ANCHORAGE, Alaska — Alaska Gov. Sarah Palin's practice of charging the state when she stays in her home must be reviewed to determine if she should pay taxes on the payments, state Finance Director Kim Garnero said Tuesday.

Palin, the Republican vice presidential nominee, released two years' worth of tax returns last week that did not list the per diem payments she received since becoming Alaska governor in December 2006. She collected nearly $17,000 during that period for 312 nights spent in her Wasilla home about an hour's drive from Anchorage, according to state travel records.

Palin has relied on the state's calculation of her taxable income, reported in her annual income statements known as W-2s, said Roger Olsen, a Washington, D.C., tax lawyer asked by the Palins to review their tax returns before they were made public last week.

"The income tax aspects of fringe benefits are complex and highly technical, and not subject to second-guessing by laymen," Olsen wrote in a three-page letter outlining his review of the returns.

Palin listed 157 days spent in Anchorage during 2007 on her travel forms. Garnero said Palin's work place as governor is considered to be Juneau, so she filed for the per diem payments _ most times the full $60 a day _ when she worked in her Anchorage office and stayed at her Wasilla home.

But state officials consider changing an employee's work station when they spend most of their time in another area, she said. That review will occur for Palin, Garnero said, which may require Palin to report future per diem payments as income.

"That's something we need to confer with the governor's office on," said Garnero, who said she was not aware of the number of days Palin spent working in Anchorage.

State rules for employees who receive a large amount of per diem payments are difficult to apply to Palin because she has no supervisor monitoring how long she works at another state office, Garnero said.

A typical work year for most employees is 260 days, but Garnero said the governor's staff told her Tuesday that her work year is considered 365 days because she is on call around the clock. That would mean Palin spent about 43 percent of last year working in Anchorage, and would allow the governor to continue receiving per diem payments that aren't taxed when she stays at her home, Garnero said.

The state review will not consider whether Palin should report past per diem payments as income. "In the past, we've gone prospective. We've never gone retroactive" when reviewing per diem paid to state employees, Garnero said.

The final decision likely will be made by the Internal Revenue Service, said Allen Bingham, an Anchorage accountant and member of the Alaska Society of Certified Public Accountants' taxation committee. IRS officials could determine that Palin owes taxes on past and future per diem payments, he said.

Bingham said Palin's situation is unusual because she claimed such a large number of days working away from Juneau, something that would typically raise red flags when considering whether the per diem should be considered income.

"It's certainly one of those things that some of us have raised our eyebrows about," he said.

The IRS likely also will want details about $43,490 the state paid Palin over 20 months for family travel, including commercial airline tickets the state bought for some of her children to join the governor. Bingham said taxpayers must show a specific business purpose for the state reimbursement, some actual work or duty performed for the expense.

"I guess I'm surprised that the state is paying for the kids. I don't know what the state business purpose is here," Bingham said.

Palin's returns showed that she and her husband underpaid their estimated taxes with an April extension and likely will owe interest. The per diem payments and family travel expenses were not included as income in those returns.

During the two tax years for which Palin released her returns, she claimed four dependent children. She gave birth this year to a fifth child. The family travel was a legitimate paid expense because Palin's husband and children represented the state at events, said Maria Comella, a campaign spokeswoman.

"The only time the children's travel was reimbursed was when they were traveling as part of an official event," she said.

Olsen, who worked in the Reagan administration's Department of Justice's tax division as an assistant attorney general, noted in his review of Palin's tax returns that her per diem payments were handled correctly by state officials as non-taxable because the governor's place of business was considered to be Juneau.

"No special consideration was ever given to Governor Palin, notwithstanding that she was the governor of Alaska," Olsen wrote.

Olsen said state law allows the governor's relatives to receive payment for travel costs "when conducting official state business." But his review did not address what state business was performed by Palin's children.

"Such payments for family members traveling on state business would not properly be included as taxable income on Governor Palin's federal tax returns," Olsen wrote.

Good for them. If there's one good thing that came out of Palin being McCain's VP, it's that Alaska got to know her for who she really is and not who they thought she was. They should vote her out in the next election or impeach her before she finishes her term. It appears that she has abused her powers in more ways than one.

I hope she looks good in an orange jumpsuit, because it's getting legally hot for her in Alaska too.

And, lost in all this is that Obama is polling at 38% in ALASKA! Not much, you say? Well it's more of a percentage than either of Bill Clinton's runs for office and that of Gore and Kerry! And neither Clinton, Gore or Kerry were facing a candidate FROM Alaska!

