On Saturday morning, Drudge trumpeted the latest one-day finding in John Zogby's latest three-day tracking poll on the presidential race. While Zogby's three-day average still shows a 5-point lead for Barack Obama over John McCain, the pollster notes on his site today that McCain led Obama by one point, 48 to 47, in the last day of surveys.

More cautious than Drudge, however, Zogby says that it's too early to declare that McCain has made decisive gains over Obama. "If McCain has a good day tomorrow, we will eliminate Obama's good day three days ago, and we could really see some tightening in this rolling average. But for now, hold on," Zogby writes.

But as the Huffington Post reported on Thursday when discussing the latest Fox News poll, Zogby has a unique methodology in his polling. He fixes -- or "weights" -- the partisan balance of his respondents, unlike most pollsters. While his admirably transparent and stable practice guarantees a certain methodological sameness from day to day, therefore making any new lead for McCain worth reporting, Zogby's partisan weighting can also raise other questions.

Asked earlier this week what the partisan weighting of their poll currently is, a Zogby aide told the Huffington Post: "Party ID remains at 38 Democratic - 36 Republican - 26 Independent. We have added a point for 18-29 [year old voters], 1.5 for African Americans, and 2 for Hispanics."

Earlier this year, Zogby told me that "party ID is a lead variable, and a major determinant in how people vote. I apply a weight to party ID, and if I see a reason for it to change, I will."

Still, Zogby's two point party ID advantage for Democrats is the smallest of any polling firm. The last four days of the Hotline/Diageo poll show anywhere from a four- to six-point advantage for Democrats -- and a simultaneous seven-point lead for Obama. Gallup's latest surveys indicate that Democrats have an 11-point advantage over Republicans in party ID (including what the firm describes as partisan "leaners").

Zogby's partisan makeup gives even less of a partisan advantage to Democrats than Fox's latest poll, which earned some skepticism, as well.

As for the day-to-day fluctuations in tracking polls, Emory University political scientist Alan Abramowitz says they are "almost entirely due" to random statistical error, or "noise."

"The trackers don't move in sync with each other -- one goes up, another goes down," he tells the Huffington Post. "This is what we are seeing today in fact. Already we see that Obama is down in Zogby but up in DailyKos and Rasmussen. No doubt we'll see more of the same in the next three days. There is no evidence here of any real trend toward McCain in either the national polls or the state polling as smart analysts like Nate Silver of fivethirtyeight.com and Mark Blumenthal and Charles Franklin of Pollster.com have shown."

For what it's worth, McCain lead pollster Bill McInturff sees things Zogby's way. In a Friday conference call with reporters, McInturff said "I don't see how you have party ID at negative 8 [percent for Republicans]. That's not America ... anywhere in the last generation and a half."

Aside from determining the next president, Tuesday's election might be used to settle a few scores in the polling profession, as well.

I was asked by a co-worker yesterday to accompany and cast my vote early. It was Halloween and casual Friday, so I figured I could get away with wearing my Obama shirt. I first thought "I,m wearing this shirt, I can't go. But I had another shirt on underneath, so I took off the T-shirt and turned it inside out. Waited in line about 45 minutes, voted and then once I reached the "No campaigning beyond this point "sign, I took off the shirt, turned it right side in, and put it back on. Folks, I got applauded by all the people standing in line when they saw my shirt. Great feeling!

You did exactly the right thing. Federal election law prohibits electioneering at the polls ... within 100 feet of them, to be exact. Electioneering includes wearing shirts, hats, buttons, etc., or carrying placards or demonstrating, etc., etc. within that 100 feet.

The reasoning behind the law is to prevent voters from being influenced or intimidated into voting a certain way.

Although, at first blush, it looks like freedom of expression should allow a person to wear campaign clothes to the polls, it is not a violation of the First Amendment. The right to vote is sacred (although far too few of us exercise that right) and Constitutional protections can be overridden by a "compelling state interest." In this case, the compelling state interest that puts free expression on hold at the polls is in protecting the sanctity and privacy of the vote and the voter's right to make his/her selection according to personal beliefs, not the influence of others. If electioneering were not prohibited, it is foreseeable that some people would be intimidated or otherwise influenced to cast a vote they didn't want to.

Obama has a large lead, but whatever fixed machines, registration purging, voter suppression, the Republicans will do their best to make it look like a minimal "win" when everyone has seen the large crowds at Obama's rallies--those crowds do translate into votes.

Could Pennsylvania in 2008 be what Ohio was in 2004 and Florida in 2000?

Is there reason why the McCain Campaign and the Republicans are targeting Pennsylvania in the final days to the elections? Do they have a legit shot at winning this state that hasn't gone Republican in 20 years and they're down in every poll by as many as 12 points and a few as 4 points? I think not.... and I believe the Republicans and John McCain are up to their old election Tricks of Voter Suppression and creating chaos and confusion.

I would Strongly Suggest that the Obama Campaign and the DNC get their Top Lawyers and Advocates on the Ground in PA to do Poll Watching. I would target counties like York, Adams, Lancaster and Cumberland, because we have seen increases in Democratic Voter registration over the past year. Many have moved in from Maryland and New York. Their a lot of new residents in York, Adams, Lancaster and Cumberland counties who are not savvy to “local politics” and can be taken advantage of by the Republican Machines that has Ruled these counties for over a quarter of a century. They are using the Zogby and Fox polls to legitimize these actions.

I plead to the Obama Campaign and the Democratic National committee to bring in the troops to these counties or Americans will once again pay the price for FOUR MORE YEARS.

EVEN with E-voting, there has to be a record connecting a REAL person residing in that state to a REAL vote. I'm sure that this time Forensic Accountants, who are used to decrypt the Mob's coded records, are on site at every major polling station in the nation for Dems. AND, ANY attempt to remove the evidence will be closely watched. This is a serious effort that could have gotten Dems a Gore win in 2000, but not this time.

Still, this could very much be a rigged election, and the way software code works, one could set the software to ERASE ITSELF after the polls close.

What's kil.ling me is that the default position for these Diebold machines (Diebold CEO a huge Bush contributor) is a STRAIGHT Republican ticket. How crazy is that? Anything can happen. But I'm sure Obama's people have anticipated this, given the way they've run this campaign. If all those machines are seized and tested, they will HAVE to produce the EXACT same results on a statistical sample, or else it is a very serious conspiracy.

During the primaries, Obama camp tried this mode of argument whenever Hillary won...
If McCain wins, it may very well be for the simple reason that people just couldn't see their money going up in smoke with Obama, or maybe they felt he couldn't be trusted to negotiate with enemies in a position of weakness, as he would do with no precondtional meetings with the likes of Raul Castro or Ahmadinejad. Or it could be that Americans just don't like the pals Obama allied himself with. All legit reasons to vote no for Obama...

Samples on Fridays and holidays are notoriously inaccurate (see fivethirtyeight.com) -- yesterday was BOTH a Friday and holiday.
