Senator Christopher Dodd opened today's Senate Banking Committee hearing by offering deep concern over the bailout package proposal that's been put forth by U.S. Treasury Secretary Henry Paulson. During his opening remarks, Dodd criticized the underlying thinking behind the proposal, pointing out its lack of attention to taxpayers, its allowance of "golden parachutes" for CEOs, and its dearth of detail. Most importantly, however, Dodd squarely aimed a shot at Section 8 of the proposal, which stipulates that, under the plan, the Secretary's actions would be "non-reviewable and committed to agency discretion, and may not be reviewed by any court of law or any administrative agency."

"After reading this proposal," said Dodd, "I can only conclude it is not just our economy that is at risk but our Constitution as well."

DODD: Barely 72 hours ago, Secretary Paulson presented a proposal that he believes, and others do as well, is urgently needed to protect our economy. This proposal is stunning and unprecedented in scope and lack of detail, I might add. It would allow the Secretary of the Treasury to intervene in our economy by purchasing at least $700 billion of toxic assets. It would allow the Secretary to hold on to those assets for years and to pay millions of dollars to hand-pick firms to manage those assets. It would do nothing in my view, to help a single family save a home, at least not upfront. It would do nothing to stop even a single CEO from dumping billions of dollars of toxic assets on the backs of American taxpayers. While at the same time do nothing to stop the very authors of this calamity to walk away with bonuses and golden parachutes worth millions of dollars. And it would allow the Secretary and his successors to act with absolute impunity without review of any agency or court of law. After reading this proposal, I can only conclude it is not just our economy that is at risk but our Constitution as well.


Nevertheless, in our efforts to restore financial security to American families and stability to our markets this banking committee has a responsibility to examine this proposal carefully and in a timely manner. In my view, any plan to address this crisis must embody three principles. First, American taxpayers must have some assurance that their hard-earned money is being used correctly and responsibly. Second, we must put in place proper oversight so the executors of this plan are accountable and their actions are transparent. Finally, we must address the root cause of this crisis by putting an end to the rising number of foreclosures sweeping our nation. Longer term, it is clear our current economic circumstances demand we rethink, reform, and modernize supervision of the financial services industry. Certain basic principles should form the foundation for reform. We need a leader in the White House that will ensure regulators are strong cops on the beat and do not turn a blind eye to reckless lending practices. We need to remove incentives for regulators to compete against each other for bank and thrift clients by weakening regulation. We need to ensure all institutions that pose a risk to our financial system and taxpayers are carefully and sensibly supervised. We need to accept the premise that consumer protection and economic growth are not in conflict with one another but inextricably linked. If we learn nothing else from this crisis, it is that the failure to protect consumers can cause the collapse of our largest financial institutions, loss of hundreds of thousands of jobs, and the draining of hundreds of billions of dollars of wealth from hard-working Americans.

BE AWARE: Former Republican House Speaker Newt Gingrich Is At It Again

Yesterday, Gingrich laid out 18 policy prescriptions for Congress to take in order to "return to a Reagan-Thatcher policy of economic growth through fundamental reforms." In the midst of this economic crisis, he actually called for the repeal of the Sarbanes-Oxley Act, which would lead to further deregulation of the financial industry. Gingrich also called for reforming the education system to allow "competition" (AKA school vouchers), strengthening border enforcement, creating an immigrant guestworker program, and his signature move: allowing offshore drilling.

It would be a grave mistake to dismiss this conservative wish list for how to “solve” the financial crisis. Don’t forget that Newt Gingrich's 527 organization, American Solutions for Winning the Future, is still riding the wave of success from its offshore drilling campaign, "Drill Here, Drill Now!" As Naomi Klein wrote in her last Nation column, just four months ago, offshore drilling "was not even on the radar" and now the US House of Representatives has passed legislation. In fact, Gingrich is holding an event this Saturday, September 27 that will be broadcast on satellite television to shore up public support for these controversial policies. So friends, get ready! We must start putting forth our own alternative proposals and not shy away from a tough debate.

