NEW YORK — No criminal prosecutions are planned for former Justice Department officials accused of allowing politics to influence the hiring of prosecutors, immigration judges and other career government lawyers, Attorney General Michael Mukasey said Tuesday.

Mukasey used his sharpest words yet to criticize the senior leaders who took part in or failed to stop illegal hiring practices during the tenure of his predecessor, Alberto Gonzales.

But, he told delegates to the American Bar Association annual meeting, "Not every wrong, or even every violation of the law, is a crime. In this instance, the two joint reports found only violations of the civil service laws."

Other intrusions of Bush administration politics into department hirings and firings remain under investigation. Justice officials say the attorney general's remarks do not preclude criminal prosecutions if wrongdoing is found in the firing of nine U.S. attorneys in 2006 and the hiring practices in the department's civil rights division.

The political controversies prompted Gonzales' resignation last year.

Senate Judiciary Committee Chairman Patrick Leahy said Mukasey "seems intent on insulating this administration from accountability."

The Vermont Democrat said Mukasey's remarks "appear premature based on the facts and evidence that congressional investigators and the inspector general have uncovered so far" in the hiring scandal. "We must continue to pursue the truth and facts, and hold any wrongdoers accountable," Leahy said.

An internal investigation concluded last month that for nearly two years, top advisers to Gonzales discriminated against applicants for career jobs who weren't Republican or conservative loyalists.

The federal government makes a distinction between "career" and "political" appointees, and it's a violation of civil service laws and Justice Department policy to hire career employees on the basis of political affiliation or allegiance.

Yet Monica Goodling, who served as Gonzales' counselor and White House liaison, routinely asked career job applicants about politics, the report concluded.

Mukasey, who once was a federal judge in New York, said the Justice Department has taken steps under his leadership to prevent a recurrence of the hiring scandal.

"I have made repeatedly clear ... that it is neither permissible nor acceptable to consider political affiliations in the hiring of career department employees," Mukasey said.

If the problems were to recur, Mukasey said, he is confident department employees would speak up.

That did not happen during Gonzales' tenure, he said. Gonzales appeared unaware of the political hiring process outlined by Goodling and his then-chief of staff, Kyle Sampson, the report said.

"There was a failure of supervision by senior officials in the department. And there was a failure on the part of some employees to cry foul when they were aware, or should have been aware, of problems," Mukasey said.

Sen. Charles Schumer, D-N.Y., said more must be done to prevent political hiring at the agency. "Even if it is true they didn't commit a crime, it would be appropriate to make what they did a misdemeanor so that in the future, those who violate the civil service laws cannot escape unscathed," Schumer said in a statement.

Goodling's lawyer, John Dowd, declined comment when asked about Mukasey's speech.

The ABA has been at odds with the Bush administration on a range of issues, including treatment of prisoners suspected of terrorist ties and the need for a federal law to shield reporters from subpoenas.

Mukasey said that on the issue of politics in his department, there was no disagreement with the lawyers' group.

"Professionalism is alive and well at the Justice Department," he said.

Some candidates for career Justice Department jobs who were excluded because of politics could be invited to apply for new positions, Mukasey said.

He also ruled out firing or reassigning those who were hired under the now-discarded evaluation process.

"Two wrongs do not make a right," he said. "People who were hired in an improper way didn't themselves do anything wrong."

Could the Justice Dept please tell me which which crimes and wrongs are not crimes and wrongs so I can do those crimes and wrongs and not lose sleep over them? If the employees that were hired under illegal circumstances are allowed to stay then we are "packing" the Justice Dept. with a certain idiology. The employees need to be fired and then they can reapply for their jobs. They can be fired since the employment contract was obtained illegally.

Not all violations of law are crimes, although all crimes are violations of law.

Unfortunately, this point is apparently too subtle for far too many HuffPo posters and that fact makes me fear for the future of the rule of law in the US.

Rather than learning what the law *actually is or says* and following it (or working to change it if they don't like what it says), too many HuffPo posters talk as if their uninformed and very fundamental misunderstandings were the law.

Number 1 states, "and that is legally prohibited". Doesn't that mean that if someone violates federal hiring laws, they are, in fact, committing a CRIME?????

Nope, not necessarily. Not every violation of law is a crime, even if every crime is a violation of law. Put another way, crimes are a subset of all law violations. (Also, when it comes to legal technicalities, you'd be wise to leave the general dictionaries -- especially online ones -- behind and consult more authoritative texts.)

