In this Oct. 24, 2008 file photo, Ashley Todd, a 20-year-old college student from College Station, Texas, center, is led from Pittsburgh Police Headquarters by detectives in Pittsburgh. Todd, a John McCain campaign volunteer, will enter a probation program for first-time offenders for making up a story of being mugged by a black Barack Obama supporter who scratched the letter "B" on her face. PITTSBURGH — A volunteer for John McCain's presidential campaign agreed Thursday to enter a probation program for first-time offenders for falsely reporting that a Barack Obama supporter robbed and assaulted her and scratched a "B" on her cheek.

Ashley Todd, 20, of College Station, Texas, claimed the attack happened when a robber saw her McCain bumper sticker. Todd appeared before a city judge and waived her right to a hearing and was to be released from jail later Thursday.

Under the agreement, her criminal record will be expunged after if she stays out of trouble and gets mental treatment on probation. Most people spend a year on probation in the program, which is for first-time, nonviolent offenders.

"Our focus was really, 'This is somebody who appeared to have some mental issues,'" said prosecutor Chris Avetta. "And we wanted to make sure she doesn't hurt herself or anybody else."

Todd's public defender, Emily McNally, declined to comment.

Todd initially told investigators she was attempting to use a bank ATM on Oct. 22 when a 6-foot-4 black man approached her from behind, put a knife to her throat and demanded money. She told police she handed the assailant $60 and walked away.

Todd, who is white, told investigators she suspected the man then noticed a McCain sticker on her car. She said the man punched her in the back of the head, knocked her to the ground and scratched a backward letter "B" into her face with a dull knife.

After admitting she made up the story, the woman told investigators she believed she cut the "B" onto her own cheek but didn't remember doing so, police said last week.

She was charged with a misdemeanor count of making a false police report and had been jailed since Oct. 24. She underwent a court-ordered psychiatric examination and was deemed to be competent to stand trial but in need of further counseling.

The charge Todd faced carries a maximum two-year jail sentence. Assistant Police Chief Maurita Bryant said Todd must abide by the conditions of her release or risk being prosecuted on the charge.

"I think what she needed mostly was counseling," Bryant said. "The only one she actually hurt was herself, although there could have been so many other ramifications based on her actions."

The case generated national media attention when a picture showing Todd with a black eye and the red "B" on her cheek was posted online.

Initial reports of the mugging prompted calls of support from McCain, the Republican presidential nominee, and his running mate, Sarah Palin. The College Republican National Committee at first criticized the attack, then fired and disowned Todd once the hoax was exposed.

The problem with the McCain campaign is the vetting, they have no process to pull the BS out of the completely deranged happenings that they themselves stumble around.

Palin, Joe the Plumber, this wacko College Republican etc.

College Republicans are hoodlums. It's where Rove came from, and where his predecessor Lee Atwater came from. People don't understand that College Republicans are not just a GOP fan club, they are an integral part of the GOP establishment.

Kind of like you have the big drug lords {the GOP} and then the street gangs {college repubs} doing the dirty work. The worst of the worst end up stepping up the ladder to upper mangement.

Can't help but wonder if a black man would get such caring considerate treatment. She manufactured a hate-crime, which is itself a hate-crime in my opinion. Not only should she not get off with a slap on the wrist, she should be tried in federal court. Unbelievable.

I agree. I don't think this is just that she has "issues." I think this was deliberate as a wannabe "October surprise." She should be put on trial and thoroughly investigated.

I agree. And she also attempted to affect the outcome of a national election. Can she be tried for this. This crazy person needs to serve some serious time for a serious crime.

Clearly this was a GOP trick gone awry. I'll bet you she was paid to do this and keep her mouth shut by John McCain and the Republican party. They will stop at nothing.

A slap on the wrist--disgusting! This is why perjury is so common in our court systems--even if one is caught red-handed, the consequences are meaningless. And this is how some women in this country put marks on themselves in order to get their children's fathers arrested for things that they have not done. This is a recipe for disaster. I know so. I've been there. Anyone who does such a thing should not only be forced to get psychiatric help, but should spend time in jail as well, and that person should know that if he or she were to ever do that again the price to be paid would be incrementally higher.

A lot of racial bias crimes are hoaxes. At least most of the more notorious ones. Think Tawana Brawley's allegation of being raped by white police officers, the allegation of the Duke Lacrosse team rape of a black stripper, the noose hanging on the door of a black professor at Columbia (who subsequently was fired for plagerism), and now this hoax. I'm not saying there are no racial bias crimes, but when I hear of one, I like to wait for the facts to come in before I start organizing marches, protests and boycotts. Fortunately, this hoax was brought to light before anyone's life (except for the fake victim) got ruined like in the previous cases I mentioned.

