RAYMONDVILLE, Texas — A county prosecutor who brought indictments this week against Vice President Dick Cheney and others pounded his fist and shouted at the judge Friday during a routine hearing. Willacy County District Attorney Juan Angel Guerra asked Presiding Judge Manuel Banales to recuse himself from the case, which alleges abuse at federally run prisons.

Attorneys for the vice president and other defendants leapt to their feet in objection as Guerra pounded the table and accused Banales of giving the defendants special treatment.

"Now all of a sudden there is urgency," Guerra shouted. "Eighteen months you kept me indicted through the election."

Guerra lost his bid for re-election in the March primary and will leave office in January. He was indicted last year on charges he extorted money from a bail bond company and used his office for personal business, but the charges were dismissed last month.

Guerra said the judge was wrong to allow motions to quash the indictments to be heard before the defendants were arraigned.

Banales called a recess so he could try to contact the chief justice of the state Supreme Court for suggestions on how to proceed, and ordered Guerra, who had slipped out once during the hearing, to remain in the courthouse.

Guerra first said "I will not obey that order," but then agreed to stay if the judge asked him respectfully.

After the recess, Banales adjourned for the day and announced that he would send all documents pertaining to the recusal motion to the chief justice. He tentatively scheduled the parties to return to court Wednesday.

Curious residents packed the well-worn pews of the Willacy County Courthouse's only courtroom for Friday's hearing. The defendants were not required to appear in person.

Cheney and former Attorney General Alberto Gonzales were indicted in connection with privately run federal detention centers in Willacy. In particular, it alleges that Cheney's personal investment in the Vanguard Group, which invests in private prison companies, gives him culpability in alleged prisoner abuse.

Guerra also indicted judges and special prosecutors who played a role in the investigation of him.

T. Gerald Treece, a constitutional law specialist and professor at the South Texas College of Law in Houston, this week questioned Guerra's jurisdiction.

"You can't have district attorneys across the country bringing charges against federal officials," Treece said. And even in a federal probe, Cheney and Gonzales have a "qualified privilege" that would protect them so long as they were acting within their jobs, Treece said.

I found it very unusual that when the country voted in the Democrats that they wanted justice not someone saying it's off the table. I have the feeling we will never get justice for the last 8 years, I just find it hard to believe they tried to Impeach Clinton for shady sexual lying but it's off the table when we were lied into wars and all sorts of crap. I'm wondering what is going on, we deserve justice and I don't see it happening.

Interesting that you suggest (and I concur) that the country voted in 06 for "justice" -- Rahm Emanuel would likely disagree, as he did to resounding boos on Bill Maher's show in '07. According to Emanuel, the Democrats took Congress for the sake of the economy.

But here's the thing about justice: justice delayed is justice denied. And it isn't just Pelosi; it's beginning to look like Obama is willing to let the Bush administration slip gently into that good night. With all that Obama has on his plate, it might seem to some petty to expect him to settle old scores. But many of us still believe it is neither petty nor counter-productive -- it is absolutely necessary to restore confidence in the rule of law. Without an accounting, these people will be back and others will join them, more emboldened than ever.

Reid and Pelosi saw that they would not be able to get the 2/3 votes needed. They were wise to not pursue this until they had the necessary votes to do so. Wise indeed.

We need to stop playing armchair QBs. After all, we are not intelligent to be holding an elected position.

Oh I know, neither was Bush, but he holds the highest on in the land. Gosh darn it!

How can you pardon someone before they are even convicted or sentenced? What are you pardoning them of... crimes they MAY be convicted of in the future????

This should be a lesson to everyone, that despite the cost, prisons and detention facilities should never be mixed with a profit motive. The more dysfunction the immigration situation is on the border, the more private companies that run detention centers will profit. If Cheney wanted to play Texas Hold 'Em, he should have had to ask Congress for the money, not outsource to mercenary prisons who profit from human misery and then use that money to bend local politics the way they like.

why do you think the marajuana laws are so strick and cause prison terms for minor offences?....they need the immates to make a profit. Something like 70% are non-violent drug related crimes....yet murderers like Bush and Chenay get off scot free.

Regardless of the personalities involved, the question is: Were crimes committed? And the followup: Are Cheney and Gonzales involved? If so, the motivation of the prosecutor is not an issue.

I think this kind of retribution is good for the soul of America. Cheney, Gonzales and Bush should get the French treatment... Where are the Jacobins?

Dragging these guys through the street... [after a proper trial, heh heh heh.] is what America is craving.

REVENGE... RETRIBUTION... and closure.

Forget the high ground. If you want to heal the country -- let's start the hangings. And that includes the CEO's of Lehmans, Goldman Sachs... Paulson, Bernanke... every single one of these monsters.
