Sen. Barack Obama's campaign released a statement Friday afternoon saying that while Obama opposes amnesty for telecom firms that spied on Americans, he will support the House compromise legislation.

The statement in full:

"Given the grave threats that we face, our national security agencies must have the capability to gather intelligence and track down terrorists before they strike, while respecting the rule of law and the privacy and civil liberties of the American people. There is also little doubt that the Bush Administration, with the cooperation of major telecommunications companies, has abused that authority and undermined the Constitution by intercepting the communications of innocent Americans without their knowledge or the required court orders.


"That is why last year I opposed the so-called Protect America Act, which expanded the surveillance powers of the government without sufficient independent oversight to protect the privacy and civil liberties of innocent Americans. I have also opposed the granting of retroactive immunity to those who were allegedly complicit in acts of illegal spying in the past.

"After months of negotiation, the House today passed a compromise that, while far from perfect, is a marked improvement over last year's Protect America Act.

"Under this compromise legislation, an important tool in the fight against terrorism will continue, but the President's illegal program of warrantless surveillance will be over. It restores FISA and existing criminal wiretap statutes as the exclusive means to conduct surveillance - making it clear that the President cannot circumvent the law and disregard the civil liberties of the American people. It also firmly re-establishes basic judicial oversight over all domestic surveillance in the future. It does, however, grant retroactive immunity, and I will work in the Senate to remove this provision so that we can seek full accountability for past offenses. But this compromise guarantees a thorough review by the Inspectors General of our national security agencies to determine what took place in the past, and ensures that there will be accountability going forward. By demanding oversight and accountability, a grassroots movement of Americans has helped yield a bill that is far better than the Protect America Act.

"It is not all that I would want. But given the legitimate threats we face, providing effective intelligence collection tools with appropriate safeguards is too important to delay. So I support the compromise, but do so with a firm pledge that as President, I will carefully monitor the program, review the report by the Inspectors General, and work with the Congress to take any additional steps I deem necessary to protect the lives - and the liberty - of the American people."

Also today, in an interview with Bloomberg's Al Hunt, Senate Majority Leader Harry Reid said he would attempt to remove the amnesty provision in the bill:

Reid said the Senate may try to remove a provision from the bill that shields telephone companies from privacy lawsuits. Holding a separate vote on that issue next week may provide political cover for Democratic presidential nominee Barack Obama. Even though the attempt may fail, Reid said the vote would allow those opposed to the liability protection to "express their views."


"I'm going to try real hard to have a separate vote on immunity," Reid said in an interview to be aired this weekend on Bloomberg Television's "Political Capital with Al Hunt."

"Probably we can't take that out of the bill, but I'm going to try."

McJoan at Daily Kos writes, "That effort should be helped by Obama's opposition to the provision. His support of the remainder of the bill is disappointing, but that would be in large part offset if he can help kill immunity."

Obama's spokesman, Bill Burton, back in in September, vowed that Obama would "support a filibuster of any bill that includes retroactive immunity for telecommunications companies." MoveOn believes Obama should be held to his word and is thus conducting a campaign urging Obama to do what he promised -- support a filibuster to stop the enactment of telecom amnesty. But I still have questions about the proper treatment of the Telecoms. If the President of The United States, backed up by the Attorney General came to my company and said they needed my help to prevent a terrorist attack and they gave me legal documentation that protected my own liability.... I suspect I would go along with them.

Then, after what seemed an entirely legal action on my part, I find myself sued by hundreds of citizens and groups for what appeared to be a perfectly legal and ethical activity and incurring hundreds of millions of dollars in legal costs (which will be passed on to my customers), I would be aghast.

The bottom line is that I (the telecoms) am not the villain here. It was the President, his advisors and the Department of Justice who should be punished for this.

I do know this - if I weren't granted immunity, I would NEVER help the government again, even if it meant another 9/11.

I don't think the issue is as simple as most posters here seem to think.

But perhaps I'm just missing the big picture.

For Congress to pass a law which grants infinitely narrow retroactive immunity after the crime is committed is a violation of the separation of powers. It countermands the authority of the DoJ in the Executive branch, and the essential fundamental test of law in the judiciary system of a Republic. The foundation of the rule of law is that it applies to everybody.

Folks, you have just handed over the keys to your asses.

And Obama goes from my Mildly Hopeful list, to my POS list. If he has no problem abrogating justice, then he must have no problem selling us out on other individual rights issues.

What his parsed statement fails to explain.... once unconditional immunity is granted for past actions, you cannot rescind it. No court in the land will even hear a case, where the accused was at some time unconditionally absolved of legal consequences.

