Nude Pics In Phone Lost At McDonald's End Up Online

FAYETTEVILLE, Ark. — Here's some food for thought: If you have nude photos of your wife on your cell phone, hang onto it.

Phillip Sherman of Arkansas learned that lesson after he left his phone behind at a McDonald's restaurant and the photos ended up online. Now he and his wife, Tina, are suing the McDonald's Corp., the franchise owner and the store manager.

The suit was filed Friday and seeks a jury trial and $3 million in damages for suffering, embarrassment and the cost of having to move to a new home.

The suit says that Phillip Sherman left the phone the Fayetteville store in July and that employees promised to secure it until he returned.

Manager Aaron Brummley declined to comment, and other company officials didn't return messages.

When you leave something behind, isn't that your negligence? He knew he had nude pics in his camera--why didn't he keep up with his phone? Hmmmm....does anyone (hehehe) smell something fishy here?

This is exactly why we have the courts. How can you people espouse opinions without really knowing the details of what happened? This will be easy to disprove in court, if untrue. Winning against a corporate giant like McD is another story. For $3 million, you can bet there will be a bevvy of lawyers showing up on the company's behalf, Vs. the couple's single attorney without equivalent resources. Even if righteous, they have little chance of prevailing.

Bottom lines: If this guy called McD and they said they would secure the phone, but instead one of the company's representatives posted the photos and actual damages occurred ... then I think the couple has every right to WIN a lawsuit.

If it turns out, as many commenters appear to believe (and may or may not be correct), that the couple is scamming McD -- then they should LOSE the lawsuit and McD should WIN a countersuit for their own damages.

Ok I totally get the nude pics on the cell. I have even had a similar experience with people " stealing" my personal porn, and it was slightly embarassing, but more funny than anything. ( I also live in a small town in Arkansas, so I get that part too.)
What I don't get are these few things - a)How and through what stretch of the imagination is McDonalds responsible? b) How did they ever find them to know that they were "online"? c) When I post anything online (even this comment) I have to have an account with that site where I have to register at least my e-mail address, so wouldn't it be completely obvious who posted the pics? d) If they had any kind of desire for privacy in this matter , why are they doing something so ridiculous that it has made international news (it's on BBC too)?

Do you want fries with that? I think these two are scammers trying to make a fast buck. Someone who'd let their husband walk around with nude pics of herself on a cell phone would not be so worked up over having the pics land on the net. That type of person would be an exabitionist and this just sounds wrong. Can you imagine if they'd left the phone at Jack in the Box... ;- }
