On CNN's American Morning today, McCain surrogate Nancy Pfotenhauer continued last week's attacks on Senator Barack Obama's decision to opt out of public financing in favor of his own dedicated funding mechanism. Pfotenhauer continued the McCain camp's ongoing message that Obama somehow violated the public trust, saying, "It's doing the right thing when it's difficult that character is revealed. So juxtapose Obama, who has a preacher's gift for a righteous statement but side steps like a politician when it's going to cost him anything, with John McCain who wouldn't take the easy way out, even when his life was on the line as a prisoner of war."

CNN's John Roberts did offer up a little bit of pushback, raising the question of whether McCain cheated the campaign financing system to secure a loan when he needed one. Josh Marshall has the details over at Talking Points Memo:

McCain opt[ed] into public financing, accepted the spending limits and then profited from that opt-in by securing a campaign saving loan. And then he used some clever, but not clever enough lawyering, to opt back out. And the person charged with saying what flies and what doesn't -- the Republican head of the FEC -- said he's not allowed to do that. He can't opt out unilaterally unless the FEC says he can.


The most generous interpretation of what happened is that McCain's lawyer came up with an ingenious legal two step that allowed him to double dip in the campaign finance system, eat his cake and spend it too. But even if you buy that line, successful gaming of the system doesn't really count as strict adherence. And the point is irrelevant since the head of the FEC -- a Republican -- says McCain cannot do this on his own.

Pfotenhauer's response was a mouthload of gibberish about how the "primary season is broken" and how McCain is a "bold man" who takes "bold action." Like, say, boldly breaking the law!

Right about now, it would be worth noting that maintaining a strained and strenuous opposition to the new G.I. Bill, only to slip in at the last minute when its passage became inevitable and cravenly attempt to take credit for the bill - as McCain has done - is neither "bold," nor the actions of someone who's built his character by doing the "right thing" when it was "difficult." So there, I've noted it.

ROBERTS: There's been an awful lot of criticism of Senator Obama for this decision from the McCain campaign. Isn't that just because it puts Senator McCain at a distinct financial disadvantage?


PFOTENHAUER: I don't think so. This is something that both gentlemen said they would pursue because it was the right thing to do. It was the right thing to do because pursuing public financing is a way of keeping corruption and special interest politics to a minimum. And the bottom line is that Obama broke his word to the American people. You know, it's easy -- doing the right thing is easy, it doesn't really test your character. It's doing the right thing when it's difficult that character is revealed. So juxtapose Obama, who has a preacher's gift for a righteous statement but side steps like a politician when it's going to cost him anything, with John McCain who wouldn't take the easy way out, even when his life was on the line as a prisoner of war. And he was offered early release and special treatment and he refused to take it because that wasn't the right thing to do.

ROBERTS: Let me try to keep this focused on campaign finance. We had Robert Gibbs, the communications director from the Obama campaign on this program on Friday. He says that the McCain campaign uses financing -- that the public system only when it suits his purpose and that he's got his own problems when it comes to public versus private financing. Let's listen to what Robert Gibbs said.

GIBBS (taped): John McCain used the public financing system over the last two years and gamed it every step of the way. When his poll numbers were good he was out of the public financing system. When his poll numbers were bad, he was using the public financing system as nothing more than a shell game.

ROBERTS: So what he's talking about there, Nancy, is back in the early stages of the primary campaign when John McCain wasn't doing so well, it looked like he was going to take public financing and then when his poll numbers came up he decided to opt out. Then there was this idea of this line of credit for $4 million that he took and still some lingering questions over whether or not he used that as collateral for public financing. The FEC still wants to know about this and the democrats are going to refile a lawsuit on that issue tomorrow morning. So what do you say about that?

PFOTENHAUER: Of course they are. That's the nature of politics. But you know, John, that there's a big difference between public financing at the primary level and the general election. People have acknowledged from both parties that the primary system is broken, if you will, from the standpoint of financing. And it was the people who were kind of the cream of the crop who are committing to public financing in the general election. And Obama, that he would aggressively pursue it and threw it out the window the second it was inconvenient. Bold talk, not bold actions. Frankly, bold actions that makes the man.

