Following the Supreme Court's ruling fortifying 2nd Amendment gun rights, reactions are pouring in from politicians, pundits and bloggers.

Barack Obama:

I have always believed that the Second Amendment protects the right of individuals to bear arms, but I also identify with the need for crime-ravaged communities to save their children from the violence that plagues our streets through common-sense, effective safety measures. The Supreme Court has now endorsed that view, and while it ruled that the D.C. gun ban went too far, Justice Scalia himself acknowledged that this right is not absolute and subject to reasonable regulations enacted by local communities to keep their streets safe. Today's ruling, the first clear statement on this issue in 127 years, will provide much-needed guidance to local jurisdictions across the country.


As President, I will uphold the constitutional rights of law-abiding gun-owners, hunters, and sportsmen. I know that what works in Chicago may not work in Cheyenne. We can work together to enact common-sense laws, like closing the gun show loophole and improving our background check system, so that guns do not fall into the hands of terrorists or criminals. Today's decision reinforces that if we act responsibly, we can both protect the constitutional right to bear arms and keep our communities and our children safe.

John McCain:

Today's decision is a landmark victory for Second Amendment freedom in the United States. For this first time in the history of our Republic, the U.S. Supreme Court affirmed that the Second Amendment right to keep and bear arms was and is an individual right as intended by our Founding Fathers. I applaud this decision as well as the overturning of the District of Columbia's ban on handguns and limitations on the ability to use firearms for self-defense.


Unlike Senator Obama, who refused to join me in signing a bipartisan amicus brief, I was pleased to express my support and call for the ruling issued today. Today's ruling in District of Columbia v. Heller makes clear that other municipalities like Chicago that have banned handguns have infringed on the constitutional rights of Americans. Unlike the elitist view that believes Americans cling to guns out of bitterness, today's ruling recognizes that gun ownership is a fundamental right -- sacred, just as the right to free speech and assembly.

This ruling does not mark the end of our struggle against those who seek to limit the rights of law-abiding citizens. We must always remain vigilant in defense of our freedoms. But today, the Supreme Court ended forever the specious argument that the Second Amendment did not confer an individual right to keep and bear arms.

White House Spokesman Tony Fratto:

We're pleased that the Supreme Court affirmed that the Second Amendment protects the right of Americans to keep and bear arms.

House Speaker Nancy Pelosi:

I think it still allows the District of Columbia to come forward with a law that's less pervasive. I think the court left a lot of room to run in terms of concealed weapons and guns near schools.

House Minority Leader John Boehner:

In the most significant victory for the Second Amendment in recent memory, the Supreme Court today reaffirmed our citizens' constitutional right to keep and bear arms. ... This decision should send a clear message to opponents of the Second Amendment. The Constitution plainly guarantees the solemn right to keep and bear arms, and the whims of politically correct bureaucrats cannot take it away.

Senator Russell Feingold:

I think this is a long overdue decision; I don't think the precedent has been seriously reaffirmed in decades.

Senator Frank Lautenberg:

Today, President Bush's radical Supreme Court justices put rigid ideology ahead of the safety of communities in New Jersey and across the country. This decision illustrates why I have strongly opposed extremist judicial nominees and will continue to do so in the future.

Senator Dianne Feinstein:

I am profoundly disappointed in Justice Roberts and Justice Alito, both of whom assured us of their respect for precedent. With this decision, 70 years of precedent has gone out the window. And I believe the people of this great country will be less safe because of it.

Senator Patrick Leahy:

In its decision in District of Columbia v. Heller, the Supreme Court has recognized the personal right to bear arms, guaranteed in the Second Amendment of the Constitution, and expressly held for the first time that our Bill of Rights includes this right among its guarantees of individual liberty and freedom. That is a good thing. This opinion should usher in a new era in which the constitutionality of government regulations of firearms are reviewed against the backdrop of this important right.


In its review of the law in the District of Columbia, the Supreme Court did not say that all government efforts to keep guns out of the hands of criminals are unconstitutional, but that gun regulations must be sensible, reasonable and defensible.

Since before the nation's founding, Americans have used firearms for protection and sporting purposes. I have enjoyed target shooting since my days at St. Michael's. I know Vermonters will be relieved and encouraged to see their rights recognized, just as they were when the Supreme Court preserved the Great Writ of habeas corpus in its decision earlier this month.

The Republican Study Committee (delivered by Rep. Jeb Hensarling):

For over 30 years, the D.C. handgun ban has prevented law abiding citizens from purchasing legal guns to be used for legitimate reasons - such as self-defense, hunting, and sport shooting - while doing little to keep guns out of the hands of criminals. D.C. residents will finally have the same rights as their countrymen to bear arms and defend themselves from violent crime.

Chicago Mayor Richard Daley (via The Chicago Tribune)

An angry Mayor Richard Daley on Thursday called the Supreme Court's overturning of the Washington D.C. gun ban "a very frightening decision" and vowed to fight vigorously any challenges to Chicago's ban.


