II.

The case against Khadr, who was captured in Afghanistan when he was 15, is on track to be one of the first to trial. He faces war-crimes charges including murder for allegedly throwing a grenade that killed a U.S. Special Forces soldier during a 2002 firefight.

Kuebler said the nature of the interrogations is particularly relevant in Khadr's case because prosecutors are relying on evidence "extracted" from him at Bagram air base in Afghanistan and at Guantanamo.

"If handwritten notes were destroyed in accordance with the SOP, the government intentionally deprived Omar's lawyers of key evidence with which to challenge the reliability of his statements," Kuebler said in an e-mail to reporters.

The operations manual, which dates to January 2003, was attached to a 2005 report on an investigation into detainee abuse allegations at Guantanamo, Kuebler said. A summary of the findings was released at the time, but the defense lawyer said the section including the manual has not been made available publicly.

The so-called Schmidt-Furlow report documented degrading treatment, including one instance of a top terror suspect forced to dance with another man and behave like a dog. But investigators stopped short of saying torture occurred.

after a trial of course, but that is exactly what we need to do for the rule

If I'm not mistaken, this does qualify as interfering with an investigation. Bush happy about the fact that the taxpayers are being billed a Trillion dollars a year for defense spending (not including the actual wars) and Rummy is still sitting at a desk over there?

There was a program on PBS Chicago yesterday called Bush's War which dealt with this issue. http://www.pbs.org/wgbh/pages/frontline/bushswar/

This report goes a long way in identifying responsible parties for what went on at GITMO and other places. Pushing these trials is a political stunt that is likely to backfire big time. There has been significant resistance even within the military courts to these trials.

This is tragic not only for the detainees, but also for those who are being forced to prosecute people against their better judgment.

This morning I saw a guy in the street wearing flag pin that had to be a foot long. It was tearing the lapel of his suit coat. He didn't seem to care about the coat as much as he cared about this expression of patriotism. I'm glad size makes a difference in expressions of patriotism and long for the day we'll carry our flag pins around on our backs like crucifixes.

wow, yeah. Lets interrogate(read torture) a man SUSPECTED for throwing a grenade at soldiers of an invading and occupying force in his own country. Even IF he did it, it's pretty easy to understand why.

Not So; the US criminal justice system has always been in the "guilty until proven innocent" mode for everyone not a celebrity or a member of the top 1%.

It's about time we apply that approach to the upper eschlon criminals, as they do not understand the concept; in the US, the adequacy of your defense depends on how much of one you can afford.

For BushCo, the rule should be that no matter what you can afford, you cannot escape justice, and that the rules that apply to the least of us apply to those at the top.

Just a pipedream, I know, but a damn satisfying one....

This is not a matter of feeling sorry for anyone. It is the main principal this country wa built on: freedom from government intrusion to trump up charges and take away our freedom. How do you know that the allegations are true? This is why the govenment must prove what they say and everyone is entitled to a defense. One day it could be you, your son, your brother, your father. Then what? You will want every safeguard in place to give your loved one a fighting chance.

BTW the word "detainee" does not mean non-human despite all the efforts made by the military to do so.

Thank you for that point! See, that's the difference about our kangaroo military courts. Either they're stacked toward innocent (if the Pentagon wants them innocent) or stacked towards guilty (if the Pentagon wants them guilty). It is just a modern day Stalinist style show trial with W playing Uncle Joe and no sense of irony whatsoever. Somebody remind me what our problem was with the Soviet Union.
