WASHINGTON — Saved by Senate Republicans, big oil companies dodged an attempt Tuesday to slap them with a windfall profits tax and take away billions of dollars in tax breaks in response to the record gasoline prices that have the nation fuming.

GOP senators shoved aside the Democratic proposal, arguing that punishing Big Oil won't do a thing to lower the $4-a-gallon-price of gasoline that is sending economic waves across the country. High prices at the pump are threatening everything from summer vacations to Meals on Wheels deliveries to the elderly.

The Democratic energy package would have imposed a 25 percent tax on any "unreasonable" profits of the five largest U.S. oil companies, which together made $36 billion during the first three months of the year. It also would have given the government more power to address oil market speculation, opened the way for antitrust actions against countries belonging to the OPEC oil cartel, and made energy price gouging a federal crime.

"Americans are furious about what's going on," declared Sen. Byron Dorgan, D-N.D. He said they want Congress to do something about oil company profits and the "orgy of speculation" on oil markets.

But Republican leaders said the Democrats' plan would do harm rather than good _ and they kept the legislation from being brought up for debate and amendments.

On world markets, oil prices retreated a bit Tuesday but remained above $131 a barrel. Gasoline prices edged even higher to a nationwide record average of $4.04 a gallon.

At the Capitol, Democratic leaders needed 60 votes and they got only 51 senators' support, including seven Republicans who bucked their party leaders. Sen. Mary Landrieu of Louisiana, a state tied closely to the oil industry, was the only Democrat opposing the bill. Senate Majority Leader Harry Reid voted in favor of the measure, but for procedural reasons changed his vote to "no" so that he could bring it up again.

"We are hurting as a country. We're hurting individually as Americans ... and the other side says, `Do nothing. Don't even debate the issue,'" complained Sen. Charles Schumer, D-N.Y.

"Average citizens are scratching their heads and saying, what's wrong with Washington," said Schumer.

GOP opponents argued that little was to be gained by imposing new taxes on the five U.S. oil giants: Exxon Mobil Corp., Chevron Corp., Shell Oil Co., BP America Inc. and ConocoPhillips Co.

While these companies may be huge, they don't set world oil prices and raising their taxes would discourage domestic oil production, the Republicans said of the Democrats' plan.

"In the middle of what some are calling the biggest energy shock in a generation ... they proposed as a solution, of all things, a windfall profits tax," Republican leader Mitch McConnell of Kentucky chided the Democrats. He called their proposal "a gimmick" that would not lower gasoline prices and only hold back domestic oil production.

"The American people are clamoring for relief at the pump," agreed Sen. Pete Domenici, R-N.M., but "they will get exactly what they don't want" under the Democrats' plan _ higher prices and an increase in oil imports.

The bill's supporters argued that their proposal was different from the windfall profits taxes of the early 1980s that thwarted domestic production and led to a rise in imports. The oil companies could avoid the tax by using their "windfall" to push alternative energy programs or refinery expansions, they said.

Shortly after the oil tax vote, Republicans blocked a second proposal that would extend tax breaks that have either expired or are scheduled to end this year for wind, solar and other alternative energy development, and for the promotion of energy efficiency and conservation. Again Democrats couldn't get the 60 votes to overcome a GOP filibuster.

Neither Republican presidential candidate John McCain nor his Democratic rival, Barack Obama, were in Washington to cast votes on the energy issue on Tuesday.

Obama, in a statement, said Republicans had "turned a blind eye to the plight of America's working families" by refusing to take up the energy legislation. Obama has supported additional taxes on the oil companies. McCain is opposed to such taxes and has proposed across-the-aboard tax reductions for industry as a way to help the economy.

Election-year politics hung over the debate. Democrats know their energy package has no chance of becoming law. Even it were to overcome a Senate GOP filibuster _ a longshot at best _ and the House acted, President Bush has made clear he would veto it.

But there was nothing to lose by taking on Big Oil when people are paying $60 to $100 to fill up their gas tanks.

The oil companies have been frequent targets of Congress. Twice this year, top executives of the largest U.S. oil producers have been brought before congressional committees to explain their huge profits. And each time the executives urged lawmakers to resist punitive tax measures, blaming high costs on global supply and demand.

In addition to the proposed windfall profits tax, the Democrats' bill also would have rescinded tax breaks that are expected to save the oil companies $17 billion over the next 10 years. The money would have been used to provide tax incentives for producers of wind, solar and other alternative energy sources as well as for energy conservation.

