WASHINGTON — Saved by Senate Republicans, big oil companies dodged an attempt Tuesday to slap them with a windfall profits tax and take away billions of dollars in tax breaks in response to the record gasoline prices that have the nation fuming.

GOP senators shoved aside the Democratic proposal, arguing that punishing Big Oil won't do a thing to lower the $4-a-gallon-price of gasoline that is sending economic waves across the country. High prices at the pump are threatening everything from summer vacations to Meals on Wheels deliveries to the elderly.

The Democratic energy package would have imposed a 25 percent tax on any "unreasonable" profits of the five largest U.S. oil companies, which together made $36 billion during the first three months of the year. It also would have given the government more power to address oil market speculation, opened the way for antitrust actions against countries belonging to the OPEC oil cartel, and made energy price gouging a federal crime.

"Americans are furious about what's going on," declared Sen. Byron Dorgan, D-N.D. He said they want Congress to do something about oil company profits and the "orgy of speculation" on oil markets.

But Republican leaders said the Democrats' plan would do harm rather than good _ and they kept the legislation from being brought up for debate and amendments.

On world markets, oil prices retreated a bit Tuesday but remained above $131 a barrel. Gasoline prices edged even higher to a nationwide record average of $4.04 a gallon.

At the Capitol, Democratic leaders needed 60 votes and they got only 51 senators' support, including seven Republicans who bucked their party leaders. Sen. Mary Landrieu of Louisiana, a state tied closely to the oil industry, was the only Democrat opposing the bill. Senate Majority Leader Harry Reid voted in favor of the measure, but for procedural reasons changed his vote to "no" so that he could bring it up again.

"We are hurting as a country. We're hurting individually as Americans ... and the other side says, `Do nothing. Don't even debate the issue,'" complained Sen. Charles Schumer, D-N.Y.

"Average citizens are scratching their heads and saying, what's wrong with Washington," said Schumer.

GOP opponents argued that little was to be gained by imposing new taxes on the five U.S. oil giants: Exxon Mobil Corp., Chevron Corp., Shell Oil Co., BP America Inc. and ConocoPhillips Co.

While these companies may be huge, they don't set world oil prices and raising their taxes would discourage domestic oil production, the Republicans said of the Democrats' plan.

"In the middle of what some are calling the biggest energy shock in a generation ... they proposed as a solution, of all things, a windfall profits tax," Republican leader Mitch McConnell of Kentucky chided the Democrats. He called their proposal "a gimmick" that would not lower gasoline prices and only hold back domestic oil production.

"The American people are clamoring for relief at the pump," agreed Sen. Pete Domenici, R-N.M., but "they will get exactly what they don't want" under the Democrats' plan _ higher prices and an increase in oil imports.

The bill's supporters argued that their proposal was different from the windfall profits taxes of the early 1980s that thwarted domestic production and led to a rise in imports. The oil companies could avoid the tax by using their "windfall" to push alternative energy programs or refinery expansions, they said.

Shortly after the oil tax vote, Republicans blocked a second proposal that would extend tax breaks that have either expired or are scheduled to end this year for wind, solar and other alternative energy development, and for the promotion of energy efficiency and conservation. Again Democrats couldn't get the 60 votes to overcome a GOP filibuster.

Neither Republican presidential candidate John McCain nor his Democratic rival, Barack Obama, were in Washington to cast votes on the energy issue on Tuesday.

Obama, in a statement, said Republicans had "turned a blind eye to the plight of America's working families" by refusing to take up the energy legislation. Obama has supported additional taxes on the oil companies. McCain is opposed to such taxes and has proposed across-the-aboard tax reductions for industry as a way to help the economy.

Election-year politics hung over the debate. Democrats know their energy package has no chance of becoming law. Even it were to overcome a Senate GOP filibuster _ a longshot at best _ and the House acted, President Bush has made clear he would veto it.

But there was nothing to lose by taking on Big Oil when people are paying $60 to $100 to fill up their gas tanks.

The oil companies have been frequent targets of Congress. Twice this year, top executives of the largest U.S. oil producers have been brought before congressional committees to explain their huge profits. And each time the executives urged lawmakers to resist punitive tax measures, blaming high costs on global supply and demand.

In addition to the proposed windfall profits tax, the Democrats' bill also would have rescinded tax breaks that are expected to save the oil companies $17 billion over the next 10 years. The money would have been used to provide tax incentives for producers of wind, solar and other alternative energy sources as well as for energy conservation.

