ANCHORAGE, Alaska — Gov. Sarah Palin is unlikely to speak with an independent counsel hired by Alaska lawmakers to review the firing of her public safety commissioner, a spokesman for Republican presidential candidate John McCain said Monday.

Spokesman Ed O'Callaghan said he has not spoken with Palin, but she was "unlikely to cooperate" with the inquiry "as long as it remains tainted."

Democrats charged that the McCain campaign was trying to stall the investigation.

"The partisan presidential campaign of McCain/Palin has interfered and is picking partisan targets to smear in order to make this investigation look like something it isn't," said Patti Higgins, chairwoman of the Alaska Democratic Party. "Rather than cooperating with the investigation, the Republican presidential campaign is doing everything it can to stall and smear."

O'Callaghan also said he did not know whether Palin's husband, Todd, would challenge a subpoena issued Friday to compel his cooperation. Thomas Van Flein, the Palins' lawyer, who has accepted service of the subpoena, did not return messages seeking comment. The governor herself has not been subpoenaed, but the Legislature's investigator, Steve Branchflower, has said he hopes to speak with her.

Palin and her husband campaigned Monday in Colorado and Ohio. Palin also planned appearances Tuesday in Ohio.

McCain's campaign insists the investigation into the firing of Public Safety Commissioner Walt Monegan has been hijacked by Democrats.

Palin initially said she welcomed the inquiry. But after she became McCain's running mate on Aug. 29 her lawyer sought to have the three-member state Personnel Board take over the investigation, alleging that public statements by the chairman of the Senate Judiciary Committee, Democratic state Sen. Hollis French, indicated the probe was politically motivated.

French said Sept. 2 that the results of the investigation could constitute an "October surprise" for the McCain campaign. He later apologized for the remark, but Palin's lawyer has said the biased impression it created can't be undone.

The McCain campaign says it can prove Monegan was fired in July because of insubordination on budget issues, and not because he refused to fire a state trooper who went through a nasty divorce from Palin's sister.

To that end, the campaign released a series of e-mails detailing the frustration several Palin administration officials experienced in dealing with Monegan. The "last straw," the campaign said, was a trip Monegan planned to Washington in July to seek federal money for investigating and prosecuting sexual assault cases.

In a July 7 e-mail, John Katz, the governor's special counsel, noted two problems with the trip: the governor hadn't agreed the money should be sought, and the request "is out of sequence with our other appropriations requests and could put a strain on the evolving relationship between the Governor and Sen. Stevens."

Monegan was fired four days later.

In the weeks since, it has emerged that the Palins and her staff repeatedly had contacted Monegan expressing their dismay at the continued employment of Trooper Mike Wooten, who divorced Palin's sister in 2005. The following year, Wooten was suspended for five days based on complaints filed by the Palins, including that he drank in his patrol car, used a Taser on his 10-year-old stepson and illegally shot a moose.

A bipartisan panel of the Legislature voted unanimously to authorize an investigation into the circumstances of Monegan's firing.

In an effort to move the investigation into the Personnel Board's court, Van Flein filed a complaint there. But on Monday, he asked the board to dismiss the matter, citing the e-mails about budget issues as proving the real reason for Monegan's dismissal.

"The Governor decided to replace Mr. Monegan based on his refusal to execute her administration's policy on fiscal and budget matters, a refusal that between late 2007 and the middle of 2008 blossomed into outright insubordination."

Monegan's attorney said he had no immediate comment.

Also made clear in the e-mails is that some Palin staffers believed Monegan worked outside normal channels in making budget requests, in one case writing a letter to the governor in support of a funding for a project she had already vetoed.

Let be perfectly clear, if this was BO who would have selected a VP who was currently under major state an ethic investigation, the GOP would have be singing on this from day one to Nov 4th, How is the he--can the Dems he accused of spearheading this when in fact the state committee who decided to call this investigation was made up of 3 state Republicans and 2 Dems. Therefore, there was one Republican who voted with Dems for an investigation.