I don't believe this was a mental thing. What, she suddenly realized she was a mental case after the questions got too hard and her story started falling apart? If so, that means she lied up to the point that she conveniently 'remembered' she has mental problems. Are the courts to believe her mental problems extended from the fake attack to the entire police questioning period? Her mental case defense might have had more legs if it turns out she wasn't a paid mccain volunteer. She may be dumb as all get out, but I don't think she did this under a psychotic spell. I think she knew exactly what she was doing, and thought it would help her team win.

I think she suddenly realized she was a mental case when her lawyer explained the plea bargain and told her what her alternatives were.

I doubt the McCain campaign put one of their own paid volunteers up to this kind of fraud. There's no Plausible deniability. You need a putative independent to make deceitful false accusations ... someone like "Joe the Plumber".

IF ANYONE IS OUTRAGED.. District Attorney Zappala: da.allegheny.pa.useny.pa.us
Here is my letter to the DA. It was not answered or acknowledged so I might as well declare it an open letter::

Dear District Attorney Zappala,

- It is now clear that Ashley Todd's allegation that she was attacked, robbed and molested by "a large black man" is a lie.
- While, due to the excellent work of the Pittsburgh Police, there is no victim, Todd burdened the police department, could have implicated an innocent perpetrator because of his race and gender and may well have tainted national elections because of the allegation that the attacker was an Obama supporter.
- It is obvious that Todd's intention was to resurrect the ploy used by the KKK and other hate groups to falsely condemn a black man because of faked or false victimization of a white woman.
- Also, it is important to find out if she conspired with others to perpetrate this ploy and punish all involved to discourage this kind of ugly, unconstitutional, criminal behavior by individuals or campaigns.

So, I urge you to bring the full force of the law to bare on this act and to determine if this is an act of one political operator or part of an overall strategy to impugn a candidate based on race.

Thank You,

Robert W.

I have come back to see the other postings...I guess everyone is too busy being angry ,and in the middle of all of this is a sick girl who needs help. We dont know what her home life was like . She is a human being in immense emotional pain, and we all know what emotional pain is. Her illness exposed and now near lynch mobs are ready to form. she in eassence created no harm to the campaign. she just made a mess in public and a great many posters are walking by to rubberneck this poor girls contious fall. I should have brought the torches for the villagers. Damn Mccain and Palin pushing this story and then for distancing themselves. Yet how are some of the posters here any better? worse. you want her to pay, well grab the tar and feathers,
and you have the berve to use word like hope and change,,change yourselves.

She broke the law. Should she be tarred and feathered- no? Should she spend 2 years in jail- I believe that would be excessive. But she is walking out the door with no punishment. A few weeks in jail, with counseling, would appropriate....and would serve as a deterrent to her, and others, who might consider partcipating in similiar fraudulent activities. She wasted the resources of a police department. Resources that should have been used to serve and protect the community.

BTW: There are many people serving time in prison who have had horrific childhoods...and have emotional pain........should they all be set free because of it?

She's not "sick," I think she knew EXACTLY what she was doing. Calling her "sick" lets her off the hook easy.

At least that's what REPUBLICANS have been telling us about mental illness for years now.

Though I really do think she knew exactly what she was doing.

I don't think the McCain campaign had anything to do with this, now. She's done the same sort of thing before, apparently, and it looks to me like she wants attention and probably never even thought of the possibility of someone actually being hurt. She's a nut. Some of the McCain bunch did push the story, but they didn't script it. Ashley did. I hope they can help her, so no one else ever gets involved in her self aggrandizement manic episodes again.

No-she would have been locked up for a long time.

I'm sorry-but what this woman did boarders on hate crime status. She sought to inflame racial tensions and had the truth not come quickly, she could have fanned the flames of a fire that could have burnt way out of control.

Now, does anyone dispute Jack Murtha's claim that western PA is racist?

I do. Surely there are racists in W. PA, but to indite the entire area is also ridiculous. People are individuals. Where you live doesn't make you a racist, how you think does.

Hell NO!!! They would have thrown her As& in jail and kept her there for months and probably denied her legal counsel. It's also my opinion that they would have given her the mandatory sentence of 2 years, until someone big and or popular would have come to her aid to help her.
A Black person can not be slapped on the hand for mental instabilities.

This is serious stuff. John Lewis was spot on about what McCain and Palin were doing!!!!
I'm mad as hell about this.

Nope, she would be looking at 6 months to two years and she wouldn't have been able to say she was mentally instable...............
