Cook County Sheriff To Appear At Senate Foreclosure Hearing

Illinois Senator Dick Durbin will chair a hearing in Washington Wednesday on the foreclosure crisis.

Cook County Sheriff Tom Dart will be among those testifying.

The hearing will look at the role bankruptcy courts can play in easing the crisis. It will focus on a bill that could help at-risk homeowners keep their homes by altering the terms of their mortgages.

I recall hearing Sheriff Dart being interviewed. He appeared the only one stepping up and addressing the issue of foreclosures. He took a stand that some government officials may have thought wrong but I know I felt total respect for the man.

He brought to light the financial institutions were issuing foreclosure documentation without carrying out their full responsibilites to look into each case i.e. property was being rented and tenants had no idea the owners of the property were not paying mortgages. These people only learned this when the Sheriff showed up serving foreclosure evictions. If the financial institutions had done their work properly, they would have known it was tenants. A solution may have been worked out that the rent they were paying every month could be directed to the mortgage payment as the owner was getting payment and doing something with the money. The banks or someone on behalf of tenants to cover their eviction costs, should be looking at suing owners as the tenants show receipts, checks, etc., there was a major breakdown.

Happy to hear Sheriff Dart is going to Washington to shed some light as it seems Washington is out of touch of what's happening on the street.

I know I posted on some blog that if the state was going to cause Sheriff Dart grief and possibly firing if that can be done in Illinois, I'd donate to fund to cover his legals.
