WASHINGTON — Saved by Senate Republicans, big oil companies dodged an attempt Tuesday to slap them with a windfall profits tax and take away billions of dollars in tax breaks in response to the record gasoline prices that have the nation fuming.

GOP senators shoved aside the Democratic proposal, arguing that punishing Big Oil won't do a thing to lower the $4-a-gallon-price of gasoline that is sending economic waves across the country. High prices at the pump are threatening everything from summer vacations to Meals on Wheels deliveries to the elderly.

The Democratic energy package would have imposed a 25 percent tax on any "unreasonable" profits of the five largest U.S. oil companies, which together made $36 billion during the first three months of the year. It also would have given the government more power to address oil market speculation, opened the way for antitrust actions against countries belonging to the OPEC oil cartel, and made energy price gouging a federal crime.

"Americans are furious about what's going on," declared Sen. Byron Dorgan, D-N.D. He said they want Congress to do something about oil company profits and the "orgy of speculation" on oil markets.

But Republican leaders said the Democrats' plan would do harm rather than good _ and they kept the legislation from being brought up for debate and amendments.

On world markets, oil prices retreated a bit Tuesday but remained above $131 a barrel. Gasoline prices edged even higher to a nationwide record average of $4.04 a gallon.

At the Capitol, Democratic leaders needed 60 votes and they got only 51 senators' support, including seven Republicans who bucked their party leaders. Sen. Mary Landrieu of Louisiana, a state tied closely to the oil industry, was the only Democrat opposing the bill. Senate Majority Leader Harry Reid voted in favor of the measure, but for procedural reasons changed his vote to "no" so that he could bring it up again.

"We are hurting as a country. We're hurting individually as Americans ... and the other side says, `Do nothing. Don't even debate the issue,'" complained Sen. Charles Schumer, D-N.Y.

"Average citizens are scratching their heads and saying, what's wrong with Washington," said Schumer.

GOP opponents argued that little was to be gained by imposing new taxes on the five U.S. oil giants: Exxon Mobil Corp., Chevron Corp., Shell Oil Co., BP America Inc. and ConocoPhillips Co.

While these companies may be huge, they don't set world oil prices and raising their taxes would discourage domestic oil production, the Republicans said of the Democrats' plan.

"In the middle of what some are calling the biggest energy shock in a generation ... they proposed as a solution, of all things, a windfall profits tax," Republican leader Mitch McConnell of Kentucky chided the Democrats. He called their proposal "a gimmick" that would not lower gasoline prices and only hold back domestic oil production.

"The American people are clamoring for relief at the pump," agreed Sen. Pete Domenici, R-N.M., but "they will get exactly what they don't want" under the Democrats' plan _ higher prices and an increase in oil imports.

The bill's supporters argued that their proposal was different from the windfall profits taxes of the early 1980s that thwarted domestic production and led to a rise in imports. The oil companies could avoid the tax by using their "windfall" to push alternative energy programs or refinery expansions, they said.

Shortly after the oil tax vote, Republicans blocked a second proposal that would extend tax breaks that have either expired or are scheduled to end this year for wind, solar and other alternative energy development, and for the promotion of energy efficiency and conservation. Again Democrats couldn't get the 60 votes to overcome a GOP filibuster.

Neither Republican presidential candidate John McCain nor his Democratic rival, Barack Obama, were in Washington to cast votes on the energy issue on Tuesday.

Obama, in a statement, said Republicans had "turned a blind eye to the plight of America's working families" by refusing to take up the energy legislation. Obama has supported additional taxes on the oil companies. McCain is opposed to such taxes and has proposed across-the-aboard tax reductions for industry as a way to help the economy.

Election-year politics hung over the debate. Democrats know their energy package has no chance of becoming law. Even it were to overcome a Senate GOP filibuster _ a longshot at best _ and the House acted, President Bush has made clear he would veto it.

But there was nothing to lose by taking on Big Oil when people are paying $60 to $100 to fill up their gas tanks.

The oil companies have been frequent targets of Congress. Twice this year, top executives of the largest U.S. oil producers have been brought before congressional committees to explain their huge profits. And each time the executives urged lawmakers to resist punitive tax measures, blaming high costs on global supply and demand.

In addition to the proposed windfall profits tax, the Democrats' bill also would have rescinded tax breaks that are expected to save the oil companies $17 billion over the next 10 years. The money would have been used to provide tax incentives for producers of wind, solar and other alternative energy sources as well as for energy conservation.

In an attempt to dampen oil market speculation, the legislation would require traders to put up more collateral in the energy futures markets and would provide authority to regulate U.S.-based trading in foreign markets. And it would make oil and gas price gouging a federal crime, with stiff penalties of up to $5 million during a presidentially declared energy emergency.

After Tuesday's defeat, Democrats did not rule out pushing the issue again.

"This was politics at its worst," complained Sen. Claire McCaskill, D-Mo. "This was a refusal to debate the biggest problem confronting the American people. ... That takes nerve."