I would like to know how it is inconvient? (Him chosing to not take public finace.) I mean O bama has no clue exactly how much money he will get. He may get less than he would have gotten from public financing. As far as I am concerned people giving at a grassroots level is public financing. I love how she threw all of the POW bs in there. War hero my arse. He took special treatment from those people just like he did with the US Navy. Any chance he got to cut corners he did. All of the people from the mccants side always act so smug,bugs me to pieces. OK. I will step down off of my soapbox now.

Did anyone else notice how lately, the McBush camp is trotting out the women surrogates to speak out for him? Nice tactical move on their part......­..........­.......but again McBush is underestimating the intelligence of Americans, at least most of us.

Since he does seem to be making women more visible in his campaign, we all have to make sure to get the word out that John McCain is NO friend of women! His voting record on women's issues (such as better access to cancer screening for low-income women) is deplorable! If he's elected President (God forbid!) and gets his way on Supreme Court Justice nominations, our daughters and granddaughters will be paying the price. Freedom of Choice on reproductive rights will be only an idealistic memory. Women will again find themselves victims of dangerous -- even lethal -- illegal abortion procedures. We have to get this information out to all women (and to the men who love them)!

As usual, the mainstream media is missing the point. More surprising is that the Obama campaign is really failing to grab this discourse by its neck and drive the conversation. People have said that Obama, by opting out, has killed public financing. In a way, yes. He has killed the McCain-Feingold law, that's true. But the fact is that, once again (as seems the case with the Obama campaign, see: grassroots organizing, media and messaging, fundraising) they have outrun everyone else. The point of campaign finance reform is to take away the power of wealthy individuals to manipulate candidates as well as their platforms for their own gain while at the same time empowering the average voter. If one does the math, Obama has achieved this beyond anyone's imaginations. The fact that McCain has raised less total money while having a higher average donation per person should be egg on his face. Message to McCain: build a real coalition of citizens who are able to donate a few dollars and maybe you wouldn't have to have Charlie Gibson go out and publicly embarass himself for the upteenth time this election year just to save you from appearing to be the whiny loser you are.

Well wouldnt it make more sense from a republican standpoint for him to deny public funding? With the state this country is in...Im glad he turned down 85 million dollars of tax-payer money! Its so funny how they are making this an issue and this is actually something THEY shouldve done! *shrug* Im numb at this point!

I could not agree more! this is a true public financing system unlike the garbage loop hole filled Mc Cain finance reform bill that he is now using those loopholes to take in 70,000 donations from individuals. The public finance system is broken and if that is whom he has advising him no wonder he is doing so badly. She points out the obvious that the public system of financing is broken of course she says just the primary system but funny thing is there the same system! how dumb could she be!

They have both changed their minds on several things. We can call it flip flop or we can call it using judgement. Obama should have opted out of public financing. He by having so many small contributors he has lived up to his promise to keep big money out of the campaign. This was the intent of public financing -- so what is the big deal outside of the beltway?

I read the same report it was not only rasmussen but a few others also that was noted and finance reform has never in the history of elections been a huge issue the public would rather not have there money sent to a candidate they do not support so GOP is on the losing side on this one yet again! All these wedge issues they keep trying to elevate to the public are blowing up in there faces

John Roberts should have succeeded Dan Rather on the CBS Evening News for this very reason. He's one of the few that doesn't just let a McCain surrogate spew their talking points without accountabilty.

And why does McCain get a free ride from the press on his flip-flops on Bush tax cuts, on torture, on Gitmo detainee rights, on immigration, on religion's influence in politics--see his comments about Jerry Falwell from a few years ago versus the speech he gave at Falwell's college. Then add in the public financing issue and his use of the wife's private jet and you have conclude the press is either in the bag for McCain or they are still too afraid of Republicans and too afraid to be accused of liberal bias to actually challenge them on these issues.

McCain only declared when Obama made his stance. The McCain campaign has been gaming the system and breaking laws HE HELPED ENACT. Interesting how she side-stepped McCain's questionable character on this issue while attacking Obama. It seems the McCain campaign's biggest advertiser is going to be the MSM minus MSNBC.
