Appearing on "The Rachel Maddow Show" earlier this week, Indiana Sen. Evan Bayh argued that Connecticut Sen. Joe Lieberman should keep his committee chairmanships, suggesting that the posts could be taken away at a later date if he misbehaves. But a Senate rules expert who spoke to the Huffington Post said this could prove more difficult than is presently assumed.

Attempting to put Democrats' fears to rest, Bayh told Maddow:

And the final thing I'd say is, if he does retain his chairmanship, we still exert oversight over him and control over him. He doesn't have the ability to just do whatever he wants. The caucus still has the right to remove him from that position at any time if he starts going off on some kind of tangent.

Bayh's rationale appeared persuasive to some Democrats, including former Clinton campaign operative Phil Singer, who wrote on his blog that the Indiana Senator's take was "not unreasonable."

But former Democratic Senate staffer Martin Paone suggested Bayh is under-educated on this matter. Paone, who became as the "secretary to the majority" in the Senate starting in 2001, notes that Republicans harbored similar desires in the past, but never executed them due to the threat of a filibuster.

"It takes a Senate resolution to change a chairmanship, and that resolution could be subject to a filibuster," Paone told the Huffington Post. Put simply, under Bayh's proposed scenario, Republicans would have every reason to filibuster a new Senate resolution taking Lieberman's chairmanship away if he was proving an effective antagonist of President Obama.

Paone noted that a similar game of political chess played out in the Senate's recent history. "We had a similar situation in the past with a Republican moderate senator, Mark Hatfield from Oregon, who voted the wrong way in the eyes of [former Sen. Rick] Santorum and others on the constitutional amendment on a balanced budget," Paone said. "There were rumblings they wanted to take his chairmanship away. But the ranking member on the committee was [Democratic] Sen. Robert Byrd, who wrote Hatfield a nice note saying, 'if they ever try to take your chairmanship away, I'll make sure we [Democrats] will filibuster such a resolution."

According to Paone, "the time to take a chairmanship away is when everybody is being appointed [at the beginning of the new Congress]. Everybody has an investment in that resolution. In order for everybody to benefit, that resolution has to pass. It's much more difficult to cherry pick in this fashion, to take one Senator's chairmanship, at a later date."

Asked if Bayh understands this complexity, Paone said "I'm sure he probably doesn't. There aren't that many people up there who do. It's not every day you want to change a chairmanship. And since the Hatfield matter never materialized, I think that shows why it's not as easy as some might think."

I already made 2 calls to my 2 CA senators, Boxer/Feinstein wording my concern for letting JOE 2 FACE, go undisciplned and unpunished, for him to continue chairing a comity taking away that chance for other faithful democrats is UN ACCEPTABLE imho. The guys in favor of Joe 2 Face are possibly concerned for their fates in the future if go ROGUE lol.

Joe 2 Face crossed the line! If Florida and Michigan got punished for going Rogue, Joe Face for stabbing the back of people he got his CREDITS developed with is unbelievable.

AIPAC that pulls the strings on Liberman allowed the baiting that had the extreme right wing to rear its ugly head. Liberman was out of line and his puppet masters at AIPAC did not care how dangerous his rehertic was. We all know how bad Lieberman behaved and he crossed a line that no normal person would of.

Republicans ran from there party because of Sara Palin and Liberman attracting the extreme right. wing. Please play back what Lieberman said during this election and you will understand that his comments were so bad that he should be shuned for life.

Out with Lieberman! This is a matter of principle and should not be dealt with as a matter of pragmatic politics. So far as filibusters are concerned, can't we rely on a few rational republicans, the gentlewomen from Maine spring to mind, to put country ahead of partisanship?

all the Dems need are a few moderate Repugs in Dem leaning states and they can overcome a filibuster. A little prok here and there works miracles. Lets do some research here. Who can tell me which senators would be best to target to vote with the Dems?

Lieberman has to represent his constituency or be voted out of the Senate.
He can only do that as a Democrat.
That said, Obama is willing to let it go, so who am I to protest?

AIPAC or not, Lieberman is not a Democrat. He's an independent caucusing with the Democrats. It will be a big mistake to keep him in the chair of the Homeland Security Committee. It will come back to haunt Obama and the Democrats. They will deserve what they get if they keep him.

I'm an Obama supporter (from the start) but I have to say this is pure politics & Lieberman, believe it or not is pretty much needed by the Dems in more ways than people realize. Obama definitely knows it.
Lieberman has very strong ties to AIPAC the most powerful jewish lobby in the world & without their support any hope of middle east peace is pretty much dead.

The whole thing is a waiting game right now. All of this "maybe", "maybe not" talk is just that, talk.IMO, the Dems need to wait for the 3 senate outcomes in Alaske, Minnesota, and Georgia. IF all three of those go (D), then Leiberman will be needed to get the magic 60. If even one goes (R), then they can boot him. Right now, it is just a waiting game, dont tick him off quite yet, in case you need him. Maybe he can be trusted to stick by the Dems, maybe not. But right now, it is a case of " keep your friends close, and your enemies closer"
