WASHINGTON — Former White House adviser Karl Rove defied a congressional subpoena and refused to testify Thursday about allegations of political pressure at the Justice Department, including whether he influenced the prosecution of a former Democratic governor of Alabama.

Rep. Linda Sanchez, chairman of a House subcommittee, ruled with backing from fellow Democrats on the panel that Rove was breaking the law by refusing to cooperate _ perhaps the first step toward holding him in contempt of Congress.

Lawmakers subpoenaed Rove in May in an effort to force him to talk about whether he played a role in prosecutors' decisions to pursue cases against Democrats, such as former Alabama Gov. Don Siegelman, or in firing federal prosecutors considered disloyal to the Bush administration.

Rove had been scheduled to appear at the House Judiciary subcommittee hearing Thursday morning. A placard with his name sat in front of an empty chair at the witness table, with a handful of protesters behind it calling for Rove to be arrested.

A decision on whether to pursue contempt charges now goes to the full Judiciary Committee and ultimately to House Speaker Nancy Pelosi.

House Republicans called Thursday's proceedings a political stunt and said if Democrats truly wanted information they would take Rove up on an offer he made to discuss the matter informally.

The House already has voted to hold two of President Bush's confidants in contempt for failing to cooperate with its inquiry into whether the administration fired nine federal prosecutors in 2006 for political reasons.

The case, involving White House chief of staff Josh Bolten and former White House counsel Harriet Miers, is in federal court and may not be resolved before Bush's term ends in January.

The White House has cited executive privilege, arguing that internal administration communications are confidential and that Congress cannot compel officials to testify.

Rove says he is bound to follow the White House's guidance, although he has offered to answer questions specifically on the Siegelman case _ but only with no transcript taken and not under oath.

Democrats have rejected the offer because the testimony would not be sworn and, they say, could create a confusing record.

Rove has insisted publicly that he never tried to influence Justice Department decisions and was not even aware of the Siegelman prosecution until it landed in the news.

Siegelman _ an unusually successful Democrat in a heavily Republican state _ was charged with accepting and concealing a contribution to his campaign to start a state education lottery, in exchange for appointing a hospital executive to a regulatory board.

He was sentenced last year to more than seven years in prison but was released in March when a federal appeals court ruled Siegelman had raised "substantial questions of fact and law" in his appeal.

Siegelman and others have alleged the prosecution was pushed by GOP operatives _ including Rove, a longtime Texas strategist who was heavily involved in Alabama politics before working at the White House. A former Republican campaign volunteer from Alabama told congressional attorneys last year that she overheard conversations suggesting that Rove pressed Justice officials in Washington to prosecute Siegelman.

The career prosecutors who handled Siegelman's case have insisted that Rove had nothing to do with it, emphasizing that the former governor was convicted by a jury.

Let me ask you this: What do you think would happen to you if you just ignored a federal subpoena?

And if you had knowingly broken federal law, do you think that Congress would grant you retroactive immunity?

Then why the hell do some people get away with this?

Yes. I know. Because they have money and power and the rest of us don't.

But that also means that we are no longer living uder the Rule of Law in this Nation.

It's time for the 300 million Americans that are getting screwed by the power elite in Washinton to answer Dick Cheney's: "So?" and hold these traitors accountable under our Constitution and laws, and if our "representatives" in Congress won't do their sworn duty to uphold and defend our Constitution from all enemies foreign and domestic, they get the boot too in November, and are then also held to full account under our laws.

I plan on leaving our chldren and grandchildren a free Nation under the Rule of Law, not under the emerging corporatist fascism we are seeing now. The DEMs either need to get a spine or they are no better than the GOP. We need patriots protecting freedom, not cowardly enablers of fascism.

This is a great post, Moshe! I feel exactly as you do - Democrat or Republican, if they don't understand the Rule of Law they're not qualified to hold office.

We've enabled the Dems for far too long - time to hold our own responsible or forever risk becoming the sheeple we despise. The pendulum is finally starting to swing - either we take advantage of it by talking up progressive policies and how they benefit the greater good or we continue to support inept Democrats who treat us like children that should be seen but not heard.

If he was a regular citizen, he'd have been in jail months ago and still awaiting his trial which won't be coming for another 2 years after having bail denied because they are a flight risk.

In celebration of the new rules, all citizens are encouraged to ignore speed limits, traffic signals, subpoenas, court summonses and 'reduce-speed' signs in construction areas (doubled fines have been cancelled).

Every poll shows that Republicans in Congress are dragging down the averages. Every poll indicates and most Republicans agree the Repubs will lose seats in November. By an overwhelming majority people are planning to vote for a Democratic congress. Once we have more than 49 Dems in the senate and more than a thin majority in the house we can get things done. Pelosi may have been smart to take impeachment off the table. It wouldn't happen bacause there are not enough votes. The Rs just loooove Bushie no way we could get 2/3. It willl be important to see if the new president appoints a Attorney General who will actually investigate crimes and prosecute. Impeachment is basically a labor relations board. The best that could happen is that Bush would be fired. What I want are criminal investigations.

Two words for you: Inherent contempt.

This is its description from Wikipedia:

"Under this process, the procedure for holding a person in contempt involves only the chamber concerned. Following a contempt citation, the person cited is arrested by the Sergeant-at-Arms for the House or Senate, brought to the floor of the chamber, held to answer charges by the presiding officer, and then subjected to punishment as the chamber may dictate (usually imprisonment for punishment reasons, imprisonment for coercive effect, or release from the contempt citation.)"

It was last used in 1934, by the US Senate. The convicted contemnor (who had been sentenced to a brief period of confinement) appealed his decision all the way up to the US Supreme Court, which concluded that the Senate had such authority.

It's now time for the House to dust off this power and use it to complete advantage.
