FAYETTEVILLE, Ark. — Here's some food for thought: If you have nude photos of your wife on your cell phone, hang onto it.

Phillip Sherman of Arkansas learned that lesson after he left his phone behind at a McDonald's restaurant and the photos ended up online. Now he and his wife, Tina, are suing the McDonald's Corp., the franchise owner and the store manager.

The suit was filed Friday and seeks a jury trial and $3 million in damages for suffering, embarrassment and the cost of having to move to a new home.

The suit says that Phillip Sherman left the phone the Fayetteville store in July and that employees promised to secure it until he returned.

Manager Aaron Brummley declined to comment, and other company officials didn't return messages.

No one told the employees to post them online. it would've been diff if the phone was just returned but those employees felt the need to take something private and post it online. like y would some1 do that to damage some1s image on purpose? wut were the employees getting out of it except some kind of enjoyment over some1 else embarrassment. it was stupid and they should pay for it. and any1 who take pictures of any1 nude and publicly release them without approval from the person in the photo should be held accountable. th media as to get consent to use photos of ppl so atleast do that first

Accountability is key here and you are right, the employee should be accountable. But so should the man for leaving his phone. I think 3 Million is excessive, moving to another address is excessive. Understand that the employee (hate to be sterotypical) works at McDonalds for cryin out loud. Must be a teenager or . . . someone who generally hasn't learned how to make great life choices . . do you really expect them to respect other's property?

My 4 yr old calls Ronald McDonald "the man with the lipstick". "Mumma can we go to the place with the man with the lipstick?"
Usually I say NO and we go for Sushi instead.

Why take nekkid photos of your wife with your cell phone? Isn't the real thing, which you get to see fairly frequenly, lots better than a lo-res photo on your phone? I understand that people do this, but I truly don't get it.

I hope it wasn't so that he could show the photos to his buds...ala Robert Hanssen. Creepy...