In an attempt to dampen oil market speculation, the legislation would require traders to put up more collateral in the energy futures markets and would provide authority to regulate U.S.-based trading in foreign markets. And it would make oil and gas price gouging a federal crime, with stiff penalties of up to $5 million during a presidentially declared energy emergency.

After Tuesday's defeat, Democrats did not rule out pushing the issue again.

"This was politics at its worst," complained Sen. Claire McCaskill, D-Mo. "This was a refusal to debate the biggest problem confronting the American people. ... That takes nerve."

One of the most costly problems in America is ignorance of economics...as displayed here.

The Law of Supply and Demand says that as you increase supply, or decrease demand, the price will go down. Yes, this includes oil and gas. I know, crazy huh?

I will not argue that conservation will lower price (if you can conserve more than China and India are increasing, since this is a global economy).

But yet, people here will argue that increased supply will do nothing to price. Explain to me exactly how that works. How is oil except from Supply and Demand?

In a perfect world supply and demand would regulate the prices of goods. To an extent that still applies, BUT when you have the federal reserve printing dollars 24/7 to prop up the criminal activities of wall street investment bankers , hedge funds, speculators that their brain storm blew up in their faces it devalued the dollar and the prices of good shot up. That has nothin to do with supply and demand.

You may be right. I don't have enough specific knowlege of this situation to get into the details.

But regardless, the forces of supply and demand are still operative. If we shut down all domestic oil production, prices will shoot upwards. And if we pull more oil out of the ground, prices will drop. Simple.

Actually what people have argued is increasing supply by drilling in ANWR will reduce prices by just a few almost unnoticeable pennies.

On the other hand, if Americans could somehow permanently halve their gasoline habit, the price would drop significantly. And this would be years and years before a drill touches the tundra.

The argument about China and India is a red herring. Those countries have scientist. Their scientists are saying the exact same things our scientists are saying. It's highly likely they would follow us in our conservation efforts. if we do, they well. If we don't, the free world will have to figure out how to change our dangerous and aberrant behavior for us.

The key word is permanent. Americans need to drive far less for the rest of their lives. It is the only solution that exists. All the rest are "Popular Mechanics" pinup fantasies. That's an idiot like Arnold gets wood for a hydrogen hummer.

It's called the LAW of supply and demand. The word LAW means that it has been proven as fact. And facts certainly aren't myths, are they izzy?

Can the free markets be manipulated? Certainly. For a while at least. But that doesn't mean the law of supply and demand isn't valid.

Example:

I have an endless supply of my personal excrement that i will gladly sell to you. Surely, there's not much demand for my product, but demand is only a myth, right? So let's just make the price $10/turd. And if you have a problem with it, i will manipulate the price to be $20/turd. So who's first to buy my turds? Anyone? Anyone?

Your first sentence was spot on. You are a perfect example of it.

We've reached peak oil. The Saudis have not been able to increase their bpd for over five years. They know they've begun the downward slope, but aren't telling anyone about it.

Not sure what the point of your post was, but I assume it's ANWR. Nobody knows how much oil is there, but experts predict there is up to a billion barrels at most. Do you realize how insignificant that is? By the time it starts up, the US will probably be consuming 25 million barrels per day. You're talking like a month of free oil. To call this a short-term "band-aid" solution would be the biggest understatement I've heard in a long time. I'm not saying we shouldn't do it provided it can be done in a clean way. But it's trivial. The revenue is like a couple months in Iraq. The entire motivation behind ANWR drilling is for companies involved to get a fat pay day. It won't lower gas prices in any meaningful way.

It's not just ANWR, although that's a perfectly good example. We can't drill off either coast or in the gulf of Mexico. These areas, as a whole, could make a big difference.

And i really doubt The Saudi's are worried about their oil supply. These guys go through Boeing 787's faster than i go through bottled water. Why pay multi-million dollars in excess for planes you can only use for a short while?

So supply is down so much that the inreases in price are just normal supply/demand fluctuations? Just economics 101 eh? Right. Gotcha.

Oil becomes exempt from supply and demand laws when countries start bombing,invading,overthrowing, and occupying the most oil-rich sovereign countries in the world under false pretenses to avoid becoming (George Bush's words) "economic hostages" to "terrorist" nations.

Unfortunately Bush's idiotic knee-jerk reaction to 911 is exactly what has caused the chaos and instability in world oil markets today. Not supply and demand. George and his neo-con buddies are to blame for this entire scenario. As you know the coach always gets the blame in the end.

