CHICAGO — Democratic presidential nominee Barack Obama said Saturday he didn't know his aunt was living in the United States illegally and believes that laws covering the situation should be followed.

The Associated Press found that Obama's aunt had been instructed to leave the country four years ago by an immigration judge who rejected her request for asylum from her native Kenya. The woman, Zeituni Onyango (zay-TUHN on-YANG-oh), is living in public housing in Boston and is the half-sister of Obama's late father.

A statement given to the AP by Obama's campaign said, "Senator Obama has no knowledge of her status but obviously believes that any and all appropriate laws be followed." Traveling with Obama in Nevada, campaign strategist David Axelrod declined to elaborate on the statement, but said: "I think people are suspicious about stories that surface in the last 72 hours of a national campaign."

An adviser to Republican John McCain's campaign, Mark Salter, said he had no comment on the reports about Obama's relative. "It's a family matter," Salter said.

Rudy Giuliani, campaigning for McCain in Henderson, Nev., said in an interview with The Associated Press that Obama's aunt should be off limits in the campaign. "I don't think families should be hounded," he said. "I don't think Barack Obama has anything to do with a relative being here illegally."

The campaign said it was returning $260 that Onyango had contributed in small increments to Obama's presidential bid over several months. Federal election law prohibits foreigners from making political donations. Onyango listed her employer as the Boston Housing Authority and last gave $5 on Sept. 19.

Onyango, 56, is part of Obama's large paternal family, with many related to him by blood whom he never knew growing up.

Obama's father, Barack Obama Sr., left the future presidential nominee when the boy was 2, and they reunited only once _ for a monthlong visit when Obama was 10. The elder Obama lived most of his life in Kenya, where he fathered seven other children with three other wives. He died in a car crash in 1982.

Obama was raised for the most part by his mother and her parents in Hawaii. He first met his father's side of the family when he traveled to Africa 20 years ago. He referred to Onyango as "Auntie Zeituni" when describing the trip in his memoir, saying she was "a proud woman."

Obama's campaign said he had seen her a few times since that meeting, beginning with a return trip to Kenya with his future wife, Michelle, in 1992. Onyango visited the family in Chicago on a tourist visa at Obama's invitation about nine years ago, the campaign said, stopping to visit friends on the East Coast before returning to Kenya.

She attended Obama's swearing-in to the U.S. Senate in 2004, but campaign officials said Obama provided no assistance in getting her a tourist visa and doesn't know the details of her stay. The campaign said he last heard from her about two years ago when she called saying she was in Boston, but he did not see her there.

Onyango's refusal to leave the country would represent an administrative, noncriminal violation of immigration law, meaning such cases are handled outside the criminal court system. Estimates vary, but many experts believe there are more than 10 million such immigrants in the U.S.

The AP could not immediately reach Onyango for comment. When a reporter went to her home Friday night, no one answered the door. A neighbor said she was often not home on weekends. Onyango did not immediately return telephone and written messages left at her home.

Onyango was instructed to leave the country by a U.S. immigration judge who denied her asylum request, a person familiar with the matter told the AP. This person spoke on condition of anonymity because no one was authorized to discuss Onyango's case.

It was unclear why her request was rejected in 2004. A spokeswoman for U.S. Immigration and Customs Enforcement, Kelly Nantel, said the government does not comment on an individual's citizenship status or immigration case.

Information about the deportation case was disclosed and confirmed by two separate sources, one a federal law enforcement official. The information they made available is known to officials in the federal government, but the AP could not establish whether anyone at a political level in the Bush administration or in the McCain campaign had been involved in its release.

Onyango's case _ coming to light just days before the presidential election _ led to an unusual nationwide directive within Immigrations and Customs Enforcement requiring that any deportations before Tuesday's election be approved at least at the level of the agency's regional directors, the U.S. law enforcement official told the AP.

The directive suggests that the administration is sensitive to the political implications of Onyango's case coming to light so close to the election.

The East African nation has been fractured by violence in recent years, including a period of two months of bloodshed after December 2007 that killed 1,500 people.

In Boston, Lydia Agro, communications director for the Housing Authority, said Onyango had been screened and approved for public housing as an "eligible non-citizen" when she moved in in 2003. She said the authority is not notified of deportation orders and did not know Onyango was related to Obama until two days ago.

Agro said the authority doesn't believe it needs to take any action to remove Onyango from public housing despite the order.

She said that although Onyango entered the system under federal guidelines in a federal development, she now lives in a state-funded development. State law forbids the authority from even asking Onyango about her immigration status. That means the federal deportation order has no bearing on Onyango's eligibility for the state-funded project where she lives, Agro said.

"We're not convinced that the deportation decision will affect her housing at all right now," she said.

"She's been a very good resident," she added.

