WASHINGTON — President Bush's top advisers are not immune from congressional subpoenas, a federal judge ruled Thursday in a long-running dispute between the two political branches.

Congressional Democrats called the ruling a ringing endorsement of the principle that nobody is above the law. They swiftly announced that the Bush officials who have defied their subpoenas, including Bush's former top adviser Karl Rove, must appear as part of a probe of whether the White House directed the firings of nine federal prosecutors. Democrats announced plans to open hearings at the height of election season.

The Bush administration was expected to appeal.

In his ruling, U.S. District Judge John Bates said there's no legal basis for Bush's argument and that his former legal counsel, Harriet Miers, must appear before Congress. If she wants to refuse to testify, he said, she must do so in person. The committee also has sought to force testimony from White House chief of staff Joshua Bolten.

"Harriet Miers is not immune from compelled congressional process; she is legally required to testify pursuant to a duly issued congressional subpoena," Bates wrote. He said that both Bolten and Miers must give Congress all nonprivileged documents related to the firings.

Bates, who was appointed to the bench by Bush, issued a 93-page opinion that strongly rejected the administration's legal arguments. He noted that the executive branch could not point to a single case in which courts held that White House aides were immune from congressional subpoenas.

"That simple yet critical fact bears repeating: the asserted absolute immunity claim here is entirely unsupported by existing case law," Bates wrote.

The ruling is a blow to the Bush administration's efforts to bolster the power of the executive branch at the expense of the legislative branch. Disputes over congressional subpoenas are normally resolved through political compromise, not through the court system. Had Bush prevailed, it would have dramatically weakened congressional authority in oversight investigations.

House Speaker Nancy Pelosi, D-Calif., left open the prospect of a full House vote on a contempt citation against Rove, who defied his subpoena to appear before the Judiciary Committee on July 10.

"It certainly strengthens our hand," she said of Bates' ruling. "This decision should send a clear signal to the Bush administration that it must cooperate fully with Congress and that former administration officials Harriet Miers and Karl Rove must testify before Congress."

That wasn't clear at all to the White House or Rove's attorney.

Bush administration lawyers were still considering whether to appeal, but there was no doubt what they thought of the ruling.

"We disagree with the district court's decision," White House spokeswoman Dana Perino said.

With only a few months left in Bush's presidency, there appeared to be no sense of urgency to come to a decision.

"I have not yet talked with anyone at the White House ... and don't expect that this matter will be finally resolved in the very near future," Rove attorney Robert Luskin said in an e-mail.

The House Judiciary Committee's senior Republican, Rep. Lamar Smith of Texas, said he was pleased the court ruled in Congress' favor, but he cautioned that an ongoing showdown in federal court could ultimately curtail Congress' powers, and he urged Democrats and the White House to strike an agreement.

"Unfortunately, today's victory may be short-lived," Smith said in a statement. "If the administration appeals the ruling, our congressional prerogatives will once again be put at risk."

The chairmen of the House and Senate Judiciary Committees quickly demanded that the White House officials subpoenaed appear before their panels.

Rep. John Conyers, D-Mich., chairman of the House Judiciary Committee, signaled that hearings would commence in September on the controversy that scandalized the Justice Department and led to the resignation of a longtime presidential confidant, Attorney General Alberto Gonzales.

"We look forward to the White House complying with this ruling and to scheduling future hearings with Ms. Miers and other witnesses who have relied on such claims," Conyers said in a statement. "We hope that the defendants will accept this decision and expect that we will receive relevant documents and call Ms. Miers to testify in September."

Senate Judiciary Committee Chairman Patrick Leahy, D-Vt., said, "I look forward to working with the White House and the Justice Department to coordinate the long overdue appearances."

Of all the juvenile and incompetent things Bush has done, the most egregious was putting forth Harriet Meirs, a third-rate lawyer who wrote love notes to Georgie that were not unlike those you find in a 9th grader's yearbook, as nomineee to the Supreme Court.

Harriet Meirs was just the hat being thrown into the room before the "real" candidate for the Supreme Court was put forward.
President Bush would have been shocked if Meirs had been successful.
His "real" Supreme Court nominee was slid in because another rejection would have made the Democrats look as if they were just rejecting everybody.
How could the next nominee have been rejected??

Nothing has changed. What's to stop Myers and Bolton from just not showing up? The DOJ is obviously not going to enforce the subpeonas. They are CERTAINLY not going to go out and arrest anyone. So what does this mean? It means nothing. As long as the DOJ's primary responsibility is to protect the White House like a mob lawyer protects his client, no one will testify. Sorry, but someone had to say it.

As a matter of law, you are correct. However, I do not have much faith that Miers, Bolton or Rove will suffer any significant consequences.

This was my question also.

OK, it sounds like there is some kind of procedure with this Writ of Mandamus. Cool. Except that probably it will be stayed until this issue is fully appealed.

And then the president might drag his heals on enforcing the order.

And then if by some miracle the issue has fully wound its way through the courts, the president would be forced to enforce the order, because even the Republicans would rise up against him if he didn't.

Miers shows up and then explains why she isn't going to say anything.

And now we start the whole game again. Trials, appeals, dragged out enforcement of decisions.

And if by some miracle this happens during Bush's term. Miers then moves to a different dodge and the whole process starts again.

The fact seems to be that the president is much less constrained by the rule of law than I had realized and the Bush administration has been very successful at proving that.

Which will only involve more delay. Yet more delay will result from the appeal to the Supreme Court. Why has the Bush administration been allowed to run out the clock like this? The firing of the US attorneys happened years ago. Unbelievable.

Dont get too excited. This Dubya appointed judge was is the one who dismissed Valerie Plame's suit against Cheney,Rove Libby and Armitage. This is the judge who dismissed the GAO's efforts to learn who was on Cheney's so called Energy Taskforce.­This is the judge who insisted that Kuchinich (and Congress) had no standing to dispute Bush's withdrawal from the ABM treaty without congressional approval. What's interesting is that in this case the forum shopping apparently didn't work out so well.

robotfog, they don't even have to go as far as pleading the Fifth, since they have so little respect for the rule of law that they just ignore the subpoenas.
For all the talk of Barack Obama being an "elitist", the arrogance demonstrated by the Bush Administration is mind-boggling.
Imagine if you were accused of a major crime, was subpoenaed and just laughed and carried on with your life??
YOU would be languishing in an airless dungeon.
Not so, the pasty-bodied Karl Rove and his minions.
They know that NOTHING will happen to them.
They KNOW that because there was so much sand thrown into any investigations of corruption, there is nothing that will stick to them.
At best, underlings, perhaps Ms. Goodling, will get a slap on the wrist and everyone else will escape any kind of prosecution.
The Bush Administration is gambling on the citizenry being so relieved that they are gone soon that the chances of all this going forward are slim to none.
These days the law is what President Bush says the law is.
It used to be satisfying to know that the United States was a haven of fairness and integrity. Now, they are the laughing stock of the rest of the world.
Who would have thought that it would only take eight years to dismantle all that has been built for almost 300 years??
The Bush Administration has given new meaning to the term "Banana Republic."

Judge Bates was appointed United States District Judge in December 2001. He graduated from Wesleyan University in 1968 and received a J.D. from the University of Maryland School of Law in 1976. From 1968 to 1971, he served in the United States Army, including a tour in Vietnam
