Coleman

If allegations turn out to be true that Norm Coleman's wife received $75,000 of payments from a GOP benefactor interested in helping out the Senator's family, then the Minnesota Republican could be facing a whole host of political and legal troubles, Senate ethics experts say.

This past week, the CEO of the Texas-based Deep Marine Technology, filed a lawsuit that, tangentially, alleged that a shareholder in the company, Nasser Kazeminy, helped funnel three payments of $25,000 to the Coleman family. The payments were officially made as insurance purchases from the company at which Laurie Coleman is employed. But an affidavit from Paul McKim, the Republican head of DMT, states that no such services were rendered.

Experts in Senate ethics law said the situation, while hardly settled, spelled myriad problems for the Senator and his family, including - in a ways-away hypothetical - criminal charges. One Democratic lawyer said that the best legal remedy for Coleman would be simply losing his reelection bid on Tuesday.

"If he doesn't go back to the senate than the Ethics Committee goes away," said the attorney who has followed the issue closely. "So, in some ways, Norm's best legal move is to lose on Tuesday. But if he goes back then the ethics committee will almost certainly look at it."

At issue is the reporting of the $75,000 in payments. Under Senate Ethics rules, members of that congressional body are required to disclose gifts of a certain monetary value that are given with knowledge of their political positions. Coleman's personal financial disclosure forms never report the payments.

"Under the current ethics rule [the $75,000] is a gift to him if he knew about it and believed it was given to him because his position as a Senator," said Larry Noble a longtime expert on money in politics and currently a lawyer with the firm, Skadden Arps. "If those two are true, he would have reporting obligations and would have had to report it... And yes, we have seen people get in trouble with that before."

In fact, as another lawyer described it for the Huffington Post, much of what is potentially plaguing Coleman is reminiscent of what transpired with Sen. Ted Stevens- a disclosure violation that could result in jail time for the Alaska Republican.

Such comparisons are, of course, merely speculation. At this point in time, Coleman has not been investigated for any wrongdoing. And the main accusation involves Kazeminy (who asked for the money) and not the Colemans (who may or may not have been aware that the checks were being sent their way).

Asked about the issue, Coleman has offered no detailed denial. Rather he has attempted to turn the spotlight on what he claims to be attacks against his wife and political motivations - charging that the Al Franken campaign fed the information to the Minneapolis Star Tribune, charges the paper has adamantly denied.

But lawyers for the plaintiff insist that the allegation - which makes up only a part of the suit against Kazeminy and others - is based on facts. And, sure enough, late last week the Star Tribune posted evidence of the $25,000 payments made to Laurie Coleman's Hays Company in the form of a vendor report.

Even with this evidence established, however, Coleman may be cleared of any ethical wrongdoing. It could, for example, be determined that the Hays Company did complete the task for which it was paid. Theoretically, moreover, Laurie Coleman could have received the payments without telling her husband or, taking it one step further, knowing the political purpose behind them.

"Then he has the defense that he was not aware of the gifts and would not have had an obligation to report it," said Noble.

Then there is the Senate's notorious hesitance towards tackling these matters. Should Coleman be reelected, it is likely that the congressional body would wait for the current lawsuit to pan out before weighing into the matter. That could take months, if not years.

"They tend not to be very aggressive about these cases. They tend to wait for all the other processes to fall in place," said Noble, who added that if Franken wins on Tuesday, the issue is likely for naught. "If he does lose reelection than I think there is strong likelihood that the spotlight will go away."

The Ethics Committee has been useless for years so I hold no hope that Coleman would suffer from Ethics Committee action but I do like the idea of him losing to Franken!

I don't see where this is his choice to make. We don't WANT this guy in Minnesota any more! People can't stand him.

My husband and I used to see him around St. Paul. My husband confronted him directly one day. The guy is TEENY and my husband is tall. He intimidated Coleman so much he just stood there, looking as stupid as he is.

I had a run in with him at Zelo in Minneapolis years ago. He was hitting on my girlfriend. This was back when Laurie Coleman lived in California to pursue her acting career early in his Senate days. Apparently she couldn't stand to live too close to him either. Yeah, he's a real upstanding kind of guy. I blogged about the experience here: http://mickeymusing.vox.com/library/post/senator-coleman-votes-against-stem-cell-research.html

His entourage included an acquaintance of my girlfriend, John Goodman, the guy who started Sidney's restaurants in MN. It would be well worth looking into that relationship and illegal gift giving, as well.

I don't think I've ever stood more than 20 minutes to vote. I can't imagine waiting outside in November. The ones that do are true PATRIOTS.

The one benefit of living in a wealthy Republican neighborhood.... never any lines and plenty of polling booths. I will thank them for making it easier for me to vote for Dems down the line.

The Dems need to write into law that for Presidential elections that you must have 1 polling station for every X number of people registered to that location, and enough paper ballots on hand for 102% turn out. (The 2% to cover any damaged or messed up ballots due to printing errors or other issues.)