Hmm, place your bets, place your bets......­Let's put a wager on Obama's aunt that she is still here in 2010. Maybe a phonecall or two will take care of that. Honestly, I would probably feel obligated to help family as well. The difference between us is he is going to have to find public housing for 12 million Mexicans. Wait, did he say he was going to cover that? There was soooo much, it's hard to keep it all straight. I do not dislike Obama. But I do not feel he is qualified. He is an opportunist, and was in the right place at the right time. People were so hopeless at this point in our history, that they latched on to every word. Combine that with the dem faithful, almost every AA in the land, and you have a recipe for success. Can he speak eloquently? Of course. Can he inspire? Well, he can get people to vote, but if he can change the stat of 1 of every 3 black men in prison, then I will sing his praises.

That "stat" you cite is the end product of federal drug sentencing requirements that (1) impose substantially more severe penalties for possession of crack cocaine as opposed to the powdered variety, virtually guaranteeing that African-Americans will be disproportionately sentenced to prison while our fellow white Americans will be disproportionately fined, given probation, or sent to rehab.

Add to that witch's brew poorer schools in predominately minority neighborhoods as a matter of deliberate policy, racial profiling, and other factors, and you get your "stat."

Trouble is, is that that "stat" is as much of an artificial construct of "conservative" policy makers and interests such as the CA prison guard's union, and you get the idea.

"Opportunist?" Where have you been the past eight years from Hell? We've been under the regime of the most opportunistic bunch of crooks since Boss Tweed ruled over Tammany Hall, the very same characters who love to shed crocodile tears over the "illegal immigrant/Brown Peril" problem, all the while starving the Border patrol of funding, and deflecting law enforcement from hitting the corporate employers of illegals, who invariably happen to be big contributors to the GOP.

President-Elect Obama has taken our country a first long overdue step into the 21st Century, no matter how much you may choose to rant about the dreaded "illegals" while $10 billion a month in taxpayer dollars disappears down the very rathole McCain would have kept open for "a hundred years."

I just think Obama is a good orator, but the inspiration to do good things is already fading. He will shake some things up in Washington, will it all be for the good? I doubt it. It can't be, but I don't even blame him for that. Whatever policy comes down, I might not agree with, but I'm sure it's helping someone. What gets me are people like yourself who think Obama's plan is the only plan for the U.S. Just like your opinion. It is always right. All I'm saying is wait and see. If you saw a piece of liberal pie on the other side of a freeway, would you just run at it with reckless abandon and get hit by the ConservoMobile driven by a Republican, or would you take a look around, surveil your surroundings and notice there is an overpass nearby? Peggy, he is trying to address global warming, a very difficult issue, that will need very complicated plans to deal with while still addressing the livability issues of having to try to afford to clean up. I believe in a stick and carrot approach when it comes to taxes and this is what Obama is talking about. People should not be allowed to pollute without penalty. Maybe, your company should be looking to invest more in clean tech and alternative forms of energy. That is the strategy.

He is also going to try to reduce the demand for oil, especially foreign oil. I have a feeling that he is going to demand that the oil produced here should stay here. Is this the secret face at the heart of your nightmares?

Unlike McCain, he is able to reconsider with dignity and deal with complicated issues. His being the head of The Harvard Law Review is incredibly impressive to me. He was voted in unanimously. and to answer your completely off topic and irrelevant post, how would making people who build polluting coal fired power plants bakrupt the coal industry? There will be MORE than enough investors willing to build plants that capture carbon emissions rather than pay hugs sums for making our air quality suck. So the coal will still get bought, just not by people who care so little for our descendants that they would destroy our environment.

Sorry, you need to look into BO's comments in the SF chronicle.­.he said what I commented on above, that by design, his proposal would bankrupt the coal industry..­..so, to comment on your post, why would anyone want to continue investing in an industry that BO's policy will bankrupt..­.those investors would pull their money out and go overseas, and I wouldn't blame them...why should they throw money down an empty hole??

Err, try that again...ho­w would bankrupting people who wish to harm our environment by building polluting coal fired plants bankrupt the coal industry? The coal industry SELLS to those people, so they would lose customers, but those customers would be replaced by ones with RESPECT for our world who build plants that can capture and sequester the carbon emissions from burning the coal. And perfecting the technology to do that will result in jobs for many Americans. But I suppose you just want to rant and rave how this would hurt the middle class...oh yes, creating jobs would hurt the middle class SOOOOO much.

Do you know how OJ got off? It was because there was so much coverage of his trial that the defense could pick a few news stories out of hundreds of thousands that brought doubt to the prosecutions evidence. The people who reported on his trial did not always put out factual information and made errors in reporting, as well, witnesses make errors and people misspeak. I like the way that Biden explained it in an official manner, a speech, not some small quote of a rushed news story. I liked the way Biden explained the plan, and that is the way I explained it to you.

