NEW YORK — Yet another band is complaining about John McCain's use of their song to promote his campaign. This time, it's the Foo Fighters.

The rockers sent out a missive telling the Republican presidential candidate to stop using "My Hero." They said they learned it was being use through news reports.

"The saddest thing about this is that `My Hero' was written as a celebration of the common man and his extraordinary potential," the band said in a statement. "To have it appropriated without our knowledge and used in a manner that perverts the original sentiment of the lyric just tarnishes the song."

The band noted it's not the first time McCain has been told to stop using a song. John Mellencamp, Heart and Jackson Browne have also complained _ Browne even filed a lawsuit.

Soul legend Sam Moore also has asked the campaign of Democratic presidential candidate Barack Obama to stop using "Soul Man."

"The McCain-Palin campaign respects copyright. Accordingly, this campaign has obtained and paid for licenses from performing rights organizations, giving us permission to play millions of different songs, including `My Hero,'" said McCain-Palin spokesman Brian Rogers.

This has been noticed before, CNN had a story a couple of days ago about candidates' body language and on the reactions of babies to Obama and McCain. Kids overwhelmingly prefer Barry. He's younger, more familiar with child-rearing. Maybe he just has better breath. And no, I don't have the link. There's this thing called the internet search engine, go look it up yourself, haters.

When, oh, when will the REACTIONARY party get it? Maybe they can get former "Monday Night Football" announcer "Dandy" Don Meredith out of retirement and he can sing what was his trademark song when the game was out of reach for one team:

You go, Foo Fighters. Does anyone know whether there's any legal ground for artists to stop campaigns from using their music? Could the campaign hide behind a "not-for-profit" technicality (notice the quotes around that)?

I know that Heart went as far as filing a cease-and-desist order. I think they stopped using their song before a court got a hold of it though.

It depends on the license and the circumstances of use. In most cases the bands have no real recourse.

no, tommyjohn is one of those music snobs that walks around diminishing everyone else's musical favorites in favor of his/her own esoteric bands that no one has heard of, no one cares about, and no one will ever think of as relevant. that way, tommyjohn can feel special- like he/she is the only one who knows truly great music.

Weird. Why is Sam Moore telling anyone to use or not use Soul Man? He didn't even write it. The song was composed by David Porter and Isaac Hayes, not Sam and/or Dave.
