LOS ANGELES — A long-running lawsuit filed by Tim Burton's ex-girlfriend over his assets should be dismissed, an appeals court has ruled.

The California Court of Appeals issued a ruling on Wednesday ordering a lower court judge to grant a motion by Burton's attorneys for a summary judgment.

The move halts a trial scheduled for next week that would have focused on the couple's nearly decade-long relationship, which ended in 2001.

Burton's longtime girlfriend, Lisa Marie, sued the director in 2006. She claimed that she was cheated out of money that Burton had promised her during their relationship.

Douglas Bagby, who is representing Burton, praised the ruling and said the suit should have never been filed.

Lara Ott, an attorney representing Marie, said late Thursday that she plans to appeal the ruling. She said she expects the case to eventually go to trial.

In court documents, Burton claimed he paid Marie $5.5 million. She signed an agreement relinquishing any claims to future assets and should return the payout if she did not want to abide by the contract, Burton has argued.

Marie countered in court filings that she felt coerced to sign the contract and that Burton promised to take care of her "financial support and needs for the rest of her life."

In July, Los Angeles Superior Court Judge Teresa Sanchez-Gordon denied a motion by Burton's attorneys to have the case thrown out. She can argue why her decision should be upheld, but must file a response by mid-September.

Burton met Marie, a former Calvin Klein model, at a club in 1991. He cast her in several of his films, including "Ed Wood," "Mars Attacks" and a "Planet of the Apes" remake.

Burton met Helena Bonham Carter, whom he is currently dating, while filming "Planet of the Apes." The couple have two children.

Tim took a struggling actress...gave her 10 years of a "fame and fortune" lifestyle, then 5.5 million when they broke up the relationship. AND SHES STILL COMPLAINING?

His movies are creepy and unentertaining. My wife loves tim burton, but the world could do without his boring and incoherent flicks.

I would rather sleep with him then watch another one of his movies.

Be real people, Tim Burton would have to tie a bone around his neck to get his dog to play with him ...and this (fill in this blank) wants him to pony up large for "her charms" give me a break...

honey the free ride is over ...

So basically the relationship revolved around sex and money. All she really wanted was to get paid handsomely, and all he wanted was to get laid by a beautiful woman. What ever happened to romance?

Wait, I thought Kenneth Branagh left Emma Thompson for Helena Bonham Carter? She sure gets around, doesn't she? I'm getting a headache...

What kind of world do we live in where some chick can sue to get money from someone she wasn't even married to? Seriously, this is some jacked up stuff. It's bad enough when gold-diggers marry a guy for a few years and then take half his money, but a girlfriend? Come on! Not only should this suit have been immediately thrown out, she should be heavily fined for wasting the court's time. Unbelievable.

$5.5 million, invested getting a modest 10% return...that's $550,000.00 a year minus $175,000.00 for taxes leaves her with a "measley " $375,000.00. Not bad and she doesn't even have to get out of bed.

Those Batman movies were sure cheesy.

I have yet to see the "talent" that Mr. Burton has demonstrated in any way. If you see the dark knight you realize what a bunch of crap the other batman movies are. Edward scissorhands? please! and Charlie and the chocolate factory was unwatchable. Name one movie any one but a 15 YO Goth cutter would find entertaining.

Ed Wood, Big Fish, The Nightmare Before Christmas, shall I continue?

Pee Wee's Big Adventure. Beetlejuice. And half a dozen other great films. Not to mention, the original Batman, with Jack Nicholson as the Joker? Friggin' brilliant!! The series DID get campy, but Burton was long gone by the time that happened (Joel Schumacher directed the films with the "nippled" Batsuit).

That's what you get when you look at the world through those big rose colored glasses. Didn't you Hollywood guys learn anything from Lee Marvin.

The thing for me is that I believe every word Lisa Marie says. In her relationship with Burton, he did put her in a lot of movies while they were together (she was also in Burton's "Sleepy Hollow") so she can say that her ability to make a living acting was destroyed by the brake up of their long relationship. She obviously was dependant on Buron for guiding her career, but that situation was not Burton's fault so she should get nothing. In all likelyhood, LM was just that "trophy" girlfriend who actors like to dangle in front of cameras to make themselves look important. When a bigger trophy came along, LM was outta there.

Lisa Marie did not break up with Burton, she was fired.

Former Calvin Klein model? That's a novel credit of hers I've never heard before. From everything I've read, which is admittedly not much, the circumstances of their meeting has always been shrouded in secrecy, which always suggested to me that he met her at a stripper bar. Her behavior now that she's losing her looks is consistent with my theory.

I'll never understand why any woman believes somebody else should pay their way through life. I just don't get it. And I'm a woman.

Same here, two adults who decide to have sex. Their own business. But a person who says person A owes me money for having sex with me, That is just silly.

And they never seem to make the connection when someone calls them a polite term, prostitute. Doesn't she think she has the talent to make it as something other than some famous person's toy?

1) Burton promised to take care of her "financial support and needs for the rest of her life."

How many men promise this to their better half? Probably all of them.

2) In court documents, Burton claimed he paid Marie $5.5 million.

I think this more than meets the threshold of "financial support... for the rest of her life."

Seriously! How many million do you really need to live comfortably? Getting dumped sucks, but you gotta let it go and move on. Been there, done that.
