FAYETTEVILLE, Ark. — Here's some food for thought: If you have nude photos of your wife on your cell phone, hang onto it.

Phillip Sherman of Arkansas learned that lesson after he left his phone behind at a McDonald's restaurant and the photos ended up online. Now he and his wife, Tina, are suing the McDonald's Corp., the franchise owner and the store manager.

The suit was filed Friday and seeks a jury trial and $3 million in damages for suffering, embarrassment and the cost of having to move to a new home.

The suit says that Phillip Sherman left the phone the Fayetteville store in July and that employees promised to secure it until he returned.

Manager Aaron Brummley declined to comment, and other company officials didn't return messages.

This is definitely inside job ,leave phone mcdonalds,then find nude pictues internet,these people belong in jail for this,I dont see how mcdonalds responsible for lost phone

We cannot sue Congress for giving away our civil liberties to a failed Texas oilman. We cannot even sue the phone companies for enabling this because the president elect joined with them on the vote.

And thanks for reminding why I should stay the hell away from here. I'm better off not knowing how many of my fellow liberals are as addicted to the squabbling and finger-pointing as our right wing opponents are. That knowledge isn't helpful when, from time to time, doing partisan battle is actually necessary.

How did they find the photos online anyway? There's an ocean of amateur nude photos out there. Unless the wife is holding up a sign with her name and address in the photos, it's unlikely anyone would ever connect them with the photos.

My guess: The husband posted the photos himself. He may have even left the phone in McD's on purpose so he cold sue them.

Why do people do silly things and then blame everyone but themselves....because that is human nature....we humans are not big on accepting blame but we are huge on doing silly things . so when other human beings are so willing to make excues for OUR behavior ....which is also human nature....so willing to make excuses for the stupidity WE make .......why not blame the "other guy".

What is up with everyone so concerned about protecting McD's? How long does it take them to make a $3 mil profit? 10 minutes? Maybe if they paid people a respectable wage, they would not have to hire unemployable sociopaths.
Having private pictures on your phone is not a great idea, but seriously, lets not jump to McDonald's defense. If they hired people with a modicum of professionalism, this would not happen.

The question isn't if McDonald's has enough money to pay. The question is whether they are responsible. If you're stupid enough to put naked pictures of yourself and your wife on your phone and aren't responsible enough to take proper care of your own phone, why are 16-year-old employees at McDonald's held to a higher standard to look after your phone?

To their credit, McDonald's pay it's workers above the minimum wage and includes a pretty generous benefit package for their full time employees, including health insurance, vacation, and education reimbursement. Ask for those same things at Wal-Mart and security will escort you to the door.

The hot coffee case was a jury trial. You need to give juries more credit. Non-attorneys love to criticize jury awards because they don't understand them and how they are broken down - until it happens to them.

I don’t know what I think about this case. On one hand it is stupidity on the part of the husband, and on the other part the employee broke their word.

I have a problem with people setting themselves up for stupid things and then someone comes along and takes advantage of them and it is ALL the other persons fault. You should know better than to have dirty pictures on you phone if you don’t want to take the chance of someone else seeing them.

When you put yourself in potentially dangerous or embarrassing situations you are at least partly responsible for the consequences.

And the coffee thing still pi$$es me off. If I remember correctly it was an old lady riding with her grandson in his Alfa Romeo sports car and it had no cup holders. So she put the hot coffee between her legs. My problem is this woman would have raised 7 different kinds of hell if her coffee had been at say 160 degrees instead of 190. But she had no idea her coffee was that hot!! Bull Spit!

If I had spilled hot coffee on my lap, I would admit that I had SPILLED THE COFFEE ON MYSELF. If my wife sent me naked pictures of herself and then I left the phone behind, I would be mad at the PERSON who posted the pictures, but I would NOT be suing the company!!!

That hot coffee "incident" that is constantly referred to was the last in a line of over 700 complaints about burns from the coffee at various McDonald's, nationwide. Secondly, the suit came only after McDonald's refused to pay for the medical expenses of treating the THIRD DEGREE BURNS which were verified at the treating hospital. I don't believe a penny has been paid (not sure about that one) to the plaintiff as of this date. I am an investigator with several law firms that do personal injury and product liability work, and this case is a classic rebuttal of the argument for tort reform.

I live in Fayetteville and according to local newspapers the suit was filed in the Washington County, Arkansas courts. According to the local news sources it is not a hoax and apparently it was an employee of the McDonald's that posted the pictures AFTER they had been notified of the phone being left there and were supposed to have secured it in the manager's office.
