The debate over how the Bush administration has conducted its warrantless wiretapping program seems to be nearing a legislative end.

On Thursday, the United State Senate voted overwhelmingly to advance a legislative compromise on the Foreign Intelligence Surveillance Act, marking the beginning of the end of a fierce battle over civil liberties and national security that has been waged in the halls of Congress for more than three years.

And yet, for all of the political passions the issue engendered, the fight over FISA ended with something of a whimper. The final product -- much to the consternation of the progressive community -- gave the president wide authority to monitor terrorist suspects and collect communications from U.S. citizens without review. It also offered telecommunications companies that helped with the previously illegal program immunity from lawsuits, a hard provision to swallow for the program's opponents.

In the end, only 15 U.S. Senators were willing to resort to procedural tactics as a last ditch effort to hold up the legislation. The list of those who voted against cloture included:

For the White House and the majority of the Senate, the FISA compromise has been hailed as a political breakthrough. "I think the White House got a better deal than even they had hoped to get," Republican Sen. Kit Bond told the New York Times.

Sen. Barack Obama, a reluctant supporter of the bill, said he would work to strip telecom immunity from its language. However, he added, "My view on FISA has always been that the issue of the phone companies per se is not one that overrides the security interests of the American people."

Others were not so willing to concede. Sen. Chris Dodd, who left the campaign trail before Iowa to threaten a filibuster of a FISA compromise that included immunity, today bemoaned the fact that the public would never know the scope of the administration's actions.

"We're closing the door, never to know why this happened, who ordered it, why did they avoid [the courts], what was behind their thinking," said the Connecticut Democrat. "And that is a dangerous step for us."

Sen. Russ Feingold, another aggressive opponent of the compromise, spoke with sorrow over his party's unwillingness to put up a principled fight.

"It's the latest chapter of running for cover when the Administration tries to intimidate Democrats on national security issues," he told The Young Turks radio show. "It's the most embarrassing failure of the Democrats I've seen since 2006, other than the failure to vote to end the Iraq war. These are the two real sad aspects of an otherwise pretty good record. It's letting George Bush and Dick Cheney have their way even though they're that unpopular and on their way out. It's really incredible."

OBAMA IS LOOKING OUT FOR THE SAFETY OF THE AMERICAN PEOPLE, THAT IS THE ONE MOST IMPORTANT TASK OF A PRESIDENT. LIKE OBAMA HAS SAID, AND I BELIVE HIM: "My view on FISA has always been that the issue of the phone companies per se is NOT one that overrides the SECURITY INTERESTS of the American people."

FIRST JOB OF THE FUTURE PRESIDENT, KEEP US SAFE!!! THAT IS WHAT ALL OF US NEED AND WANT !!! The mechanisms had to be put in place to do that, and THAT WAS OBAMA'S FIRST PRIORITY OUR SAFETY, OUR COUNTRY'S SAFETY

Obama has also said that he would work to strip telecom immunity from its language from FISA, and I believe that he will, because there is NO benefit for him to NOT do this, so I know that he will do what he says he will do, and work to remove telecom immunity from FISA.

I AM ALOT SURE THAT OBAMA WILL WORK TO REMOVE TELECOM IMMUNITY FROM FISA, AND I AM 100% SURE THAT JOHN McCAIN WILL NOT REMOVE IT!!!!

The benefit to him is the telecom dollars for his election that are not going to come if he doesn't agree to the retro immunity. It's always about the money. Nothing more, nothing less. Say what you will but it's been proven time and again money talks.
Watch how the telecom industry doles out donations between now and November. If you don't support us (telecom) we won't support you. Even if what we did was illegal and immoral. The ones that should really hang for this are the guys in the White House and Justice Department that came up with this illegal crap to begin with. I wonder if the U.S. Government strong-armed these companies to comply with their requests? Never heard much on that idea. If true and someone would come forward with this info then we could find the real slimeballs behind it all. For these large companies to do something so wrong without some sort of pressure is not believable to me. They aren't crazy. Maybe a threat of losing government contracts? Maybe some sweet deals on waterfront property down beside Rove's new abode in Florida? Just to many ideas floating around for me to understand it all. I do believe we're being pulled into misdirection here so that the real problem won't come to light.

Instead of complaining or applauding here on a forum, how about some of you actually make a phone call or fill out the contact form on your senators' websites? I have already called my two senators today (Brown and Voinovich) to let them know how I feel about this issue, how many of you have bothered to do so before spouting off here?

I did that. I contacted both Kerry and Kennedy. Kerry made the right decision. I guess Ted is not able to vote, not back yet. So I did my part. I also made my feelings known to BO. I guess it is just over and we can only hope that with BO and more dems in November, we will be able to do something to adjust this.