The mayor, speaking at a Navy Pier event, said he was sure mayors nationwide, who carry the burden of keeping cities safe, will be outraged by the decision.

This split should be useful to either of the Presidential candidates who wants to make either gun control or gun rights into an election issue -- my guess is that this is more likely to be McCain. Expect McCain ads in states where there are likely many pro-gun swing voters stressing, "your constitutional right to keep and bear arms hangs by one vote." Also expect fundraising letters to likely pro-gun contributors stressing this at length.

I also doubt that conservatives will be too upset by the "judicial activism" involved in the Supreme Court overturning the DC handgun ban. I don't really understand the details of the ruling at this point, but I'm not complaining about it either. From a policy perspective, what DC is trying to accomplish is just futile -- as long as the District is a very small patch of land adjacent to Virginia, there's no way gun regulations of this sort will prevent criminals from acquiring weapons.

Individuals have a constitutional right to possess a basic firearm (the line drawn is unclear, but does not extend to automatic weapons) and to use it in self-defense. The government can prohibit possession of firearms by, for example, felons and the mentally ill. And it can also regulate the sale of firearms, presumably through background checks.


The opinion leaves open the question whether the Second Amendment is incorporated against the States, but strongly suggests it is. So today'€™s ruling likely applies equally to State regulation.

Yeah, so they say there is a contsitutional right to bear arms, the opinion ignores the whole "well armed militia" part of it, but so be it. We have SCOTUS Judges that literally ignore law.

But what about the manufacture and sales of arms? It doesn't say anything about that. Let's say that people can own all the guns they want, but they can't manufacture, sell, or buy them under any circumstances. This doesn't get rid of the guns, but it does make them a limited commodity, which should raise the price to the point that it is no longer feasible for criminals to afford them. It's the use of the free market system against the NRA.

Since there is a right to own firearms, the right to purchase a firearm and ammunition is implicit. If there is a right to read, there is certainly an implicit right to be able to purchase books, magazines and newspapers.

I don't care if you think this decision is wonderful or terrible.
I DO care that this decision, at this particular moment in this election year, is ANOTHER politically motivated move by a loaded Supreme Court, and take 'loaded' any way you want.
It smacks of vicarious conservative pandering to swing votes, and the timing is reprehensible to the priciples of a body that is supposed to be NON-POLITICAL.

Walter- apparently I wasn't clear enough. I was NOT arguing FOR or AGAINST the decision ITSELF.
I made the point that it was suspiciously TIMED to favor a particular POLITICAL view, in a time that would influence voting in an election.
And to be perfectly clear, being in favor of basic human rights transcends any political or religious inclinations.

I live in Dayton Ohio. It seems like everyday there is another shooting.
If it's not a drive by shooting it's someone had an argument, and shot some other family member, or a friend.
There are no reports of someone protecting themselves, and stopping an intruder.
There was one exception last week the guy shot a cop thinking he was an intruder, He's in jail now!
Handguns don't do a damn thing for protection!

This is another way of saying "hey, I'm running for the Presidency so I gotta try to appeal to both sides. It dosen't matter if I come off looking wishy-washy, getting elected is all that matters. I mean, hey... I was wishy-washy as an Illinois State Senator (136 Present votes) and it got me elected to the U.S. Senate so it should work now, right?"

If Hillary had done this, every Obama supporter would be screaming bloody murder and accusing her of triangulation.

There's not another reaction to this that even approaches to acknowledge the perspectives from both sides of the fence. You call it wishy-washy because...why again?

Personally, I would prefer that the next President break away from the idiocy of the Bushian bipartisan spiel that would pit this as a battle between the ultrapacifists vs the ultraarmageddonites. You may think that's cool, but where exactly has it gotten us the last eight years?

I have been so proud of how Obama has responded to controversial issues this week. His speech on oil dependence, his response to this gun ruling, even how he responded to Ralph Nadar have shown the voice of an intelligent, well-informed and reasonable leader. For several elections, all we've heard from candidates on either side is sound bites and the same statements repeated over and over. Obama actually thinks about issues and responds to them in a thoughtful, detailed way. Certainly, there are liberals who want him to be against guns (and in an ideal world, I would be one). But he knows the issue is complicated and to many Americans, gun ownership symbolizes freedom, nevermind that the authors of the 2nd amendment had militias and muskets in mind, not individuals and AK47's. But Obama wants to lead all of us, not just some of us, and he is taking less polarizing positions and explaining them clearly, even when he may take heat for them, and that is incredibly impressive.

I also like that he responds to all issues thoughtfully, not just as campaign opportunities. He continues to keep his campaign on a higher plane, while McCain uses every event as an opportunity to sling mud (example: using this ruling to bring up the "bitter" and "elitist" labels, neither of which had any relevance to Obama's reponse). The polls are showing that I'm not the only one who is impressed.