To be a crime, the law in question has to be part of a criminal code or it must: 1) make specifically state that its violation shall be considered a crime and specify the degree (typically a misdemeanor or felony); and 2) specify that there is a criminal penalty for its violation. Some states' statutes provide that if no loss of liberty can be imposed as the penalty for a violation of law, then such violation is not a crime.

Most federal crimes are codified in Title 18 of the U.S. Code. So, if the federal statute in question isn't in 18 USC or it doesn't identify its violation as a crime and specify punishment, then acting contrary to the federal law in question would be only a civil violation and not a criminal violation.

Of course- we should also take into consideration the strong evidence of 'conspiracy' to violate the 'intent' or 'spirit' of the law, which is a seperate (and some may argue, more serious) crime.

Prisons are full of non-violent, good people with great hearts and families and socially beneficial talents who sometimes find it hard to walk the razor sharp line drawn by an unrealistic, militarized and overly obedient society addicted to the voyeur part of punishment. We punish trespassers with state-condoned rape and brutal assaults because they get themselves high occasionally, without harming others, to escape the pressures of a modern society that's anything but fair and just. The irony of all this is astounding.

We are continually bombarded with pro-police-state propaganda, intellectually misleading and dishonest "documentaries" and entertainment reality shows that celebrate those paid by the state to track and punish those less fortunate ("Law and Order", "Worlds Scariest..." on 5 stations any time of the day, A&E "special" reports, "Dog the Bounty Hunter", "CSI", ) And the Orwellian, American form of "justice" is portrayed as black-and-white; "If he didn't have the weed, he wouldn't be doing 5 years with rapists!"

When it comes to treason, war crimes, crimes against the poor, commercial poisoning, market slavery, human trafficking, mass murder, torture - this is all part of "American Empire" and we are encouraged to look away, ignore it as long as that person is powerful and doesn't have a few beers and drive, look at porn or enjoy a harmless joint every few days.

America is a very, very sick empire.

Why ever happened to all the investigations of the past most recent Waxman promising to take down Rove, Conyers promising hard investigations of the bush admininstration, how about Spying./phone tapping/ etc. nothing ever happens these guys are all of the same mind and take care of each other, just throw the american people a bone and send some poor slob way down on the totem pole to jail once in a while and we'll be happy. Oh yeah lets vote them all back in come november so we can complain to each other on worthless blogs some more.

This is all just a red herring, a worthless distraction to make them look like a bunch of incompetent school kids who weren't guilty of anything but misguided stupidity. Like not hiring Democrats was the worse thing they did !!!

Seriously, who cares about all this if you understand that the real worse thing they did was to filter the correspondence, phone calls and emails of individual citizens trying to reach the Inspector General of the Justice Department to keep it from physically receiving complaints from these citizens about wrongdoings of US Attorneys around the country.

Anyone they identified as a threat was immediately cut off from all access to the Inspector General.

I know that 3 of my complaints which I sent to the Inspector General never were received. I was left with no one directly to complain about it to because my congressman was a Republican, but I tried complaining about it to other congressmen in my state (who didn't do anything about it because it wasn't their responsibility and they didn't want to rock the boat anyway).

This is all like yelling at a mass murderer for jay walking, and then letting him go with a warning. Yeah, they really showed that mass murderer who is in charge ! He won't be jay walking anytime soon !

This is for all those capable and ethical men and women in this country who have been kept out of leadership positions due to similar discrimination practiced by employers. One can only wonder how many Republican run agencies, companies and clinics have engaged in incestous hiring practices, hiring only those with similar political affiliations. Republicans have shown us that they are highly tribal and incestous and why would their behavior in the private sphere be any different.

We have seen the damage that can be done when mediocre, incompetent, but loyal men and women are placed in key govt. positions. There is Brownie and Gonzales for starters; Bush tried to get Meyers in there, which would have been disastrous.

War is peace. This economy is fine. We are greeted wherever we go (invade) as lliberators. Civil liberties enable terrorists. Bush is the "moral" choice and more of a man (in his costume shop military flight suit) than genuine combat veterans like Kerry. God favors aggression, war and torture. Sex is evil, unless practiced by a right winger. (then, anything goes baby...bring on the diapers!) Dissent is crime...but political pandering/discrimination is not.
