WASHINGTON — Ivy Leaguers and other top law students were rejected for plum Justice Department jobs two years ago because of their liberal leanings or objections to Bush administration politics, a government report concluded Tuesday.

In one case, a Harvard Law student was passed over after criticizing the nomination of Samuel Alito to the Supreme Court. In another, a Georgetown University student who had previously worked for a Democratic senator and congressman didn't make the cut.

Even senior Justice Department officials flinched at what appeared to be hiring decisions based _ improperly and illegally _ on politics, according to the internal report.

"Individuals at the department were rejecting any of our candidates who could be construed as left-wing or who were perceived, based on their appearances and resumes and so forth, as being more liberal," Kevin Ohlson, deputy director of the department's executive office of immigration review, complained to Justice investigators.

The report marked the culmination of a yearlong investigation by Justice's inspector general and Office of Professional Responsibility into whether Republican politics were driving hiring polices at the once fiercely independent department.

The investigation is one of several that examine accusations of White House political meddling within the Justice Department. Those accusations were initially driven by the firings of nine U.S. attorneys in late 2006 and culminated with the ouster of Alberto Gonzales as attorney general last September.

The report issued Tuesday concluded that politics and ideology disqualified a significant number of newly graduated lawyers and summer interns seeking coveted Justice jobs in 2006.

As early as 2002, career Justice employees complained to department officials that Bush administration political appointees had largely taken over the hiring process for summer interns and so-called Honors Program jobs for newly graduated law students. For years, job applicants had been judged on their grades, the quality of their law schools, their legal clerkships and other experiences.

But in 2002, many applicants who identified themselves as Democrats or were members of liberal-leaning organizations were rejected while GOP loyalists with fewer legal skills were hired, the report found. Of 911 students who applied for full-time Honors jobs that year, 100 were identified as liberal _ and 80 were rejected. By comparison, 46 were identified as conservative, and only four didn't get a job offer.

The political filtering of applicants ebbed for the three years between 2003 and 2005, the inquiry found, then resumed by 2006.

Of 602 Honors candidates that year, 150 were identified as liberal _ including 83 who were cut. Five of 28 self-described conservatives were rejected.

Investigators blamed two political appointees on a three-person screening committee for the preferential treatment. It also singled out one of them, former deputy attorney general staff chief Michael Elston, for failing to make sure the hirings were proper _ and giving evasive and misleading answers about why they were not.

An attorney for Elston, who is now in private practice, did not immediately return a message seeking comment.

Although federal law prohibits discriminating against government job applicants based on their politics, it's unlikely that any of those involved in the hiring process will be penalized since they no longer work at the department. A Justice official said the department is not considering pressing criminal charges or taking or civil actions against them.

Democrats quickly seized on the report to bludgeon the Bush administration for playing politics with a department sworn to uphold the law fairly.

"This is the first smoking gun," said Sen. Charles E. Schumer, D-N.Y., who sits on the Senate Judiciary Committee. "We believe there will be more to come. This report shows clearly that politics and ideology replaced merit as the hiring criteria at one of our most prized civil service departments."

Under Gonzales, the Justice Department last year moved to prevent politics from influencing the hiring screening process. His successor, Attorney General Michael Mukasey, said Tuesday he "will continue to make clear that the consideration of political affiliations in the hiring of career department employees is impermissible and unacceptable."

So much for those staunch supporters of the American Way, the Federalist Society. Competency has meant little or nought since Bush was elected. Proof: no wmds, no nukes, wrong aluminum tubes, falsified yellowcake documents, Attacking the wrong nation, disregarding those military personnel and firing them because of their take on the Iraq war plan, terrible execution of their terrible war plan, "heck of a job, Brownie" in the Katrina catastrophe, the US attorney scandal, Cheney's secret energy meeting, Bush accusing Clinton of doing nothing when oil on the Clinton watch went from $10.00 a barrel to gasp $30.00 a barrel, $5.00 a gallon fuel, Torture, Abu Gharib, Habeus Corpus, Listening in on conversations and Emails without a warrant. Need I go on exposing the total travesty this administration has perpetrated on the American public and, indeed, the world.

Who, if you recall, fired all the federal judges and replaced them with lawyers more aligned to his way of thinking. Reread the story and replace Bush with Clinton and Republican with Democrats - reads about the same.