The latest: BO to the San Francisoco Chronicle: "These new cap and trade laws would, by design, bankrupt the coal industry", when speaking about the new regulations he would put on coal production here in the US. He went on to say, "this would, essentially, make the costs double, in the best scenario, sometimes even triple, and this would be passed on to the consumer".­..wtf???

Does he not care about the jobs in the coal industry, not to mention the people who use coal to heat their homes? How can people, who can't afford a gallon of milk, and buy a 1/2 gallon instead, afford to pay their utility bill when this happens, if BO is POTUS...Lo­okit up, it is from an interview with BO and the editorial staff of the SAn Francisco Chronicle in Jan. 2008, why has this just now come out? And who supressed it?? This is a MAJOR issue in the country..

you think those coal workers wouldn't love to get out of those jobs that are creating so many health problems for them as they have to work with a cancer causing substance on a daily basis?!?!

you think coal is not a major component to global warming?

the majority are uneducated workers who could and would love to begin working with wind and solar plants and technology, and alternative energy!

I see the angry libs from last night have left this site...goo­d...so much anger, and this coming from a party that constantly talks about "unity"...­The hypocracy is astounding.

BO should not have thrown his aunt under the bus...and now it has come out that it was reporters that revealed this story, so the issue is: Why did it throw her under the bus?? This is a pattern of BO's, and now a video comes out about him wanting to "bankrupt", his words, not mine, the coal industry..­.wow, wonder what people in West Virginia and Virginia think about this???

John McCain is an honest, decent man, and bottom line, that is what I need in a president, not one that h a t e s America, not one that lies to get elected, not one that shows everyone his dislike of certain people...a­nd this is what BO has done, he hasn't unified anyone!!! He wants to take from certain people and give it to others, this is NOT what America was founded on. America was founded on the premise that if you work hard, you will suceed, and it is alive and well and GROWING in America...­there have always been people who are more sucessful than others, and there always will be!!! This is NOT the POTUS's job, to take from the "rich" and give to the poor...Ame­ricans are the most generous people in the world, always ready and willing to help ANYONE out..NO ONE has a right to take others wealth...b­ottom line, and this is what BO plans to do...among many OTHER things that are out and out wrong..His ideology is that of d i st ruction, not of unifying..­He is discouraging people to go and make their own money, to wait and the government will take care of you..this is WRONG!!!

There are businesses that people seek out and people are glad, even ecstatic about paying for, and then there are businesses to whom one feels as if one does not have a choice about, as if cornered, as if put into submission by what feels like a monopoly and is forced to make payments to without hope of anything better while the ones receiving payment, on the other side, lose touch, and dehumanize the people who provide so generously to the monopoly which allows a few who live “well” in their lonely existence in five star hotels. What people forget is that there is nobody who pulls oneself up from one’s own bootstraps without having some exchange of money with someone else. Every person is connected and some are more on the receiving end. If it were let to be known that the person on the receiving side of liquidity was such a person who is an uncaring, self-centered, a-hole who can't remember or even care about the people who helped to put him on the top economically by their own sacrifice, if people knew this, then nobody would ever do business with a creature like that. A person like that is not human.

It is not my saga. I am blessed and privileged beyond belief. I'm sorry I summed you up so well. I know how the super rich live. I am not that, but I have been around it enough to know that these people are miserable because they fear of losing what they have and they think that money makes them happy. Very shallow. Like you.

There's really no question privacy laws were violated, despite the Washington Post's coy headline: "Disclosure About Obama's Aunt May Have Violated Privacy Policy." I'd like to see their headline if it had been Fact-Free Fred Hiatt's aunt's asylum petition that had been leaked to the press.

Federal privacy law restricts U.S. immigration agencies from disclosing information about citizens and permanent residents, and DHS policy similarly limits disclosures about the status of legal and illegal immigrants. Asylum-seekers are granted greater protection, because of the sensitive nature of their claims and the risks of retaliation.

In a statement, a spokeswoman for U.S. Immigration and Customs Enforcement said the matter has been referred to the agency's Office of Professional Responsibility and its parent department's inspector general.

"They are looking into whether there was a violation of policy in publicly disclosing individual case information," ICE spokeswoman Kelly Nantel said. "We can't comment on individual cases."

John Conyers is on the case. Perhaps someone from DHS will eventually testify in front of his committee:

As soon as the story emerged, Conyers wrote to the Secretary of Homeland Security, Michael Chertoff, requesting an immediate investigation of the leak.

In his letter, he said it was “was not the first leak of law enforcement information apparently designed to influence the coming presidential election,” apparently referring to an ongoing investigation of voter fraud by the |Association of Community Organizations for Reform Now.