Dear Mr. Burton:
I am a registered independent voter, who also happens to be very politically active, both in volunteering my time and contributing my hard-earned money. I have slowly become a fan of Mr. Obama, in spite of my inherent skepticism. Yesterday, however, I received a reality check. Mr. Obama's endorsement of the House Fisa "compromise" (capitulation) was a slap in the face and a direct contradiction to the very spine of his campaign rhetoric. If Mr. Obama is indeed the candidate of "change and accountability," then he MUST take a strong stand against the bill as it comes before the Senate. In fact, he must use his power as the face and leader of the Democratic Party to KILL this bill. Anything less, including a half-hearted, politically safe "fight" against the bill that ultimately fails, will tell me he lacks the leadership to right the enormous wrongs that have eviscerated our once great democracy since the "Reagan revolution".

He needs to walk the walk. Otherwise, he's just another Washington blowhard, dressing up political cowardice as "pragmatism."

Failure of leadership in this watershed case will cause me to place my loyalty (financial, as well as blood, sweat and tears) to other, more deserving candidates; true patriots, who stand for the Constitution, even in the face of fear-mongering and propaganda.

To those who say that this bill does not give immunity to the telecom companies and the Bush administration, are you sure about that? Please prove this to me because I want to believe that. Remember Bush is pleased with this bill and Bush doesn't approve of anything that doesn't give him and his criminal enterprise a pass, the troops and our civil liberties be damned.

As if this is possible but aren't we running out of crap to impeach Bush for? The framers of the Constitution deliberately gave the people's House the ace in the hole to trump an out of control executive branch with an ingenious system of checks and balances, but leave it to a Democratic controlled Congress to fold even when dealt a royal flush.

I think I had a dream last night that this was all just a nightmare. I was once hopeful, but now I feel like I'm getting my hopes up. I don't want Obama to be the better candidate but the best one. I want to pick a president, not pick my poison.

I have never been so disappointed with democrats than I am now...I'm talking about the real Flip Fops..us the American Democrats..I don't agree with half of what I'm reading...You are willing to stop support for Sen Obama because you disagree with him but you will allow MCCain to win to just have the same policies or bills pass anyway? Why are u putting this just on him? Have u contacted Mccain and his people..have u voiced these same complaints against yourselves? We let Kerry down in 2004..why didn't we come out in records numbers for him and avoided half of this nonsense..Why are u putting all of this on Obama shoulders as if he is already President? He is trying to get elected and to do that he needs our support. If he is elected then you can hold his feet to the fire and if he doesn't live up to what he stands for then don't vote for him in 2012..I'm disappointed and I will try to send him more money to his campaign...And those of you that express you will not that is fine but if he gets elected without your support please stay with MCCain and the Republicans...I want change even if it is a small one.

It's sad, but it doesn't change my vote.

First, given how many Dems are backing this, it makes me wonder what info was in their top secret briefing. Hopefully not lies by Bush to gain support.

Second, if Obama wants to get elected, he needs the support of more than his base. That means going towards the center so he appeals to a broader base. Otherwise, we end up with a President McCain, and he's definitely the worst option we have. From now until November, every vote he makes will be criticized by the right as "soft" on terror if it's even a little "liberal". That means that until the elections, he has to compromise what he might normally do, or he risks blowing the election.

Third, if the bill IS passed, we can't afford a President McCain. As nuts as he is at "getting" our enemies at any cost, you can bet he'd abuse the hell out of it. With a President Obama, there's a possibility of an effort to reverse it once he's "in power".

Fourth, a vote for another candidate is a vote for McCain.

Fifth, according to a lawyer who read the bill thoroughly, it's poorly written and doesn't explicitly state you CAN'T go back and prosecute telecoms. Obama is a lawyer and extremely intelligent...I have no doubt possible loopholes on immunity haven't escaped him.

Given all of that, my money is still on Obama being our best hope.

Here you go again. HRC voted for the bankruptcy law and credit card bill that was written by the credit card companies that was much worse than the energy law. The energy law at least raised the CAFE standards. It was a compromise bill that had very good portions for the environment and creating renewable energies with some not so great parts. But at least Obama and other Democrats got ANWR and offshore drilling removed from the bill.

If it wasn't for the overly punitive bankruptcy law that HRC signed many people would not need to go into foreclosure. Get your facts straight. We all know you are still trying to push Operation Chaos. You are not a HRC supporter, you are an 0bama detractor. Otherwise like every other Hillary supporter you would not be attacking 0bama on a hourly basis.

the bankruptcy bill HRC voted for did not become law.

by the time the next bill came up for a vote, she did not vote for it. that's the one that passed.

I did. My rep Pete Stark did not vote. I called him out on that.

I wrote to Obama and let him know that although I oppose Immunity, I understand the political pickle he is in. The smart play is to support the full compromise bill even if there are no avenues for separating Immunity from it.

I also donated $500 to his campaign, because I understand how crappy this dilemma must be and will cost him support from the naive zealots.

I have read this piece , and then , read it again . Seems to me , Obama is posistioning himself to be able to go either way . I wont get too alarmed yet. Maybe he will make a statement down the road to clarify his clarification .
