In typical news-dump fashion, the McCain campaign put out the last two years of Sarah Palin's tax returns late Friday afternoon.

The information contained a few interesting revelations in what was, otherwise, a fairly mundane filing. Palin, it appears, did not pay taxes on the more than $60,000 of travel reimbursements that she and her family members reportedly billed the state during her 18 months as governor. There is a fairly wonky debate over whether she should have been charged for these trips or whether it was accounted for in her salary. John Bogdanski, a tax professor at the Lewis and Clark Law School, told the Huffington Post's Seth Colter Walls that they did qualify as taxable income.

It does not appear that such deductions would have been allowable for any amounts attributable to travel by her husband and children. Section 274(m)(3) of the Internal Revenue Code strictly forbids deductions for bringing spouses and dependents along on business travel unless the spouses and dependents (a) are employees of the taxpayer (here, the taxpayer is the governor), (b) are traveling for a bona fide business purpose, and (c) would otherwise be entitled to deduct the travel on their own tax returns. Unless Palin's spouse and kids are also her employees and she can show that they were away on their own businesses, their expenses would not be deductible by the governor. And therefore she cannot exclude from income any per diems attributable to any of them. (By the way, since she's the employee, the income would be required to be reported on her own return, not her kids'.)

Overall, the Palins reported a gross income of $127,869 in 2006, and paid taxes amounting to $11,944 (an effective rate of 9.3 percent). In 2007, the family reported earning a gross income of $166,080 ($107,987.00 of which came from Gov. Palin) and paid taxes totaling $24,738, for a rate of 14.9 percent.

But there is some discrepancy with the latter number. According to an accompanying 2007 personal financial disclosure report, Palin's "income" as governor of Alaska was $196,531.50, well above the $107,987.00 that was noted on her W2 form from that same year. An email was sent to the McCain campaign for clarification. And this story will be updated should aides reply.

Palin's personal financial disclosure form also showed a moderate amount of assets. The family has ownership or interest in several properties, including tracts on several Alaska fishing spots. And Todd made between $50,000 and $100,000 from British Petroleum's retirement plan.

My comment was not meant to compare them to others from different faiths. While they may have given more than Biden they are far from tithing as their own faith requires.

Generally, amounts employers pay employees to reimburse them for substantiated business expenses are not subject to income tax or employment tax. For reimbursements for expenses for meals and other incidentals associated with business travel, employees get this exclusion for reimbursements for each day of travel up to the federal per diem rates(Wasilla $232 and 169) without having to actually substantiate the amounts of the expenses."

Basically, if you're not paid over the federal rate(which she wasn't) you don't have to pay taxes on it.

One of the questions is if she claimed travel expenses for her family. if she did, then it should have been picked up as income. General rule, it is taxable.

No where in this general guide for employers, does it mention the situation of taking per diem expenses for non employees. That is what the above article is about.

And how exactly is residing in your home considered "business travel"? I'd like to see the definition of "business travel". Regardless of whether her official duty station was Juneau. No matter. This is a sticking point.

Also, the WaPo (i think) did a story on the airfare for children and spouses issue in early September. I believe the prior Governor also did the same thing, and it was a big scandal at the time. And, policy was set down. They said no travel for kids/spouse.

Also, where are the gifts? As I recall one of the gifts was travel expenses for one of the kids. Where is that income?

Also, where is the personal use of the "mayor mobile"?

I read where Todd Palin had thousands of dollars from sponsors (oil companies, etc) for his racing vechiles. Did he declare this money and if he received it, he should get no deductions for repairs,etc. on these vehicles.
Also, he received thousands of dollars in top prize money for races, did he include this in his income?

It would be my guess it was listed on a Schedule C as a business. So, he could list the income from sponsers/prizes there, and expense his equipment, gasoline, etc. But, I think you have a timeframe to make a profit. If no profit, then you can only show a loss up to your income. I mean, you can only zero it out, and not claim a loss.

He did indeed declare "winnings," but apparently claimed a net loss on this "business" which is in reality a hobby.

But hey, if the IRS determines this really a business, look for an explosion in "independent football analysts" businesses, which deduct the cost of season tickets, and "professional poker machine players" who deduct their bar tabs.

I still wonder how it is that Palin's husband at his youthful age, qualified to receive a retirement pension from BP at such a high rate of 50 to 100K? Was he an executive with BP? How long was he employed by them? Something sounds real fishy about this. I thought he owned a mom and pop ski, snowmobile and ATV rental business for quite a few years. I was of the understanding that Pension plans started paying any time past your 55th birthday?

He seems to be a sort of Alaskan Renaissance Man--he's a commercial fisherman, North Slope oil worker, which gives him those union creds Palin has so often touted, (she's never once mentioned any retired status) and, of course, the world champion snow machine ("up there in Alaska we call 'em snow machines") and they were small business people who went belly-up in the snow machine business there in Alaska also. It's really quite a resume for "first Dude" don'tcha think. And the most surprising fact of all which is mostly overlooked now, is that McCain evidently chose her on the sayso of a 22 year old Colorado blogger, who still lived with his mother. A truly remarkable story as it turns out. I can't wait to see the explosive climax.