US Oil - consumption: 20.8 million bbl/day (2005 est.)
US Oil - exports: 1.048 million bbl/day (2004)
US Oil - imports: 13.15 million bbl/day (2004)

If we could just reduce consumption down to 7 or 8 million bbls a day we'd be energy independent.

Now if the government would give a tax credit to builders who set up buildings to use geo-thermal to heat/cool instead of local utilities, that would be a huge step in the right direction. That right there could really cut down our consumption big time.

Many of my neighbors could cut back on their driving without too much pain. There is a rapid transit station nearby. But it is much more convenient to get into the Mercedes and drive. Gas will have to become a lot more expensive before I notice a significant cutback in driving in my part of the world. And I am not going to hold my breath waiting to run into Senator Boxer, one of the sponsors of the windfall tax bill, on the Bay Area Rapid Transit Line. Public transit is for little people like me, not for powerful people like US Senators Boxer and Feinstein, who were among the senators that ganged up on Big Oil today.

Great idea, but the oil companies wouldn't go for it. If they can make $140 a barrel on the open market, as opposed to a closed market (if we did that), they would just start exporting American oil to maximize profits.
You and I realize that they would be rich and remain rich even if we were energy independent, but their greed exceeds patriotism or anything that resembles doing the right thing...

I read some of the posts here and don't get what is so hard to understand about a Windfall Profits Tax.

It's a tax on outrageous profits gained through the monopoly on this natural resource that is currently vital to society's existence. That's not a COST that's passed on to consumers. It's a percentage of RECORD Profits from monopolies.

The oil companies are not entitled to record profits due to their monopoly. The government has every right to regulate vital resources AND regulate monopolies for the benefit of society and the population.

SO chill with the fear over this, regulation is important, it keeps you from being hit by cross traffic, from our food being poisoned, from employers being able to abuse you.

Corporations have no conscience, only government can enforce one on them.

i get your point, and for the most part agree with it. i am always a bit nervous at the go vernment regulating business though. i guess the question is where do they stop? will small business' get regulated in the future? it is a slippery slope. i agree that they need to be kept in check, and yes it is different because of the nature of the situation. i just don't want to see the gov ernments hands in all our business.

How do they have a monopoly? Are you serious? There are 5 companies that own pretty much all the oil in the country. They own the oil, they own the refineries, they own the gas stations.

Many other industries including phone companies (ATT) and even more similarly, the film industry, which at one time had a monopoly on all aspects of the business have been broken up by the government in the past to benefit the majority and provide true capitalism, true free market competition.

How can any business start up tomorrow to compete with any existing oil company? They can't get any refinery business from the oil companies. These companies own the whole business and monopolize it.

And how does a government enforce a conscience? You don't believe in laws? Every law that protects you in this society came from government, are you serious with such a ridiculous question?

Where is the monopoly genius? They broke up your buddy Rockefeller's Standard Oil a 100 years ago. No matter what those economic midgets in Washington say if you hit them with a windfall profits tax the cost will flow into your gas tank. And a 10% margin is not excessive. If it is then Microsoft and Apple should be paying those taxes as well as the corner grocery store. Where did you learn economics from Tony the Tiger.

The only thing close to a monopoly is the governments not allowing exploration. And btw the gov't margin on gas at the pump is about 15%. They bring in more than the oil companies. How about a windfall tax on the taxes they get from oil and give it to the people

It is so sad that so many people even listen to those jerks in Washington. How about educating yourself with some facts and then you will want to throw them all out like I do. Of course that would be too much like work so I will just listen to what some other half wit has to say and I will parrot it

This a prime example of why the Republican brand is in the crapper and why the Democrats will win the White House, expand theier majority in the House by another 20 to 30 seats and create a filabuster proof majoirty in the Senate. Try convincing working class and poor Americans that they aren't being exploited by big oil and that the Republicans aren't trying to perpetuate profiteering. Try convincing Americans that Republicans care about or can relate to their daily struggles to house, feed, clothe and educate their children. Try convincing conservative evangelicals and independents that they should vote for Republicans because they choose to support windfall corporate profits instead of the common good of America's most underprivileged citizens during a time of war and recession. At a tune when home foreclosures are at record numbers, unemployment is on the rise and our nation's debt is balooning into the stratosphere, Bush Republicans are once again choosing greed over compassion.

I can understand the Repub resistance to the Oil Co tax hike (not agree with it, but understand it), but WTF with the refusal to give tax breaks to renewable energy. They give tax breaks to everything else, but actually seek to discourage renewables??

It puts the lie to their claim of wanting to use tax cuts as stimulus. They want a tax cut for selfish reasons and they like the idea of taxing new things that might be the slightest competition to their stock portfolio, even if it would be better for the nation in the long run.

I recall Nancy Pelosi saying Hillary's tax break wouldn't work because: As she gestered filling up a tank of gas, she said they just need to stop using so much gas. That's her only answer. That woman needs to go. She is in bed with Bush/Cheney. How dare she take impeachment off the table. She needs to answer for high crimes & treason herself.

It's not working like it used to--that getting people to vote emotionally instead of rationally.