Nope, not kidding at all. This country is made up of lots of kinds of people and I'm sick of the idea that any politician can only represent one side of things. We need peace within our country as much as we need it in the rest of the world. The gun issue is not black and white. I'm sorry that the 2nd amendment every got into the Bill of Rights - it has caused nothing but trouble since. But for sweeping gun control laws to have any effect in our current society, we would first need to CONFISCATE all of the existing illegal firearms (and those of people who got them legally but shouldn't have) and start from scratch. That isn't going to happen.

Nonetheless, I know that when I help Obama get elected, the next members of the Supreme Court will interpret laws in ways that are closer to my values than any who might be nominated by John McCain. So yes, I really do want Obama to be elected, but no, not at any cost. A smart man who understands the complexity of issues and understands that some compromises will need to be made to have a more inclusive government - yeah, I can live with that.

Should the real fight be against the manufacture of guns? A fair fight becomes the norm, the best persons wins, etc. I don't really see guns as an equalizer.

It is not a fair fight when a 250 pound assailant attacks a small statured victim that has been disamed (think boxing match between a 105 pound boxer and a 225 pound boxer--if they are both well trained, the little guy is going to get creamed)

If you have a right to keep and bear arms, fine. Please continue to pretend that owning a gun will stop all crime, make America great and cure the common cold..

I have the right (no less important than yours) to choose not to own one. I also have the right to live free of attacks by gun owners (drunk, doped up, mentally ill or otherwise impaired). I also have the right to not live in fear of that kind of attack. Where are my rights??

Thank you, Supreme Court, for nothing. According to you, my rights and those of millions of others, don't matter.

I don't pretend my owning a gun will stop All crime. I just want to stop the one crime someone is trying to do to me. The police actually do a good job ,despite what everyone thinks, in arriving at a priority call quickly. The national average is about 8 minutes. But just for fun run this little exercise and see how safe you feel. Set your egg timer or oven timer for five minutes, well below the average. Close your eyes and sit in a chair. Pretend someone is breaking into your house, or attacking you or a loved one. Pretend you cannot run away, nope don't open your eyes. You still have 4 minutes to wait for the police to come save you. Its' all very silly isn't it. But I'll bet a lot you will not do this, will not try it out,and will poke fun at me for suggesting it and if you do give it a try you cannot keep your eyes closed for five minutes because it is a very very long time. But during the same five minutes you could defend yourself if you believed in owning a gun.

I live in one of the crime ravished communities to whom Senator Obama referred. Due to the dire economy, joblessness, bankruptcies, foreclosures, homelessness, etc. the crime is ravishing greater numbers everyday. On a daily basis, little children are killed on the streets and in their schools. On a daily basis, innocent people walking down the street are caught in gang cross fire and murdered. On a daily basis, people are carjacked and killed. On a daily basis, people are robbed in their homes in broad daylight. The police force is leaving in droves and recruiting is extremely dismal.
The lifting of any bans on the purchase AND use of handguns by the mayors of urban centers will only result in more death and killing. The Supreme Court justices must be chapperoned to work by armed guards and live in communities with gates and lots of security. Obviously, they have no idea of the reality of much of America. With so many angry, impoverished citizens, gun crime will only escalate. These are desperate times in America and the SCOTUS today made it even more desperate to live in this country. Pretty soon, Americans who can afford it, are going to leave. Much like their ancestors three or four generations ago, they are going to move away because it is not a place where people can any longer live in peace and support their families and keep them from harm.

It's actually the mayors of those cities that deny law-abiding citizens the right to self defense that are, "...chaperoned to work by armed guards and live in communities with gates and lots of security".

If you think criminals and gang-bangers are affected by bans, you're really living in a fantasy. Laws against illegal USE of guns are in no way affected by the second amendment.

The Constitution has always been interpreted to fit modern times, and that is what we need to do with the 2nd Amendment. Guns need a LOT OF CONTROL. They carry around guns in some parts of Middle East and it's just the scariest thing I’ve seen, looks like an un-modernized society that needs to carry around guns. It is a shame that America is moving backwards to caveman days and not forwards to a modern society. How much hunting do you need to do in 2008? We live in a time where there are billions of humans overburdening the ecosystem. The first time you get confronted by a 16 year old brandishing gun in the urban city, or your kid gets shot at in some rural school, let’s see who will be standing up for gun rights then. Imagine going grocery shopping or going to a bank and seeing some weird looking man carrying a gun. How safe would that make you feel? Geez’ we are peddling backwards. So for everyone who says we have a right to bear arms, get over it because there are wackos who don't just bear arms, but kill innocent people. There is some city in Virginia where the people walk around foolishly with guns strapped to their sides, and that is one City I would never support. Certain weapons ought to be banned, and if you have never been confronted with a FOOL waving a gun, soon you might just get your chance.

She makes me laugh! Feinstien voted these two liars & perjurers into their lifetime positions. They gladly lied and perjured themselves in order to get confirmed and now gutless Feinstein is dissapointment. You know exactly what you can do with your dissapointment, Dianne.