In an attempt to dampen oil market speculation, the legislation would require traders to put up more collateral in the energy futures markets and would provide authority to regulate U.S.-based trading in foreign markets. And it would make oil and gas price gouging a federal crime, with stiff penalties of up to $5 million during a presidentially declared energy emergency.

After Tuesday's defeat, Democrats did not rule out pushing the issue again.

"This was politics at its worst," complained Sen. Claire McCaskill, D-Mo. "This was a refusal to debate the biggest problem confronting the American people. ... That takes nerve."

You think they screwed up this country in the last seven and a half years? Windfall profits tax? are you kidding? This is just what the Bush economic deal for the past two terms has been all about. Open a spigot to the coffers. When they bleed the US Treasury dry, go after everybody else. That's you and me, bunkie. They stole the military because they found a way to take most of those Billions that are missing, and a lot of the money that's accounted for with their benefactors like KBR and Blackwater as well as many that are not well known outside of Republican fundraising circles. And it that's not enough, our Moron in Chief is in Europe making a case for attacking Iran while the Iraqi government is telling us to go home. Imperiealism is a wonderful way to grab more money.

I'll bet you couldn't get the Republicans to even suspend the $18B in subsidies. Notice how they won't tax the windfalls but they'll help create one? Anybody, I mean ANYBODY, who considers voting Republican is either an idiot, racist or a thief.

By the way, McCain says that the GOvernment doesn't work. That's because the bastards broke it. We don't need a President, we need a janitor.

Despite the fact that you're shouting, DAWK, I read your post. As it happens, a friend of mine who's a mechanic/machinist and I have been tinkering with the idea of a compressed air go cart for quite some time. We should have the prototype done in a month or so. The tricky part was developing a clutch system that would recharge it's tank once it got moving. Thanks to some spare parts off an old Cushman Eagle, I think we've done it. I'll keep you posted.

McCain receives $58,000 per year TAX FREE because he is considered 100% disabled by the Navy. The story came out in the LA Times in April but obviously never hit the MSM. So, is John McCain in "robust health" or is he 100% disabled? It doesn't seem possible that he could be both!

Some companies to invest in alternative energy, notably Shell and BP. Just to tax to change their behaviour or use proceeds in a different way. In other countries, it is just for subsidies, or to keep gas prices low. Qua tax or loss of revunue a better way since extraction on federal land cost companies hardly anything, and old mining act of 19th Century is in need to be replaced.

ANOTHER GREAT REPUG LIE:

Our Corporate tax rates are the second highest in the world. True...if you dont then factor in the tax breaks! After that the rate is avergae. And if you dont count countries like DUBAI or CHINA which start off by getting a 50% interest in a Corp set up to do business there! And they dont have any propblem having a fast growing economy.

A lower corp tax is great, if BUSH had not taken us in to huge debts. And you onnly apply the lwoier rate to income earned here from labor here! Otherwise they still move jobs offshore to lower the cost, but sell the goods here made by non U.S. workers... thats does not help the working middleclass.

But our greatest area of non competativeness is healthcare costs... and only a single payer system such as medicare for everyone will solves that problem.

Of course McCain is against a single payer system but is for doing away with employer health pans and basiclly leaving everyone on their own.

The Republicans are so good at spinning things- like the Corporate Tax rate. Then there is the Estate Tax that sounded too elitist so they renamed it the ominous DEATH TAX. Now they are droning on about drilling in Anwar as a solution to the oil crisis. WE WOULD NOT SEE A DROP OF OIL FOR 15 YEARS! And then add to that all the enviromental considerations. No surprise to everyone here that once Bush got into office the goverment pretty much stopped it oversight of futures trading. (Jim Webb talkied about this with Tim Russet on CNBC Saturday- it was a very interesting interview.) I read somewhere that 30% of our oil cost is a FEAR PREMIUM. No wonder Bush is out there saber rattling all the time. We haven't raised the CAFE standards on cars for 30 YEARS! Why would state and federal goverments be motivated to change that when the get a substantial revenue stream from each gallon gas consumed. What's wrong with the dumb ass American car manufacturers couldn't they see the writing on the wall? They did not need a goverment mandate to make their products better and more efficient. Now they have just been so crushec by their competition that they will probably never recover.

Taxes pay for the American Way of Life but somehow rich people (who enjoy "our way" the most) don't feel like they owe any taxes. They drive the biggest cars (which are the biggest polluters). They use more than their share of energy. They occupy big houses. And they don't pay any frigging taxes but the Rethugs made paying taxes sound like the worst idea ever. Taxes pay for parks, roads, bridges, schools, libraries, and a little bit pays for helping the poor but not much. The biggest reaper of Taxes is the Pentagon--they gobble up most of our tax revenues. And they pour money down the drain!

