NEW YORK — A former presidential aide claims in a lawsuit that plot and marketing elements of the Kevin Costner and Kelsey Grammer movie "Swing Vote" were stolen from him.

Political commentator Bradley Blakeman, a former deputy assistant to President Bush for appointments and scheduling, said in the lawsuit filed Thursday that he gave a copyrighted screenplay entitled "Go November" to Grammer in 2006.

The lawsuit, filed in federal court on Long Island, claims Grammer agreed to develop the project and star as an incumbent Republican president but ended up portraying a similar role in "Swing Vote," which was released Aug. 1.

A spokesman for Grammer and his production company, both named in the lawsuit, dismissed the claims as frivolous.

"I am not sure why Kelsey was even named in this suit," spokesman Stan Rosenfield wrote in an e-mail. "He was an actor who signed on to the project AFTER the script was written."

Blakeman's lawsuit, however, claims the former "Cheers" and "Frasier" actor told him to consult a producer who later told him repeatedly that they were interviewing potential screenwriters and planned to go ahead with the project.

The lawsuit claims Blakeman's screenplay shared a basic premise with "Swing Vote," although it focused on an election hinging on multiple swing voters instead of one swing voter.

Blakeman claims "Swing Vote" incorporated other elements that he proposed, including: the timing of the film's release, the use of real-life newscasters as actors playing themselves, the use of dirty tricks by both major political parties, marketing strategies and other plot points.

"Essentially, except for the character names and the relationship developed between the main characters played by defendant Kevin Costner and his daughter, the entire concept of 'Swing Vote' ... was taken from the copyrighted work," Blakeman's lawsuit claims.

The Walt Disney Co. is named as a defendant in the suit, as is Walt Disney Motion Pictures Group Inc. and Disney division Touchstone Pictures, which distributed "Swing Vote." Costner and the writers of "Swing Vote" also are among those named.

Spokeswomen for Disney and for distributor Treehouse Films said they hadn't seen the lawsuit and wouldn't comment. A spokesman for Costner, who helped finance the movie, said the "Dances with Wolves" and "Field of Dreams" actor was on vacation and couldn't be reached.

Blakeman's lawsuit seeks unspecified damages.

Grammer was hospitalized in New York in late July after feeling faint, which Rosenfield said was possibly due to his heart medication. Grammer suffered a mild heart attack in late May.

I see this Blakeman pundit Repub shill on MSNBC all the frickin time. He is the most offensive, smug load of them all. How MSNBC can justify his input is beyond me. I feel like I need a shower when I just see this cretin. This loser is an outright liar everyday and there's a special place in hel! when he drops.

I can even stand Pat Buchanan on MSNBC, but whenever this slimeball comes on I change the channel. All he's ever contributed to any conversation is "up is down", "black is white", and other republican talking points. Based on his abysmal TV performances I can't believe he has the talent or imagination to come up with an idea of his own, let alone an actual movie script.

While the law must be upheld regardless how low esteem I hold one of the counterparties, I hope that absolute concrete proof is provided before any consideration is given to someone I consider to be as worthless as many posting here appear to agree. Like others, I believe Blakeman is a mouthpiece, not an adviser or consultant. He is not intelligent enough to advise anyone and is an irritating mouthpiece even at that. I consider that a failed mouthpiece.

Re: Buchanan. He is worse. He is part of the Republican "brain trust" and is a mouthpiece, thanks to MSNBC. He espouse all the despicable goals of the Republican party masters. MSNBC may think they need opposing voices for each argument or debate, but they risk losing the only folks who watch. The folks who think like Buchanan or Blakeman (if he does, indeed, think) already are watching FOX to learn what to think. These folks obviously cannot think for themselves.

The thing about Buchanan is that he can be outrageously over the top, and sometimes even throw a curve ball that makes me believe he's actually thinking about the issues sometimes. Not so with Blakeman. He gives boring predictability a bad name.

Ya can't copyright ideas, Bradley. I personally own two different alternate history novels from two different authors in which England enters the Civil War on the Confederate side, but the South still gets reabsorbed into the Union...and there was no corresponding lawsuit from the first author to do it against the second because the stories were quite divergent, too. So drop the suit, Blinky.

Now I understand why everytime I see this guy on MSNBC he is so cold and bitter... he has grudges... poor thing.. don't tango with the celebrity word, they are sharks and will eat you alive...

I can't stand him on Dan Abrams' show. He's so smarmy. Even Pat Buchanan, who has been pretty vile at times, has a sense of humor and can actually engage in debate. This guy's a lying condescending jackhole. I frequently change it when he's on because I find him so unpleasant.

I hate to say this, folks, but defendants have lost on less compelling evidence than this guy alleges. That being said, it never ceases to amaze me that the party which rails against trial lawyers is never hesitant to retain them.

Oh right, who'd of ever thought to write about "swing voters" if Brad hadn't penned it first. Yeah, and I bet he's got this idea for a film about how guys chase girls and try to bed them!! Well hey, I OWN that idea.

Blakeman's got a great set of intense eyes for the camera, he tracks in tight like the lead dog - never surrendering a point, and he is the age-old loyal advocate, starting fires, putting out fires, and standing in the hot spot and taking the crap and flinging it back double.

I hate the guy, but you gotta admit...

Actually I saw a similar movie on TV some time ago with the same premise; one swing voter in a town. Can't remember the whole thing but this is not a new idea and so I can't imagine that this sorry excuse for an ethical human being will win this one.
