The AP reports:

LONDON -- Britain's top court refused Wednesday to stop the extradition to the U.S. of a British hacker accused of breaking into Pentagon and NASA computers --something he claims to have done while hunting for information on UFOs.

Gary McKinnon, 42, faces charges in the United States for what officials say were a series of cyber attacks that stole passwords, attacked military networks and wrought hundreds of thousands of dollars worth of computer damage.

The decision by Britain's House of Lords --comparable to U.S. supreme court judges-- was his last legal option in this country, but his lawyer said she would appeal his case to the European Court of Human Rights in Strasbourg, France.

"The consequences he faces if extradited are both disproportionate and intolerable and we will be making an immediate application to the European court to prevent his removal," Karen Todner said after McKinnon's appeal was rejected. "We believe that the British government declined to prosecute him to enable the U.S. government to make an example of him."

McKinnon's lawyers alleged that an American official had told him he would be forced to serve a lengthy sentence in the United States if he fought against his extradition, something they say amounted to an unlawful threat.

The five Law Lords were unanimous in deciding McKinnon had failed to prove his case.

McKinnon's supporters say they want him freed --or at least tried in Britain.

Prosecutors allege that McKinnon hacked into than 90 computer systems belonging to the U.S. Army, Navy, Air Force, Department of Defense and NASA between February 2001 and March 2002, causing $900,000 worth of damage.

[McKinnon's] lawyers, who claim he could be sent to Guantanamo Bay as a terrorist suspect, immediately announced they would appeal to the European Court to prevent him being taken from Britain.

They claim the case could have been brought in the UK but that the Government had chosen instead to stand back and let the US 'make an example of him'.

'Gary McKinnon is neither a terrorist nor a terrorist sympathiser. His case could have been properly dealt with by our own prosecuting authorities,' the lawyers said in a statement.

'Instead, we believe that the British Government declined to prosecute him to enable the US government to make an example of him. American officials involved in this case have stated that they want to see him "fry".

Is it okay to comment on grammer?
From the fourth paragraph from the end of your piece you have the following line:
"they would appeal to the European Court to prevent him being taken from Britain."
The "him" should be possessive, "his".
It's not only correct, it's clearer. "Being taken from Britain" is his fate not him's fate.

I bet they're only trying to extradite him AFTER he refused to become employed by the US military to hack into other country's systems as he clearly has the ability to do.

Aged 42, maybe he wanted to know the truth behind Roswell. Doesn't sound that ridiculous.

[Uncle Sam scrathing Union Jack's chin ... " What a fetch. Give it to me. That's it. Whose da' good boy? Whose da' good boy!"] McKinnon a terrorist? If the data sez he focused on UFO-related items, probably not. If not, then McKinnon should be tried in England's otherwise competent legal system as 1.) America has already cited that, given a chance, America will award a sentence greater than the alleged crime; and 2.) America appears to have a notorious gulag (or two or more less well known)whereas, as I've heard, England merely maintains prisons. The punishment should fit the crime.

Push this guy hard enough and he may end up in Iran or China teaching their military how to hack into U.S. systems. Better to hire him as an educator and set up shop for him to spy on the Chinese, Russians, etc., for the U.S.

Make an example of him? More likely to make it look like they are doing something since China isn't going to extradite any of theirs. UK governments, Labor or Tory, would send half of their citizens to jail if the US told them to.

I see the military's dilemma. Lock up/don't lock up. But no mind. They'll lock him up ("make an example of the boy") AND they'll extract the hacker secrets they desire from him.

Poor man. He's just sashaying around the military archives looking for data, not even terror motivated! God help us what the real DOD hackers are finding in there.

In a global sense, if this embarrassing incident doesn't underscore what a waste of taxpayer dollars the US military is, I don't know what does. Good luck young man. You probably should have steered clear of all things US on your UFO quest.

I don't know why there are so many people defending this twisted-looking punk - maybe Brits, expats, or conspiracy kooks and extremists are here. But, this guy allegedly caused $900,000 worth of damage by stealing American military secrets over the course of an entire year - continuing even after 9/11. Under the extradition treaty between Britain and the U.S., he should be tried in an American court, and if found guilty, punished accordingly. Anything else said here is irrelevant and misplaced.

Unless this guy was working for a foreign govt, which I don't think anyone alleges, he deserves 1-2 years. Decades of imprisonment is unjustified.

I think this guy should be hailed as a hero. After all, he did nothing wrong. The Govt has no clue that it was Al Qaeda that stole all the information that they claim he did.

Anyone ever wondered, why there is no extradition request with Pakistan for them to extradite Osama bin Laden to the USA to stand trial for the 9/11 attacks??

But a guy gets on the Library of Congress computer and looks up UFO data, and suddenly they are all over him and accuse him of terrorism and want him to be sent to GITMO???

What in the hell happened to our country??
