WASHINGTON — Ivy Leaguers and other top law students were rejected for plum Justice Department jobs two years ago because of their liberal leanings or objections to Bush administration politics, a government report concluded Tuesday.

In one case, a Harvard Law student was passed over after criticizing the nomination of Samuel Alito to the Supreme Court. In another, a Georgetown University student who had previously worked for a Democratic senator and congressman didn't make the cut.

Even senior Justice Department officials flinched at what appeared to be hiring decisions based _ improperly and illegally _ on politics, according to the internal report.

"Individuals at the department were rejecting any of our candidates who could be construed as left-wing or who were perceived, based on their appearances and resumes and so forth, as being more liberal," Kevin Ohlson, deputy director of the department's executive office of immigration review, complained to Justice investigators.

The report marked the culmination of a yearlong investigation by Justice's inspector general and Office of Professional Responsibility into whether Republican politics were driving hiring polices at the once fiercely independent department.

The investigation is one of several that examine accusations of White House political meddling within the Justice Department. Those accusations were initially driven by the firings of nine U.S. attorneys in late 2006 and culminated with the ouster of Alberto Gonzales as attorney general last September.

The report issued Tuesday concluded that politics and ideology disqualified a significant number of newly graduated lawyers and summer interns seeking coveted Justice jobs in 2006.

As early as 2002, career Justice employees complained to department officials that Bush administration political appointees had largely taken over the hiring process for summer interns and so-called Honors Program jobs for newly graduated law students. For years, job applicants had been judged on their grades, the quality of their law schools, their legal clerkships and other experiences.

Story continues below

But in 2002, many applicants who identified themselves as Democrats or were members of liberal-leaning organizations were rejected while GOP loyalists with fewer legal skills were hired, the report found. Of 911 students who applied for full-time Honors jobs that year, 100 were identified as liberal _ and 80 were rejected. By comparison, 46 were identified as conservative, and only four didn't get a job offer.

The political filtering of applicants ebbed for the three years between 2003 and 2005, the inquiry found, then resumed by 2006.

Of 602 Honors candidates that year, 150 were identified as liberal _ including 83 who were cut. Five of 28 self-described conservatives were rejected.

Investigators blamed two political appointees on a three-person screening committee for the preferential treatment. It also singled out one of them, former deputy attorney general staff chief Michael Elston, for failing to make sure the hirings were proper _ and giving evasive and misleading answers about why they were not.

An attorney for Elston, who is now in private practice, did not immediately return a message seeking comment.

Although federal law prohibits discriminating against government job applicants based on their politics, it's unlikely that any of those involved in the hiring process will be penalized since they no longer work at the department. A Justice official said the department is not considering pressing criminal charges or taking or civil actions against them.

Democrats quickly seized on the report to bludgeon the Bush administration for playing politics with a department sworn to uphold the law fairly.

"This is the first smoking gun," said Sen. Charles E. Schumer, D-N.Y., who sits on the Senate Judiciary Committee. "We believe there will be more to come. This report shows clearly that politics and ideology replaced merit as the hiring criteria at one of our most prized civil service departments."

Under Gonzales, the Justice Department last year moved to prevent politics from influencing the hiring screening process. His successor, Attorney General Michael Mukasey, said Tuesday he "will continue to make clear that the consideration of political affiliations in the hiring of career department employees is impermissible and unacceptable."

Everytime this administration gets caught at doing something truly reprehensible and illegal, they're kneejerk reaction is 'well, the OTHER side does it,' without supplying any evidence to back it. Just 'blurring and minimizing' their bad actions like a sociopathic child. Fact is, this administration did things to extent NEVER BEFORE SEEN--using all areas of our government to push their political goals. I want my Justice Dept back. And I want those in this administration who went along with all these illegal and unethical acts to be 'held accountable.' You know--that same 'accountability' Republicans always demand of everyone else.

Now that we know for a fact what's been going on, what is going to be done about it? According to this article, the people involved in the illegal hiring practices are not going to answer for their crimes. And I doubt seriously that any of the sub-standard hires are going to lose their jobs. So where is the accountability!!!???

I fear under Pelosi, there will be no accountability. It just goes to show that women wanted to see the first Speaker of the House be a woman without knowing anything about her really. Women need to realize that just being a woman doesn't mean you will do the right things for your country. We need to think and investigate more before we put our hopes and desires into a candidate because of their gender. What a shame this is.