You're wrong. Clinton, like every President when they first come into office replaced the DA's, not federal judges. Those are political appointments. Federal judges serve for life. DOJ staff lawyers are hired through the same hiring process all other job applicants go through. Maybe you need to read a little more.

[a] I believe that the interest being expressed now (1200+ posts, as you stated) is because this is yet ANOTHER documented "indiscretion" of the Bush Administration (another "straw" to add to the already massive pile). What will be the "final straw" that breaks the camel's back and forces proper action by Congress...? [you know, that checks and balances and oversight thingy mentioned in the Constitution]

As many frailties, or "perceived" frailties, you may attribute to Clinton -- they fail in comparison to Bush.

[b] While Clinton DID remove all the federal judges in March 1993, it was somewhat at the beginning of his first term (relatively speaking). It IS customary for new President's to make changes at the beginnings of their first term. Documents showed that back in 2005, White House counsel Harriet Miers recommended the idea to the Justice Department that all 93 U.S. Attorneys be replaced. Instead, the Bush team dismissed only eight (eventually replacing more). [so, in your mind, does that make Bush ONLY about 10% as bad as Clinton?]

Stories circulated (in Mar. 2007, I believe) stating that Bush replaced the US Attorneys:
(1) NOT at the beginning of his first term (as is customary)
(2) Were fired as pure political retribution. The U.S. attorneys received positive performance reviews from the Justice Department and were then given NO reason for their firings.

By firing well-respected federal prosecutors and replacing them with Republican loyalists, the Bush administration had politicized the judicial system.

(1) Not wearing the customary (dark) black suit that Bush and his henchmen (um, associates) like Rove and McClellan were pictured wearing "back in the day". -or-

(2) Not wearing the customary armband of the neocon crowd (something resembling a topsy-turvy cross). -or-

(3) Not performing the customary neocon salute to the flag.

I really do worry about the future of a so-called democracy in which substantial numbers of voters are so gullible that they can be hoodwinked by a piece of junk jewelry into thinking that wearing it bears some direct relationship to either decency or patriotism. How easy has it been to drop into Wal*mart, find one of these cheapo bogus symbols from a remainder basket in the jewelry department, and LO you are on your way to the senate as a GOPer.

Next thing the Republicans will be EATING flag-decorated b'day cakes and passing them through their digestive systems (and back out in another form). Whoops...BUSH has already done that AND took pictures, at least of the first part of the process.

Yeah, we have all know about this stuff for years! What I really want to know right now is are any of these ball-less wonder Democrats, who every day recently, have been stabbing the American people in the back and twisting the knife, going to finally do anything about this?? Any investigations and hearings? Any Special Prosecutors appointed or Grand Juries convened? Any criminal charges? Any indictments? Any trials? Any war crimes tribunals? Any Impeachments? If not Dems, why not quit jerking us around and tell us now, so we can stand down from this ridiculous "HOPE" mode and just crawl back into our bunkers and then five months from now crawl back out in November to cast another placebo vote for Ralph Nader?

I am totally convinced McBush is insane. His latest gaffe in a town hall meeting today just proves it.

" COSTA MESA, California (Reuters) - Only World War III would prompt Republican presidential candidate John McCain to bring back the military draft, McCain said on Tuesday.

Many Americans are fearful the U.S. government will be forced to reinstitute the draft given the prolonged Iraq and Afghanistan wars.

Asked about that possibility by a potential voter in Florida during a telephone "town hall meeting," McCain said: "I don't know what would make a draft happen unless we were in an all-out World War III."

The United States ended its last military draft in 1973 in the waning years of the Vietnam war, moving to an all-volunteer military force.

McCain, a Vietnam veteran, said the draft during that conflict weighed most heavily on lower-income Americans, and that this should not be repeated.

"I do not believe the draft is even practicable or desirable," McCain said."

He's not saying he is pro-draft. He is saying he would only consider a draft under the most dire of circumstances. How would Obama answer?

Oh, I forgot....if Obama is elected, there wouldn't be a chance of war because of all of the hope and change etc. He is so enlightened, his brilliance would calm any conflict in the world.

There's a world Obama supporters live in.....and then there's the real world.
