DURHAM, N.C. — The son of former New York City mayor Rudy Giuliani is suing Duke University, claiming he was wrongfully kicked off the golf team.

Andrew Giuliani claims he was dismissed without cause from the golf team earlier this year because coach O.D. Vincent III wanted to cut the team of 13 players by about half. The lawsuit claims the coach has interferred with Giuliani's efforts toward becoming a professional golfer.

Duke University spokesman Keith Lawrence said Thursday the university was discussing the lawsuit but didn't have an immediate comment.

The 198-page lawsuit was filed Wednesday in U.S. District Court by Durham attorney Robert Ekstrand. Ekstrand did not immediately return a message for comment.

Why aren't Republicans outraged? They are supposedly against frivolous lawsuits, as this clearly is. But I guess if common folks have the temerity to tell a Republican he can't have something that he wants then he can expect a lawsuit. You gotta love that.

Andy is an accomplished golfer who has won an amateur tournament in the New York City Metropolitan area. He was tutored at Van Cortlandt golf course, a public course and represents that course at amateur tournaments.

His problem is that Duke has a very strong varsity golf team and he didn't make the cut. If he believes he has the stuff to make it as a pro golfer, playing college golf is hardly the only path open to him.

Since the members of a college golf team practice and play on the same courses, what their score average is should in large part determine who makes the team. Even if Andy's average is lower than that of someone who made the squad, other factors can enter the coach's choice. For example, a coach might choose a freshman with a 1 stroke higher average than a junior or senior. Or just believe that one has more potential, though yet unrealized.

Hard to see how Andy can win his case.

I believe Duke Lacrosse was exonerated and the DA relieved of his job for false prosecution. You may want to reconsider your post.

It's touching that Rudy raised his son to give back to his country - by being a pro golfer. Instead of naive folks like John and Bobby Kennedy, who taught their children that they should go into public service.

I think the children of wealth and fame need to give more consideration to a life on the golf course. Instead of becoming liberals who ruin everything.

And I fight back tears when I think of how brave this young man is, by choosing to study golf instead of serving on the ground in Iraq or Afghanistan. It would have been so easy to go considering how strongly his daddy beat the drum for the Iraq invasion. (God, do you know how long you have to wait for tee time in Tikrit?)

But no. This young man has chosen to fight for golf students' rights across the country, and I salute him, choking back tears.

At least he hasn't gone into local labor organizing and working with people in the streets, like Obama. Obama can't even bowl!

Young Mr. Guiliani... keeping the world safe for young elitists. A hero in the making!

What about the other players who were cut ? Shouldn't this be handled as a class action suit ? Matter of fact it could be expanded to include all college studemts who didn't make the teams in their respective sports at whatever college. Might include high school students while we're at it. This could be huge. Battalions of lawyers could become rich before it's done.

Where does your ordinary college senior find the resources to lodge a 198 page lawsuit? Where did Andrew? Obviously a colorful group of dictators, torturers, and amoral corporate profiteers, or in other words, Dad's clients, chipped in (whether they know it or not).

This lawsuit is ludicrous. The reason college athletes get a grade (and don't get paid) is because going through the competitive situation of trying out for a team is supposed to teach life skills that help later in life.

The system is suppposed to work In the same way an honors class with an independent study component challenges regular students. A sports coach places obstacles to be overcome in front of his players, no matter how skilled they are and the players success or failure depends almost completely on making the effort to give the coach what he wants. This is different from most classes, but it's a skill you need at the top levels of any business. You can't take a job at Microsoft and then do things your own way instead of how Bill Gates wants them done.

To claim that a coach has a responsibility to not hurt a players chances of earning money in a sport, is not only ridiculous, but runs counter to the idea that a player is supposed to be challenged and that there is a reasonable chance of failure in his effort. That educational component is why contributions to athletic programs are tax deductible. If you want to have a minor league then pay the money for it, don't hide the whole thing as an educational experience and milk taxpayers to pay your bills.

Guliani is acting like a spoiled brat who goes off whining when he doesn't get his way.