You know, most regular Americans, the "Joe 6-Packs" of the country, if we took a job where the office was 500-600 miles away from our home WE'D HAVE TO MOVE CLOSER TO WORK.

No average American takes a job that far away from their current residence and expects to not have to pick up and move closer to the new job. No average American takes a job that far away with the expectation of charging the company travel expenses for ourselves, our significant others, and our kids, so we can cover that insane distance on a daily basis. That would cost the company huge amounts of capitol that would eventually become burdensome to any company and eventually the cost of the employee would outweigh the job they were doing.

Broken down simply, she was gaming the system. She is NOT an average American. She is no more than another Republican abusing loopholes and taking advantage of tax payers.

Maybe an even better comparison would be to discover what other governors do. All surely have homes where they lived before being elected governor. They move into the governor's mansion and keep up their original home to return to when their term of office is over. Their living expenses in the governor's mansion are covered by the State. I've never heard of a governor who won't live in the governor's mansion but "stays home" to work and charges the state for commuting to that home, 800 miles away from the State capital.

How available could she possibly BE for state business at that distance?. I know we have marvellous communication technology (though Alaska may be behind in this because many areas don't have the technology yet), but usually people want to interact with a governor in person, not through telephone lines or emails. How does she coordinate anything with the State legislature so far away? How does she GOVERN from so far away?

Sounds to me as if she's been a governor largely absent from the duties for which she was elected. They DID say she was needed 365 days a year.

If, God forbid, Palin becomes the VP is she going to commute back and forth between DC and Alaska. Are we the tax payers going to have to pay for her and her family to do the countries business. Is she going to take the whole family with her when she meets with dignitaries around the world? Sarah Palin has no business wagging those chilren around with her almost everywhere she goes. And why does Mr. Palin have to be there, he looks like a secret agent man. There are serious questions about the Palin's and I think it's time we got some answers.

What just occured to me is this- $60/day per diem x 20 days/month x 12 months =$14,400/annually.
There are many people in this country trying to actually live on that amount, and a lot more people, maybe most people, making it on that $43,490 that Palin recieved for travel expenses, including the questionable reimbursments for taking the family on official business.

I don't think Sarah Palin has a clue what goes on at the average kitchen table if she can really dismiss these amounts, treat them like "no big deal".

The kids were stage props, and I'm sure you can claim deductions for props like that.

Man, if the people, at great costs, provides you and your family with a mansion and for whatever reason you choose not to live there for certain days, I don't care what the IRS tax code say, it is just wrong to claim further expenses from the people for you living at your own home when a perfectly liveable and expensive mansion is not being use.

Talk about wasteful spending of people's taxes.

One thing is for sure. If Alaskans have this much money to throw at their politicians, they are doing better than most of the country. Quit whining about how expensive stuff is - if paying Ms. Palin to have two homes and travel with the whole family on the taxpayer's money is ok up there, they you're all just making a choice as to how you want to spend your money - but you do have the money to spend.

Alaskans don't pay their politicians' salaries or expenses. It all comes out of oil revenues: I am sure this is why Alaskans haven't protested Palin's "income".

"Alaska is the only state that does not collect state sales tax or levy an individual income tax on any type of personal income, either earned or unearned. To finance state operations, Alaska depends primarily on petroleum revenues. Some of its cities and other local jurisdictions, however, do collect sales tax revenue."

This is ridiculous! I work for the government here. I am hired and my main office and supervisor are in the countries capital. I do almost all my work about 1000 miles from my main office in the area of my residence. I get 0 per diem for the work I do 1000 miles from my office. But if I have to go to my office 1000 miles away in the countries capital I am paid a per diem of around $86/day while I am at my main office. I have no residence there! I also get that per diem for any work related travel outside that area around my home, 1000 miles from my office, since I have no residences there either.

So determining where she does most of her work seems to be a prudent measure. You get the per diem when travelling where you do not normally work. Of course she is not like me as I do not have a mansion avaialable to me when I travel to the countries capital!. Having said that, does she also get a per diem when she is in Juneau? If so then it is a rip off and you are being had. She has a Government paid for and supplied home in the form of a mansion in Juneau. She should get nothing for travelling there under any circumstances. Seems there are a lot of other factors to consider here.

What is the complete story here?

I've worked under similar conditions, and the truth of the matter is
that you only receive per diem, when you are away from your office "working"
in an approved work environment. One' personal home does not count-
In fact it is illegal. Palin owes Alaska some money-