Golly, it only took a year to demonstrate what journalists had proven in just a couple weeks .... And of course no one will be held accountable for this, either.

The accumulation of crimes committed by the Bush Administration may lead to the worst consequence for the country, even worse than the Iraq war: governments run by loose cannons who flout the law, violate the constitution, issue Signing Statements and Presidential Orders that negate legally enacted legislation, and do so with impunity. We could find ourselves in wars, lose our rights for assembly & speech & free press, suspend habeas corpus, have our Social Security given away to private control, etc., all by the signature of one person. These grim consequences could happen if we did not hold Congress accountable and make them hold the administration accountable.

I don't know what journalists you're talking about because whatever they had proven never was released to the people that's for sure. The media today is not in harmony with the people. They report whatever their bosses tell them to report, certainly NOT THE TRUTH.

Early in his administration, Bush called for changing the Civil Service system, to allow senior executives to hire and fire at will. Thankfully, he did not get the changes he requested, or the entire government would be staffed by Republican flunkies.

As it is, Bush's appointments have demoralized professional civil servants and managers, forcing many to quit after bumping heads with Bush's cronies. We've lost many dedicated and competent managers as result of Bush's attempt to pack the agencies with his loyal supporters. The Justice Department is but one example. Ask anyone who works in a federal agency how Bush has undermined their effectiveness.

Neo-cons believe that the best government is no government. That way they can simply rule over us by decree.

crablover, truer words were never spoken. That one sentence says it all in a nutshell.

If the neocons had been alive during our War of Independence, they would have most assuredly sided with the King of England and the Tory party. They are, for some reason, uncomfortable with true democracy.

This is a surprize to who?
Really people this man or this administration has lied since before he was appointed by the supremes!
Think not? Would you like to travel down memory lane?
Lets see the first one I can remember was i'm a uniter not a divider, Then there was I'm a christian, Then there was i'm a compassionate conservative.
Then there was all the lies about his lack of military service or the way he sherked his duty.
Then there was all the lies that got him appointed not elected.
Then we get to 911 wow what a pack of lies we have to go with that, no one could have known that they would fly planes into buildings.
Then it was a historical document remember bin laden determined to strike in the united states.
As every day goes by the lies get bigger more people die because of the lies and more people are starting to see just what a pack of lying fools we have allowed to over run our government.
War crimes trials are way over due as well as impeachment. For gods sake people if we could impeach bill clinton for sex with a consenting adult surly this fool needs to be impeached for the real crimes he and his cabal have commited.
We can never make things right after so many people have been murdered but maybe we can bring some comfort to those that have survived this pack of murdering thieves!

Anybody who thinks George W didn't have an agenda prior to 2000 of stacking the supreme court, the justice dept., and basically every other department to assure republican power and influence for years to come is in la-la land.

Obama, when he gets in the White House, will have his hands full cleaning house, cleaning government and getting this country back on track.

I only wish we could impeach supreme court justices also, like Scalia, a definite bush cohort. We're stuck with them for life and that is a shame. I don't know why the founders didn't put in a "failsafe" for justices just in case something like a Bush would come along and pike 'em high with his cohorts.

Unfortunately, once President Obama takes office, the more likely scenario will be that the conservatives will be so freaked out, they're going to make it their life's mission to block every attempt he makes at any kind of real reform.

President Obama's cabinet secretaries will have a daunting task when they take over in January 2009. Not only has Bush destroyed this country, which is problem's enough to deal with, but in my view, the first priority will be to flush out all the Bush cockroaches that have been imbedded in the Federal Civil Service. Political appointee's will hit the door quickly; it is finding all the moles these un-American republicans have planted in the hopes of destroying the Obama presidency. Obama, show no mercy; get rid of these vermin quickly. Then start prosecuting them for all the crimes they have committed. (you may have to build a new federal super-max prison to accommodate all of them.

On occasion I've watched as a police car went through a red light or failed to come to a complete stop at a stop sign or was driven at a speed above the posted limit. Like you, I noted the lack of concern for the law and went on my way.

The Bush administration is the police department, writ large. Congress is you and me, writ large.

And the next time you see a crime happening, maybe you will think about getting a license plate number especially if their sirens aren't in full blast. Going through lights and not stopping at stop signs is against the law even FOR THE LAW, who might just be going home for a snack.