Yes - my question as well. That's the kind of "pension" you get after years and years if you've worked for a corporation. How could he be Joe Sixpack AND a well-reimbursed corporate executive at the same time??? He's too YOUNG, as noted by CharlesJ, and this stinks.

The very fact Gov. Palin would DREAM of dinging the TAXPAYERS a per diem for her FAMILY is my issue, not just whether she paid taxes on it. If she demanded and GOT per diem for her kids and husband, that is a scandal of HUGE proportions since they are not employees of the state. That alone demands an investigation! And I've heard that after she sold the state airplane at a loss (the famous "I put it on Ebay" plane) she now demands she AND her family fly first class. Well - she should be paying their fares, not the taxpayers of Alaska. Outrageous if she's getting away with this!!!!!!

I wondered about that myself. I was a teacher for 18 years and just retired. My retirement sum each month is $1100 before taxes which makes my income for the year $13,200 before taxes (which I have to pay). I was 64 when I retired, sure wish I could rake in $50-100 k from my career.

It must be good to be Governor! It must be even better to be on the GOP ticket. Seems you can get away with not co-operating in an investigation by simply ignoring a supeona, you can have high powered attorney attempt to thwart the judicial process, you can have discrepancies on your taxes and with a wink and a prayer, you can avoid answering to the public.

Your kids must love it too. They don't have to go to school. This must save the Palins' a fortune - the two eldest kids are not going to get any kind of education beyond high-school, so no college money needed there and the two younger ones that should be in school are being hauled around the country as props so with all the school that they are missing and the message that their parents are sending them about the importance of education, likely means they won't ever get the grades needed for post secondary education.

And those taxpayers - they must love to compensate an elected official that takes the job of running the state but doesn't actually move to the where the job is located and then charges the state for it. If by some chance (if on November 4th, hell actually does freeze over) Palin is the VP, will she refuse to move from Wasilla to Washington and then charge the US government so she can stay in her own home?

And no one is looking at Bristol, just her mother. Sarah is slavering to be Veep, and that involves full public disclosure we all deserve. If she has violated law as governor, why should we look the other way??? We don't need MORE self-interested crooks in the White House than who've been there the past 8 years. With due respect to Professor Bogdanski, I am sure that the Alaskan treasury department that prepare the appropriate tax reporting documents (w-2 and any Form 1099-Misc) knows what is correct about the "per diems" paid to the Governor. I'll bet the professor has not a clue to the total facts of this situation and is shooting from the hip. Anyone can come to their conclusion with partial facts. Tax matters should never be claimed to be incorrect until the professor knows the entire set of circumatances, facts and conditions. I'll bet the professor is outright WRONG. I am a tax practitioner and can come to many different conclusions with partial facts and circumstances.

With due respect taxfrank, it isn't a question of what the Alaskan treasury reported, but what the Palins did with the information provided. The Anchorage Daily News reported that the Palins used their Wasilla address on their tax forms making that their "Tax home". Although the capital of Alaska is Juneau Palin worked out of the Anchorage office most of the times. Wasilla is 30 miles form Anchorage.

Well, it maybe a conflict of laws. The state of Alaska normative practiceregrdaing per diems for family (non-employees) . Just because the state will pay the perdiems doesn't mean they are tax exempt, now does it!

This morning I woke to a brand new day and it hit me that I had not thought too far into the Palin family thing. I know I wasn't happy with the Clinton's potentially being co-presidents or co VP's as it appeared like the two for one thing and that isn't the US of A way of doing things. But I looked at the tax thing and not too deep before I realized what was there for all to see, they have been running Alaska together. That's why he's been cc'd and been part of the travel and all of the perks as she hasn't been just herself doing the job. If she was then why was he joined at the hip and all involved in business no other spouse would be? Any other governor whose wife has the same level of involvement would have been backed into a corner with questions by those who elected him. The "little woman" running the state for you? Why else does she need to be at home and doing all of the per diem? Is no one else thinking like I am? How would this affect the VP job? Would the "Todd and I" be a factor all of the time like now?

Google "Shadow Governor" and you'll get many hits for Todd Palin. This has been an issue with many Alaskans since Palin entered office. He calls and holds meeting at the governor's office in Anchorage, lobbyings the senate and the house, does recon work for potential state projects and sits in on other meetings that the Governor has.... he must by one good ....??? what's that word I'm lookin for?

Call it sour grapes(or something stronger), but I'd still like to know why Cindy McCain didn't have to disclose her financials, but 4 yrs ago Teresa Heinz Kerry did....the Ring-Wing nutso's punished the Heinz company by boycotting their products, yet (a) charges were false and (b) the Heinz company had nothing to do with the Kerry campaign. But I do hope Jack Cafferty or someone brings the tax/per diem issue to light in the so called 'main stream media'.

What surprises me about the Palins' tax records is the small percentage of their income that was given to charities. As born again Christians they should be giving a tithe of their gross income to the Lord. The tithes can be given to their church or to charitable organizations of their choosing. The reason that God requires Christians to do this is to teach us to always put God first. It is a way to honor God as the source of all we have. Not all churchs believe in tithing but pentecostal churchs do and I believe this is the kind of church the Palins are affiliated with. These records reveal to me that she is not as full of faith as she would like others to believe.