The Rethugs have been lying and lying and lying about taxes for years while they've been stealing you and me BLIND. I am sick of my taxes paying for Illegal Wars against people who are NOT our enemies. I am sick of the Rich and their entitlements. We pay rich people and Corporate America more entitlements than the poor could ever imagine.

I am sick of the TROLLs who come here and lie--the ones who hate our country and hate YOU. The Rich think they deserve their wealth--and think the poor deserve being poor.

Does anyone else see the hypocrisy of this? Are Americans THAT stupid that we let the Rethugs stay in office? Does anyone else see the tragedy in what the GOP has done to US--the country and YOU and ME?

Jimmy Carter did exactly that back in the 70s, Razz. I'm with you, this is an policy that needs to be reinstituted.

Oh, and while we're at it, let's s**tcan that ridiculous $25,000 tax writeoff on SUVs that weight over 6,000 gvw. If those cockamamie vehicles don't qualify for a FARM or COMMERCIAL TAG, then they sure as f**k shouldn't be allowed to use a loophole to ABUSE a tax break originally meant to help farmers ONLY. This kind of sheet really peesses me off, man.

Hmm....I guess I'm supposed to be sent into a fulminating outrage over this? I hate big oil companies as much as the next person, but I'm having a tough time seeing how all of this is going to lower gas prices. Seems like political grandstanding to me.

I have a better idea: how about ending the murderous wars, the crazed spending, and the Fed printing press that is all causing massive inflation? That would bring oil way, way down.

It also has exactly zero chance of happening. Such is our political system. Ain't America great?

Assuming you honestly are bewildered about the connection, Windfalls Profits Taxes would go to developing alternate fuels which would result in lowering fuel prices.

Ignoring the inevitable doesn't change it, the supply of oil is finite, the amount or oil that can be produced is about to be eclipsed by global demand (not just US demand).

The sooner we reduce our oil dependency and develop alternate fuels, the sooner fuel prices lessen, our energy security increases and all those billions going into Saudi pockets stays here in the U.S. improving our economics.

The sooner we start, the sooner we succeed.

Sounds great in theory. I guess I don't have the faith in the FedGov that you do, look at their track record. Even if the money is not diverted to the coming wars or other expenses (like our Social Security taxes), if will probably end up being squandered in some boondoggle like corn ethanol, which will make our energy (and food) problems even worse.

i HAVE A WOODWORKING business and need a pickup truck. I bought a new F150 in 2005. I got the 6 cylinder with a 5 speed manual tranny and on trips I get 22 MPG.

I also have a motorcycle that gets 65mpg and I use it for everything I can.

Have you driven an interstate lately?............People drive 80-90-100mph. When will we learn?

This leaves absolutely no question as to who put the GOP in power in the first place, and seems to be keeping it there. . . . . Bush's Big Oil and all its lobbying pirates. They seem hell-bent on following the blueprints for destruction drawn up nearly 8 years ago.

What a great legacy you leave us, Mr. Bush. And, hey, you've got a couple more months to see how much more damage you can do to the American economy, the American image abroad, and the American spirit at home. Too bad you won't just go on one of your extended vacations, and take your entire GOP gang with you. We would be better off without 'cha . . . .

Yah gotta love it. At the top of thie page is a picture of a gas nozzle sticking out of an auto tank.
The caption reads, "Gas Projected To Peak At $4.15 A Gallon In August".

After our esteemed Senate GOPers gave Big Oil the green light today to continue raping American consumers, I put the odds of gas topping out at $4.15 are somewhere between slim and none.

You can say that again, Ernestine! Here, in town, we've been paying $4.39/gal for the last week and a half. According to a recent news broadcast, the majority of dead cars on the shoulder of the freeway are from people running out of gas. They can't afford to fill their tanks anymore!

4.15? I paid 4.96 for diesel yesterday. As goes diesel, so goes unleaded in about 4-6 weeks. And diesel is made from cheaper oil, is less refined and has fewer additives. The profit margins on diesel must be huge.

It's $4.29 here in CT. Get this --I can lock in my heating oil price at $4.60 per gallon. In 2002, I locked it in with the same company for 99 cents a gallon. That is really signficant with the cold winters we have here in the Northeast.

My local Chevron station in California was charging $4.45 this morning, about the average for the state. California's special blending requirements and its sales tax on gasoline (in addition to a road tax) have kept gas prices among the highest in the country. I am expecting prices in my area to top out above $5 a gallon for regular this summer. If you are upset by the high gas prices, cut down on your driving and/or buy oil company stock.
