The debate over how the Bush administration has conducted its warrantless wiretapping program seems to be nearing a legislative end.

On Thursday, the United State Senate voted overwhelmingly to advance a legislative compromise on the Foreign Intelligence Surveillance Act, marking the beginning of the end of a fierce battle over civil liberties and national security that has been waged in the halls of Congress for more than three years.

And yet, for all of the political passions the issue engendered, the fight over FISA ended with something of a whimper. The final product -- much to the consternation of the progressive community -- gave the president wide authority to monitor terrorist suspects and collect communications from U.S. citizens without review. It also offered telecommunications companies that helped with the previously illegal program immunity from lawsuits, a hard provision to swallow for the program's opponents.

In the end, only 15 U.S. Senators were willing to resort to procedural tactics as a last ditch effort to hold up the legislation. The list of those who voted against cloture included:

For the White House and the majority of the Senate, the FISA compromise has been hailed as a political breakthrough. "I think the White House got a better deal than even they had hoped to get," Republican Sen. Kit Bond told the New York Times.

Sen. Barack Obama, a reluctant supporter of the bill, said he would work to strip telecom immunity from its language. However, he added, "My view on FISA has always been that the issue of the phone companies per se is not one that overrides the security interests of the American people."

Others were not so willing to concede. Sen. Chris Dodd, who left the campaign trail before Iowa to threaten a filibuster of a FISA compromise that included immunity, today bemoaned the fact that the public would never know the scope of the administration's actions.

"We're closing the door, never to know why this happened, who ordered it, why did they avoid [the courts], what was behind their thinking," said the Connecticut Democrat. "And that is a dangerous step for us."

Sen. Russ Feingold, another aggressive opponent of the compromise, spoke with sorrow over his party's unwillingness to put up a principled fight.

"It's the latest chapter of running for cover when the Administration tries to intimidate Democrats on national security issues," he told The Young Turks radio show. "It's the most embarrassing failure of the Democrats I've seen since 2006, other than the failure to vote to end the Iraq war. These are the two real sad aspects of an otherwise pretty good record. It's letting George Bush and Dick Cheney have their way even though they're that unpopular and on their way out. It's really incredible."

I contributed to Wexler and as a result got invited to participate in a telephone town hall with the Congressman. It turned out to be nothing but a canned Q&A plugging his new book.

This morning I got an email congratulating Russ Feingold and asking to contribute to him.

It's like tipping people at Starbucks for doing their jobs.

Gee, my advice then, is to contribute NOTHING to the GOP then you'll get what you EXPECT . . . NOTHING!

Your "contribution" says you support their effort and what they are doing . . . to expect MORE slides toward the "Lobbyist" side of "giving" - if you REALLY want more than a "canned" response or request for additional help . . . VOLUNTEER to work actively for them . . . or . . . just be glad ass happy that they are DOING what it appears no other elected official is doing - THEIR JOB - "Protect and Defend".

The DNC supports anti choice candidates and gives money to Blue Dog Democrats who all too frequently vote on the side of this failed administration.

I take that back. It's not a failed administration. They have succeeded to do everything they set out to do. The price of oil is sky high. Cronies head and work in every department of the government. Bush friends became billionaires by robbing the treasury. I think that's a pretty successful track record if your goal is to bankrupt the nation and eliminate the middle class.

Our government deputizing private entities to become an extension of it to assist in violating our fundamental rights could lead to a renegade posse. The problem is they have decided to remove the controls that prevented widespread abuse. This government is functionally inept already, are we to believe they will be able to control the telecom industry. Information is valuable and can be sold to the highest bidders once it is mined in addition used for unintended purposes. This could lead to something far worse than McCarthyism.

In exchange for telecom immunity, the inspectors general of the Pentagon, Justice Department and intelligence agencies will investigate the administration's warrantless wiretapping program.

The bill would also establish new rules to govern when the National Security Agency, CIA, FBI or other agencies can tap American phone and computer lines.

The new surveillance bill would also:
Require FISA court permission to wiretap Americans who are overseas.

Prohibit targeting a foreigner to secretly eavesdrop, without court approval, on an American's calls or e-mails.

Require the government to protect American information or conversations that are collected when in communication with targeted foreigners.

Allow the FISA court 30 days to review existing but expiring surveillance orders before renewing them.

Allow eavesdropping in emergencies without court approval, provided the government files required papers within a week.

Prohibit presidents from superseding surveillance rules in the future.

Why did we need this bill? Besides immunity for telecrimes BEFORE 9/11, It still allows mass computerized surveillance of Americans.

Everything else was already law.

Actually READ the bill first. NOTHING in the bill says ANY of those things must be followed. They are actually GUIDELINES for the FISA bill and court.

None of it. AND of course, as usual, Dumbush only has to put a signing next to it, which he has done for every single bill he has "signed' into law stating he has the right to override ANY of the provisions.

In other words NO ONE got anything compromised, Bush got EVERYTHING he wanted and more and as usual the American citizen got bent over AGAIN.

Obama is a coward. Pure and simple. I was, REPEAT WAS supporting him.

Now he can go to hell.

Where is this written in the bill? That they "will" investigate? Never heard of it. And why, if that's the case, would Dodd and friends not mention? And why are Dodd and friends so upset about not being able to access this kind of info?
I'm not challenging you, btw, I really want to see where the bill gives this order of investigation. Would you be so kind as to cut and paste? Thanks.

Oops,and one other question/comment:
"Allow eavesdropping in emergencies without court approval, provided the government files required papers within a week." Isn't this evesdropping allowed to continue for up to 72 days if the FISA court initially denies the request and an appeals process begins? And if, at the end of that appeals process, the warrant is still ultimately denied, doesn't the info gleaned from that evesdropping still remain "in the loop," so to speak? (In other words, whatever they got for those 72 days - even after an appeal is denied - they get to keep?)

Selective enforcment of the law is nothing new while letting others go.

In Michigan it's a felony not to pay child support.

By the same token it is a felony to commit adultry.