Let me tell you another little known fact about supply and demand. If you tax something more. Demand for it will decrease. Which will cause the price to fall to a lower level. More money to build and maintain roads. Lower prices. That's how it really works.

Let's entertain your straw man -- though I didn't see anyone here state that increasing supply would not lower the price of oil at all. Still, there are reasons why increasing the supply of oil might not lower prices as much as you hope, or expect.

My vocabulary list in Economics class wasn't limited to the two words, "supply" and "demand," was yours? Look up the word "cartel." Also look up the two-word phrase "inelastic demand." Finally, a three-word phrase: "barriers to entry."

Oh, and there's one other phrase that you probably won't find in your Econ book, but which you might have read in transcripts from Enron execs in 1999-2001: "gaming the market."

They[congress] needs to remember that the quest for profit trumps:the law,decency,fairness,morality and the needs of the people.

If they started drilling in ANWR tomorrow it won't do any good NOW or tomorrow,next week,next month,ect.,ect.-this is a "cop-out" excuse to screw in the name of the almighty dollar.Besides if the oil companies were to drill in ANWR,they would probably get subsidies(corprate welfare) to do it with.

There should be a mechinism the gives WE the people the power to Dictate to our Employees ( the government) how our hard earned tax dollars shoud be spent. I want my tax dollars spent here in America for the benefit of all working Americans. Why should the very wealthy get tax breaks. I don't get tax breaks. I don't want my tax dollars given as subsidies to corporate farming conglomorates, or to the Military industrial complex or to Isreal or to people to spy on me or to throw away on illigal and immoral wars. If spending my tax dollars on hard working Americans is considered Socialism than so be it. For those of you with short memories, the last time they passed a windfall tax back in the 70's the effect was that of raising the price of gas. Great solution.
This proposal shows the complete lack of understanding the neolibs in congress have for the problem. Punishing the oil companies does not help the price of gas. They think the average American hates the oil companies as much as they do, when in reality the average American hates congress even more.

OIL from arctic national wildlife Preserve would go west....to china,japan,etc...Not to american needs...AND if opened, has been predicted to drop gas by about $.01 per gallon by 2020...not worth the lost of pristine country. However, with the removal of a few more republicans, then we can put appropriate pressures on this industry because it clearly has the world by the NUTS with no interest of letting go, Alot like the republicans...it is up to us Americans to vote these crooks out of office...on principal alone and in good conscience.

The good news is...they, the republicans, have been given enough rope to hang themselves...and it appears they have done just that!

OK. A windfall profit tax is not a way to help lower oil prices. So find another reason to be pissed off at Republicans. They actually did us a favor this time.

The right way to go about this is by prosecuting of criminals in the oil industry, speculators and members of OPEC for war profiteering, fraud, corruption, price fixing, collusion and international transfer of illegally gotten gains would help to drive away the hogs at the trough.

The bumper crop of pseudo reasons for increases in oil prices is just a cover for the De Beers model applied to oil.

A special prosecutor with a large staff should be appointed and given unlimited access and authority to investigate and prosecute. Then you would see downward pressure on oil prices.

Corporatism = Fascism

The oil being pumped out of the ground belongs to the American people, NOT the oil companies. This is too important to our national security and economic survival to be left to the Republican no-regulation bribery by corporation mentality. Tax the excess profits then use every dollar to do a moon-landing type crash program to build electric cars and subsidize the installation of solar panels everywhere. This is the type of challenge that brings us together and has made America great.

If Congress agreed to give a $100,000 tax break on Hummers they sure as hell can provide US taxpayers with a $25,000 tax break to dump their gas hogs for vehicles getting 40+ mpg until the electrics are ready. It's the patriotic thing to do. Stop listening to traitors and their static. Demand a commitment to this from you Congressman or tell them they will be voted out. Its time to quit messing around and get moving!

When gas retailers were mom and pop operations there was competition and I remember when the price of gas was 15 cents a gallon. On top of that they had a mechanic on duty. They would pump the gas for you, check your radiator, battery, tire pressure and give you green stamps or Texas gold stamps . You could top off a twenty gallon tank for three dollars. Then the greedy oil producers decided to retail the gas and closed all the independent mom and pop operations. With no real competition except from their oil buddies they said " you want gas, pump it yourself", you want air, or water, It'll cost you. They sell you overpriced goodies and instead of three dollars for a full tank you pay four dollars for one gallon. The Republicans just blocked a windfall profit tax on Exxon Mobil and the other price gougers. Remember that on November.