Exactly. I have make numerous calls to my senators and Obama's campagin headquater in Chicago. The latter said they have been overwhelmed by the complaints, but I guess there is little effect to Obama, anyway.

I called Ed Perlmutter's office (CO-District 7) to say I highly disapproved of his vote *for* the bill, Ken Salazar's office for voting to send the bill along, and left a message on Majority "Leader" Reid's answering machine express my support of the Constitution and disdain for this bill.

Kudos to Feingold, Dodd, et al. for showing us what real leadership is.

(Oh, yeah - I called Obama's HQ, too.)

You know, I think I agree with Indoboy, the terrorists HAVE won. They have made us more paranoid, made us fear our won gov't (of course, Bu$h and friends helped tremendously with that) and made us question everyone, including our peers. They are, and the realization that they were just as responsible for recent fiascos as the Repubs led to the defeat of Clinton, who was capitulator-in-chief. Obama would do well to remember this. That is why the "change" campaign has been so effective. In the past week, Obama has done all he could to erase the very reason for much of his support.

Obama seems to be quite busy enough running for PRESIDENT! Chances are that he won't be able to BE in Washington FOR the final vote. This vote was for ending debate on the TOTAL bill. This does NOT MEAN that Obama will vote FOR the bill itself. He can ALWAYS ABSTAIN! Chances are also that he has at LEAST FIFTEEN 'surrogates' who did what he wanted to do himself. So-we now have SIXTEEN dems on the list. Here's the 'scoop'. The country has been running without ANY KIND of oversight so far as 'electronic surveillance' is concerned for at LEAST three years! SOME kind of bill WAS necessary! Once again, the immunity issue was a tacked on' 'my way or the highway' paragraph, courtesy of the foxy loxy Repubs and their 'across the aisle partners'. Remember PLEASE that 'bipartisanship' the way it is being done right this very MINUTE is NOT 'bipartisanship'. Seems to ME that ALL of these Dems are 'safe' this year. They are NOT up for reelection and none of them is running for President. You who are no longer supporting Obama are like spoiled children who didn't get their pony for Christmas.

I would rather regret finding out the truth, than regret living in ignorance as you seem to want to do antworks. LA was trying to shed some light on what is going on in DC re the FISA bill. I read the article, not sure if the author is credible or not, but it gives me something else to think about and do research about rather than just sitting in front of my tv night after night and blindly agreeing with everything I'm told by Joe Blow from the House, the Senate or the WH.

I agree. There's a lot of ignorant comments going around. I don't think most of the people here know what FISA is or that all petitions for wiretaps must go through a FISA court, thus not violating the 4th amendment. Bush and his thugs circumvented that, but if done properly, FISA should not violate people's rights.

Every government official, federal and state, is required by Article VI of the U.S. Constitution to swear or affirm that they will recognize our Constitution as the Supreme Law of the Land, and protect and defend that Constitution from all enemies foreign and domestic.

The 4th Amendment prohitions unreasonable searches by any of these government officials, all of which swore to respect this constitutional limitation.

A massive search and intrusion into the privacy of all Americans without reason is per se unreasonable. and all that voted to allow Bush/Cheney to continue suspensionless searches has now violated their oath of office and our Constitution.

Our Constitution is the Supreme Law of the Land, not just some not just some suggested guideline to consider only when it's politically expedient.

As our Founders repeatedly recognized, any legitimate form of government is created based on the consent of the People, with the purpose of protecting our life, liberty, and property. They don't get to pretend to pick one and ignore the rest.

Further, any government that shows such contempt for the rights of its people cannot be trusted to protect any of these rights, i.e., ask the people of New Orleans about our current government's sincerity in protecting their lives, liberty, and property.

There are 15 Patriots in our Senate.

The rest have shamed themselves with an act of treason, are now responsible for the serious mischief that will flow from this act, and will be harshly judged by history.

I hope we will see some serious attempt to reinstate the Rule of Law and hold government officials to public account, as this would indicate that our government's essential system of checks and balances against the abuse of power was still functioning. But so far, I see no indication that this is the case, and those that have had the courage to stand up to abuse of power are treated like lepers in our current government, and like nut jobs by the media, and not by accident. Those currently in positions of power, and those that brought us the current disastrous status quo, very much mean to send a message that any open dissent will be punished and ridiculed. Most of our "fearless" leaders in both government and the MSM have gotten the message, and have been fiddling with pointless emotionally charged symbolic issues (like who is or is not wearing a "flag pin" "fist bumps" etc.) while our Constitution and our Nation's future burns.