I watched the entire hearing at work and heard Dodd bring up the Section 8 clause in the proposal with regards to no oversight or accountability to anyone including the courts...etc...etc.

he said he was extremely concerned about that provision.

good job...Republican Shelby from Alabama and a Senator from Montana (Dem) were spot on.

I know this whole bailout is not funny, not funny at all. However I do have to laugh like he!! when I see republicans calling for "oversight."

Are these guys even real?

They went on a spending for for over 6 years, and never once performed their Contitutional DUTY of congressional oversight.

GW Bush never vetoed a single spending bill of their. His first Veto was about stem cell research. When the democrats took over, Bush went to the vault and withdrew his oversight pen. He vetoed heath care for little kids and Dana Perino called it victory for the Whitehouse.

Yes, no heath care for kids, but a trillion for his super-rich cronies!

If we don't vote these people out, we have given up on the dream that was once known as America.

Now what's amazing is that we couldn't come up with an extra 5 billion for the CHIPs insurance program, but all of a sudden we can come up with 700 billion! We don't need to worry about uninsured kids, but we've gotta protect these Wall St. babies? I don't think so. The workers on Wall St. may lose out, but they were going to anyway. The rich fat cats are the only ones that are going to make out like bandits if this thing passes.

This is the BIG CLUE right in your face! Urgency to act would have put us in deep shigidy. Thank you God for Mr. Dodd and other members of congress who have good old fashion common sense not to be bamboozled! Enough already. Why such stipulations if your intentions to do right are honorable? These are the foxes that was watching the hen house and made up the rules how the watch would be. Don't do it Congress! Use this money to help tax payers directly. Why can't Congress manage the tax payers money and not give it to Paulson to manage? Don't do it!!!!! Where is the money coming from if we're in deficit? DON'T DO IT! Don't let them take us for a ride!!!!!!!!!!!

How in the bloody hell is this proposal being written by a former Golden Sachs guy; the same guy who when nominated to his current office had questionable motivations for his “financial” decisions? The same man who was “supposedly” handling the problem to begin with. Seriously, Golden Sachs and Morgan Stanley will be the biggest beneficiaries of this deal. WTF!!!!

They don’t even try to conceal the “good ol boys” club agenda anymore, they just appoint this dude (qualified but definitely out to protect his interest and that of his friends), to handle this colossal financial screw up and then try to write in a stipulation that all his decision cannot be investigated! Our Constitution is not at risk, it has been dismissed!

Look back at the nineties when all the crooks made sure Fanne and Freddie had to give just about anyone a home loan so they could show more assests on the books and therefore let every one think the bosses were doing such good work that they were entitled to 20 million a year salaries. You guys will never learn. 70% of congress are lawyers. Now you want to put 2 more lawyers in power. Was there ever a bigger conflict of interest then lawyers making laws that benefit lawyers. We are just sheep on their farms.

In order to do that, you save for it. And then you truly discern what it is you really need. No more of this quick impulsive purchasing and 29.9% interest. Amen to that. The day I got out of debt was one of the greatest days of my life. There's nothing more liberating than the feeling of not owing anyone ANYTHING... not a student loan company, not a credit card company, not an auto loan company, NOBODY.

I agree completely. Most people are mindlessly buying up crap that they don't even need, which is broken or obselete before it's even paid for.

Do it the old fashioned way. Earn it!

I finally paid off our credit cards of $80,000. (of medical bills as my husband was turned down for health insurance for high blood pressure) at some exorbinant % rate.. Hallejeuh!

And not only just this be done on an individual basis but the whole country and gov needs to take the lead by exhibiting fiscal responsibiity. No more borrowing from the U.S. Treasury or China.

Take this money , this 700 billion and put it into health care, education and renewable energy. This is what most taxpayers want their money spent. On them, not the fat cats golden parachutes!