This is a crock of bull

Of course she won't meet with the panel. And some of the pundits repeated the Republican position that dems have contaminated the process without mentioning it was her suggestion that an investigation take place and her state rep from Wasilla that cast the lone Republican voted to issue subpoenas etc...

How about this for a Republican strategy. John McCain and his top advisors probably realize Sarah Palin will eventually be forced out of the Vice Presidency because of her mounting problems in Alaska. Their main concern is to use her to get John McCain elected to the white house. Once there they will quickly release her as someone who is hurting the party with her personal problems. At that time it will be too late for the Republican base to object to John McCain nominating his good friend Joe
Lieberman for Vice President. However, Joe might have difficulty getting the approval of a Democratic
controlled congress.

So justice can never be blind, I guess. There's always an ulterior motive in the prosecution of the case itself. God forbid we keep focused on the actual incident and the potential abuses related to it by the Governor and her husband and her staff.

It's amazing we still teach how this country is based on the rule of law. We might as well teach kids this country is based on how you MANIPULATE the laws.

Whatever the outcome of the investigation, I would give this only minor weight in my voting decision, I know there's the abuse of power issue, but for the most part I would consider it a personal matter. The fact that the guy says he was 'pressured' but not directly asked - no one likes that but I'm sure it goes on all the time.

What concerns me more is the 'refusal to cooperate'. Talk about elitist, how many ordinary citizens get to 'refuse to cooperate' with an investigation? Didn't Rove just do that?

These people don't respect the process, further evidenced at the sneering that Obama wants to 'read suspects their rights'. They really don't seem to beleive in the American system.

Oh well, wasn't planning on voting for them anyway.

that's exactly what i was thinking! ok so the next time i have to go to traffic court i'm just going to send a memo to the press stating that i'm not cooperating with the investigation and tell them to throw out the caset. sorry... criminal investigations are not my thing.

Chief Monegan was raised in bush Alaska, in a town called Nyac, by his maternal grandparents. At that time, Nyac was a gold mining community with a population of 54 people and a one room school house. After attending one year of college at Alaska Methodist University, Walt enlisted in the Marine Corps in 1970.

In January of 1974, Walt was hired as a patrolman with the Anchorage Police Department. Since that time he has worked in every division and almost every unit of the Department including Internal Affairs, Crime Prevention, Communications, and Detectives, but always enjoyed his time on Patrol which he returned to frequently. Walt has attended Northwestern University Traffic Institute Police School of Staff and Command and University of Louisville National Crime Prevention Institute.

McCain campaign spokeswoman Meg Stapleton denigrated Monegan at a news conference Monday, accusing the three-decade cop of "insubordination," "obstructionist conduct" and a "brazen refusal" to follow proper channels for requesting money.

Its sad that McCain is trying to tear down a Marine who has already been smeared and fired by Palin. When is the media going to get a pair of balls and call BS on McCain. Law enforcement across the nation should know who is backstabbing you.

McCain keeps talking about honor, service to one's nation and all the accoutrements. Where is his honor when his campaign is smearing another American who had served in the Marines just like he did. Oh! I got it. Mr. Monegan was not a POW. How hypocritical?

So it has been established that if you are a Republican politician running for the highest office in this country, you can be lauded for fighting corruption; but since you are a crime fighter that does not apply to you and you simply do not have to cooperate. And as a voter and an American subject to the laws of this Country, this should be okay...why? I don't want you in office if you are bold enough to show me that the law does not apply to you, even before you get there.

This is a typical McCain camp tactic. She was for cooperating before the McCain camp really sat down with her and told her what she was going to do. The McCain camp of course is going to say it's tained and it's Obama's fault. When have they ever accepted responsibility for anything?

The way I see it is that McCain and his advisors are directing her and telling her what to do not her. This leads me to believe that she doesnt have a mind of her own with this issue. How is she going to take on the "good ol boys" if she can't even make this decision on her own?
