California Becomes First State To Ban Trans Fats

SACRAMENTO, Calif. — California on Friday became the first state to ban trans fats from restaurant food, following several cities and major fast-food chains in erasing the notorious artery-clogger from menus.

Gov. Arnold Schwarzenegger signed legislation that will ban restaurants and other retail food establishments from using oil, margarine and shortening containing trans fats.

In a statement, Schwarzenegger noted that consuming trans fat is linked to coronary heart disease.

"Today we are taking a strong step toward creating a healthier future for California," he said.

Violations could result in fines of $25 to $1,000. Food items sold in their manufacturers' sealed packaging would be exempt.

New York City, Philadelphia, Seattle, Baltimore and Montgomery County, Md., have ordinances banning trans fats, but California is the first state to adopt such a law covering restaurants, said Amy Winterfeld, a health policy analyst for the National Conference of State Legislatures.

California and Oregon already had laws banning trans fats in meals served at schools, she added.

The legislation signed by Schwarzenegger will take effect Jan. 1, 2010, for oil, shortening and margarine used in spreads or for frying. Restaurants could continue using trans fats to deep-fry yeast dough and in cake batter until Jan. 1, 2011.

Trans fats occur naturally in small amounts in meat and dairy products. Most trans fats are created when vegetable oil is treated with hydrogen to create baked and fried goods with a longer shelf life.

Stephen Joseph, a Tiburon attorney who was a consultant to New York City in developing its ban, said trans fat is a larger health risk than saturated fat because it reduces so-called good cholesterol.

A 2006 review of trans fat studies by the New England Journal of Medicine concluded there was a strong connection between consumption of trans fats and heart disease. Studies also have linked trans fats to diabetes, obesity, infertility in women and some types of cancer.

Trans fats are like cigarettes, with no safe level of consumption, said Jeffrey Luther, a Long Beach doctor who is president of the California Academy of Family Physicians.

He said the California law, "when it finally takes effect, will be a tremendous benefit."

The California Restaurant Association opposed the bill. Spokesman Daniel Conway said the federal Food and Drug Administration rather than individual states should be developing regulations on trans fat use.

He said, however, that the association has no plans to challenge the law, in part because restaurants already are phasing out trans fats to satisfy customers. Several major fast-food chains have announced that they have eliminated trans fats from their menus or intend to so do in the near future.

"We're confident that California restaurants can meet the mandates of the bill," Conway said.

I like it when the government thinks for me and keeps me safe from myself. As we all know politicians are greatly concerned about me and my health. I wish they would do more to further remove the burden of thought from me.

RightWingMarine, I get your point. I think it is much better to leave these decisions up to the giant food industry that clearly cares about us much more than that damn Socialist government. I am sure that my quadruple bypass seven years ago was just bad genetics. After all, healthy food is everywhere you shop.

Not only have I been serving but I still am. From your post I'm guessing you have not served or at least not in a war zone. In answer to your question I don't know if the equipment issued was MilSpec or not. I do know that I replaced or supplemented at my own expense every piece of gear that I was permitted to.

Health food is not everywhere I shop but I make plans for that. I wasn't born into the Marine Corps and didn't enlist until I was 25 but somehow I managed to eat and excercise in a manner that would leave me healthy enough to enlist and stay enlisted ever since. It may come as a shock to those who have never worn the uniform but once boot camp is over military people make their own decisions as to what to eat and how much excercise to get. If I choose to eat cheeseburgers everyday and never excercise I can do that but I will need to be prepared to face the consequences of my actions.

On all but one military base I have ever been on including bases in Japan and Kuwait there has been at least one fast food resturant but no health food resturants. (Burger King was building a resturant in Fallujah.) Everyone I know of was still able to excercise self-control and balance junk food and healthier fare. Why can't the people of CA do the same?

We're so glad to have this ban on Trans Fat take effect in California, although too bad it will take until 2010 for it to kick in. We also believe that this ought to be legislated nationally, especially in school lunch programs where type 2 diabetes has become an epidemic!

We filmed a wonderful episode on Ann Cooper, the school lunch lady for Berkeley Unified School Systems, where she has completely turned around the diets for school children from K-12, including teaching the kids where their food comes from and how to eat more veggies and fruits.

The results are startling! After feeding kids healthier school lunches (sans Trans Fat and processed foods), the rate of A.D.D and & A.D.H.D dropped like a rock, grades went through the roof (with better attention spans and focus), and they've seen a complete turn around in childhood obesity (the key factor that contributes to type 2 diabetes in kids).

No, they are Christians. The Law of Moses gave strict dietary guidelines, which included a strict prohibition against eating fat (Leviticus 3:17). Jesus said in Mark 7 that it doesn't matter what you eat (and even included the fatted calf in the parable of the prodigal son), and Peter repeated this in Acts 9. Paul called those who only eat vegetables "weak in the faith." Studies that show that fat is bad for you reinforce the Law of Moses and indicate that Jesus and Peter did not know what they were talking about, casting serious doubt on their claims of divine inspiration. Christians cannot allow Jesus to be proven wrong.

In Mark 7 Jesus also said that handwashing was unimportant. Being divine, didn't he know about bacteria?

Actually Snoop2's analysis is pretty much right on the money. People don't want to take responsibility for themselves, just like a baby.

There is a lot of conflicting evidence on nutrition, and the biggest problem appears to be that low fat diets are not all that healthy and don't solve many problems.

So CA will ban trans fats, but they won't ban tobacco which causes cancer and other fatal diseases, nor will they ban alcohol which also ruins lives and kills. To me, this seems like a token attempt to make the people think they're trying to do something about health issues.

And then many of you argue that since this is "good for you" it doesn't constitute a loss of freedom. But you'll get up on a podium and cry foul if they try to ban porn, or rail against the system for outlawing drugs.

There are some serious double standards here.

Huh? I'm not crying, surfer, and I'm aware that there are healthier ways of cooking. My comments were about how people are willing to give up some rights and fiercely defend others. If you don't want to eat garbage, don't. I hate it when government intrudes on our lives. But if they're gonna pass health laws there are things a lot more detrimental than fat that should be addressed first.

Thank you, California! People are so uneducated about the poison our food industry foists off on us. I have tried to talk friends out of eating margarine....the kind full of trans fatty acids, but they just love their parkay, while feeling proud they're avoiding real butter. As saturated as butter is , and as limited should be its use, these people are so WRONG. Now, Ca., can you do this with high fructose corn syrup, please?

This seems like an appropriate next step as the American Left gathers more power in controlling our lives.

Political Correctness has succeeded in stopping Americans from using certain words and phrases that "could offend someone." Freedom of Speech, RIP.

The teachers' unions will most likely succeed in taking freedom of choice away from parents who don't want to have to send their children to government schools. God forbid a parent having the ability to send their child to a school most appropriate to the child's needs. I guess choice is only good for abortions.

Smokers are no longer allowed to engage in their habit in most public places. Why don't you just make it illegal? Oh, that's right, you're getting TAX money from it, ha ha.

And next the government will tell us what we're allowed to eat. Keeping "bad" food from us should help, in the astonishing and immortal words of "The View" hostess Joy Behar, "victims of this kind of eating."

Gosh, what in the world would we do without a bunch of politicans and the government to run our lives for us?