I just paid $4.51 per gallon (the lowest I could find in Sacramento) and want to know why it costs 20¢ less in the San Francisco Bay Area. The oil companies are scamming us--and we ALL better learn how to get out of our frigging cars except to go to work. Even then--move closer to your job. There's more hell to pay while the Bush Crime Family stays in power--it's only starting.

I hope it truly is a revolution because I am sick of slaving for two percent of the world's population.
Honestly,the stock market is nothing more than a sham manipulated and contrived to profit the most powerful.Anyone who believes the sub prime credit fiasco was an accident is deluding themselves.These people know exactly what is going on and it isn't rocket science.

The only reason we are still refining black sludge is because the elites can make trillions of dollars.

We have as humans the ability to harness multiple natural energy and it isn't encouraged because the elites can not recover trillions from this less expensive environmentally friendly unlimited cheap source.

Wake people and think out side the box.This system was NOT designed by us but for us to benefit them and we can have a more equitable society and world community if we pull together.

The crooked and corrupt politicians need to be tossed out.

This is not free democracy for the people it is corporate rule under the guise of democracy.

What is TRULY disguting is the idea that the Republicans refused to extend the the funding for Alternative Energy . The next time i hear tese SOB's complain about our dependence on foreign oil I am not sure if I will be able to restrain myself from beating them to death with a Solar panel .
They talk a good game but when push comes to shove they roll over and play dead for Big Oil .
I can only pray that somehow we get rid of McConnel who is an absolute snake . He delights in worrying about spending too much on health care for children but won't lift a finger to stop the obscene Profits of BOTH the Oil Companies and the Speculators .

Take a magnifying glass on a sunny day and place it under the sun's ray and feel the energy,or grab a couple of magnets and reverse them.

Not to mention wind,tidal and geothermal.

It is insulting to my intelligence to say we cannot convert the energy and given the black sludge has to be refined etc..it's a costly dirty process just to turn the oil into an energy source.Our natural energy doesn't need a refining process.

I never thought I would ever have to entertain the idea of this science but for the sake of my sanity I will do it.

People need to know we are living the Truman show.

republicans. what a bunch of greedy uncaring lying jerks! well, they should consider the effect that the ever-rising cost of living (one root cause: skyrocketing oil prices and speculation coupled with practically non-existent government sponsored research into alternative energy sources) is having on the middle-class in this country. they are killing their cash cow. what a bunch of short-sighted fools.

yes, taxes are not the complete answer. but something must be done to help our stagnating economy and to stop the blatant profiteering by corrupt corporate cronies. and a token gesture of a 'gas-tax holiday' is not going to help anyone.

i'm certainly no expert, nor do i claim to even completely understand all the complexities of our dynamic and ever-devolving economy, but cutting taxes for the rich as well as mega-corporations while increasing spending on only the military is not going to solve our huge debt and deficit situation.

republicans are complete hypocrites. republicans have done more harm to our country in the last 3 decades than any terrorist could ever do. these dumb-ass thugs are clearly beholden to their corporate masters. it's disgusting.

the only way to change course and begin repairing the damage is to vote these assholes out of congress this november along with voting Barack Obama in to the Whitehouse! (republicans have had their turn and FAILED miserably. let's let the democrats have a chance to redeem themselves.)

He can't do it alone. We have to get as many true Democrats (not Blue Dogs) into office as possible. Plus we need commissions formed with the best and the brightest, like we did with the Iraq Study Group and the 9/11 commission. AND ACTUALLY IMPLEMENT THEIR RECOMENDATIONS.

Plus remember the squeaky wheel gets the grease. Email and call your Congressmen and Senators and the media. I called the Obama campaign last night and made a suggestion when you call- you get at live person at the goverment offices, at the campaigns and at the networks. The MSM has done a great job of dumbing down America with their superficial tabloid coverage. The pundits with the huge paychecks don't want to upset their corporate masters. I email them all the time and tell them to step it up.

The oil co profits have risen 400 percent since 03 according to the information from the senate hearings. No matter how you figure the equation of price factors to buy, refine or speculation the bottom line or bottom dollar is someone is making a real good bundle and its not the working middle class. Now for me this is no surprise when you have had a VP like Cheney making energy policy with the six ceos and to this day not one note from those meetings have been seen by the public. Take that with the fact you have oil men in the whitehouse and this is what you can expect. Doesnt matter how many times they try to sell trickle down economics it never works.

You mean those with the typical American whose median income is around $48k? Of course they'll benefit, when their capital gains taxes are kept low and their Estate Tax is finally raised to $5 million exemption.

Considering the millions each of them have in the stock market, real estate and Krugerands, it's no wonder so many support the Republicans in enhancing the wealth of the wealthy.

Prices are climbing on everything. Local taxes are going through the roof to compensate for the cuts in federal spending to fund those tax cuts. I cannot believe how many voters are taken in by the tax cut scam. If you're not making big bucks, your overall financial burden (local and state taxes, fees, etc) is probably higher than ever.