I agree. All the way down to the dogcatcher. Unfortunately, in my county, many Republicans were unopposed, so I just skipped over these folks. They don't deserve my vote.

I'm going to check out what is required to get on the ballots for these unopposed positions next time. I know here in Cincinnati we probably have that going on too with the Repubs. You never know when you might catch a break.

I remember one election where a guy put his name on the ballot jokingly in a Republican stronghold, and a week or so before the election the Repub was caught in this big scandal and the Dem guy won. He didn't even campaign at all or spend much money. But he ended up winning cause the other guy "lost".

Who knows, Coleman may the one of the first sleeze balls the new Congress censures. It would be entertaining to see him elected into power, then to lose it shortly afterwards for a prison term.

Although I'd rather see Al Franken get the congressional seat and save us all the headache of what damage Coleman would do while retaining his seat.

I don't understand how this election is even close. It reminds me of Senator Ted Stevens from Alaska. How are Senators will so much legal trouble able to run? How is it that we allow our country to be led by crooks!

Can we please vote for change!

I don't either. Then you see the people at Palin rallies and realize that they are sincerely deluded. They don't have the interest or ambition to check things out for themselves so they believe all the BS the right wing noise machine has generated. I know people who are still convinced that Obama was not born here, he will not recite the pledge of allegiance, he is a Muslim (with a rogue Christian pastor, WTF?) and he has secret plans to make America a communist country (I think they mean socialist, but nuance is generally lost on these folks). The euphemistically named "low information voters" (read: "mouth breathing troglodytes") are genuinely terrified of an Obama presidency. It will be the best thing in the world for them when Obama gets elected and the whole world doesn't come to an end. Maybe they'll finally start questioning some of what Rush and Hannity and their other right wing overlords have been telling them.

How absurd is it that Minnesotans could actually elect this slime nozzle?

Have you no decency, Minnesota?

Favorite    Flag as abusive Posted 03:50 AM on 11/03/2008

It is absurd, but Minnesota does have decency (the state is one of just a few to provide free emergency health care to the uninsured in a catastrophic instances to the very poor) ... although sending Coleman and Bachmann to Washington is enough to make you wonder, so you're indeed spot on but the problem is that in prosperous times (such as they were relatively speaking when Coleman was elected in 2002), Minnesotans retreat (like many Americans) to their malls and castles and figure that it really matters little who's in charge. Minnesota does have a good strain of decent Republicans with Arne Carlson and David Durnberger on one end and Rudy Boschwitz, Norm Coleman and Rudy Boschwitz on the other ... Coleman is indeed in the running to lost to both a wrestler (Ventura) and later a comedian ...

There is a very good chance that Norm Coleman was NOT elected... at least by a majority of Minn. voters.
Norm Coleman ONLY became senator because Senator Paul Wellstone (his wife, two sons, two aides, and two pilots) were tragically killed on a campaign flight as he was cruising to an easy re-election victory in Nov 2002. Even though Bush was at the very peak of his "War President!" popularity in 2002, Senator Wellstone's statewide and nationwide popularity were GROWING that tragic November, for his steadfast oppositon to the looming Bush-Cheney-Wolfowitz looming Iraq war - despite all the smear-&-Slime the Bush-Rove GOP crew could throw at Wellstone. (painting him as "un-Patriotic" which of course was to imply "treasonous".)

Former VP (and Minn. favorite son) Walter Mondale stepped in to the heroic Wellstone's senate race at the last minute... when the Rove-GOP crew used a concerted "major media" attacks to SMEAR the Wellstone's MEMORIAL campaign rally as "TOO PARTISAN" !!

Even with all those national GOP efforts focused like a laser-beam on defeating first Wellstone and then VP Mondale, Norm Coleman's "winnning" election totals differed markedly from election exit-polls.
The same thing happened that November to Senator Max Cleland's re-election in Georgia, and to Alabama Democratic Gov. Don Siegelman in Alabama - their "winning the majority" exit polls differed markedly from the "actual election results" which were of course tabulated on Diebold or ES&S no-audit, no verification vote machines.

Who says he was "elected"? No one sane could believe that stupid story that Wellstone's memorial service caused people to vote for Coleman and not for Mondale. Mondale was 6 points up over Coleman.

The elections were being rigged in 2002, remember? Remember the "upset" victory of Chambliss vs. Cleland in Georgia?

How in the heck can someone "not be aware" of receiving three checks for $25,000????

I guess F. Scott Fitzgerald was right, "the rich aren't like you and me."

I live on a miserably fixed income of less than $9,500 a year and I keep track of my money--it's a matter of shere survival! With $75 grand I could live quite comfortably--probably for the rest of my life!

I sincerely hope Franken cleans Coleman's clock on Tuesday!

Since when have Republicans ever listened to any advice other than "my way or the highway"?

In Coleman's case though, maybe it's more aptly described as "my way or the big house".
